DECLARATION
of 15 July 2011
on the formalities for handling and operating orders for water works
The Ministry of Agriculture provides pursuant to § 59 (1) (a) of Act No. 254 / 2001 Coll., on Water and on the amendment of certain laws (Water Act), as amended by Act No. 150 / 2010 Coll.:
Basic concepts
For the purposes of this decree:
(a) water work handling order - a set of principles and guidelines for water handling for its efficient and economical use, according to the permit for the handling of surface or groundwater and building permit for the water part, to reduce the adverse effects of floods, droughts and ice phenomena, to protect and improve water quality, as well as to ensure the safety, stability and reliability of the water work;
(b) the operating order of the water works - a set of principles, instructions and documentation for the operation and maintenance of the water works objects and equipment;
(c) security - the probability of securing the desired purpose for which the waterworks are intended, expressed as a percentage,
(d) identification - name and surname, date of birth and, where applicable, name of the company, address of permanent residence and telephone, fax and e-mail (hereinafter referred to as the "communication link"); in the case of a legal person, the business name, identification number, if any, address of the registered office and communication link;
(e) a comprehensive control order - a set of principles and guidelines for coordinating water handling in the water works system.
Forms of the handling orders
(1) The formalities for the handling of water works are:
(a) details of:
1. identification of the owner or user1) and, where appropriate, of the water works builder;
2. identification of the person responsible for handling the water;
3. identification of the water flow manager;
4. the water control centre of the river basin manager,
5. the competent authority of water,
6. identification of the person responsible for the implementation of technicosecurity supervision (2) and of the person responsible for carrying out the technical revision of the water work declared under Article 15a of the Water Act;
7. relevant flood bodies,
(b) technical information on and related to the water works, which is:
1. the name, location and brief description of the water work, the description of the function of the water work and those parts thereof which are used for water handling and water handling control;
2. details of the construction permit and the decision on its approval;
3. the purpose of the water work; if the waterworks serve several purposes, they shall be listed in order of importance;
4. details of the authorisation for the treatment of surface or groundwater relating to the water part, including the scope of the authorisation,
5. category of water works under another legislation3),
6. the security of the required water use requirements for the water works which accumulate or raise water,
7. the possibility of reducing flood flows in water works which accumulate or swell water;
8. the basic hydrological data of the water stream on which the water works are located, or, where appropriate, other hydrological data or documentation related to the water part or the way in which water is managed in the water tank;
9. List of technical and legal provisions related to water works used for drawing up the handling rules,
(c) the essential requirements, principles and guidelines for water handling on the water works;
(d) the essential requirements, principles and guidelines for the handling of water on a water body integrated into a system of water works resulting from a complex handling order, if it is processed for a system of water works;
(e) guidelines on water handling in emergencies and the implementation of security measures, in particular taking into account:
1. protection against floods exceeding the design parameters of the water works;
2. the situation in the threat to the safety and stability of the water works;
3. the situation in damage to the objects and equipment of the water works,
4. the situation in the critical water shortage;
5. the situation in the event of an accident (4) on the waterworks or on the watercourses above and below the waterworks;
6. the situation in such a deterioration in surface water quality that the water works cannot serve their purpose,
(f) the type, method, range and frequency of measurements and observations on the water work required for handling water;
(g) lists of important addresses and communication links, in particular the relevant water law authority, zoning hygienist, fire department of the Czech Republic, police of the Czech Republic, medical emergency services, integrated emergency services and flood and crisis management bodies; if the water work is part of the monitored waterway used for transport, the relevant branch of the State Navigation Administration shall be included in the list of important addresses and communication links,
(h) the principles of cooperation in the handling of water between owners or users (1) of related water works and, where appropriate, the common principles of the handling rules of such water works;
(i) other provisions containing:
1. the method and frequency of carrying out control measurements on discharge and sampling facilities within the scope and time limits for the verification of capacity and specific curves;
2. the determination of the period for carrying out revisions and maintenance on individual objects and equipment of the water works, suitable for hydrological and for ensuring the purpose of the water works;
3. Rules on record keeping of water handling and evaluation of extraordinary water handling;
(j) Annexes to the Rules of Procedure which contain:
1. water handling aids providing the information necessary to decide on water handling as referred to in (c) and (e) and to evaluate the measurement and observation referred to in (f);
2. drawing part of the project documentation of the water works to the extent necessary for handling water;
3. legal and other documentation relevant to the management of the handling of water works or to the assessment of the results achieved, such as the authorisation for water parts and for water parts, may also be annexed to parts of flood plans related to water parts,
4. evidence of an update of the handling rules,
5. a protocol to familiarize water works with the handling order.
(2) Where a water work is divided into integrated, functionally separated parts or involving more than one owner or user in the handling of a water work (1), the relevant section of the handling order may be developed separately for each whole part of the water work or for each individual owner or user (1) to a reasonable extent.
(3) For water works on a water stream which are interconnected in an operational manner, a single handling order may be drawn up.
(4) The Manipulative Rules contain title list 5), for which a list of its annexes is attached. The note shall draw attention to the documents and the location of their storage which are stored outside the set of handling rules; the particulars referred to in paragraph 1 are further classified.
Forms of operating regulations
(1) The formalities for the operating order of the water works are:
(a) details of:
1. identification of the owner or user1) or, where appropriate, of the water works builder, indicating their share of the operation and maintenance of the water works;
2. identification of the water supply or sewerage operator (6) and its share in the operation and maintenance of the water works in terms of public water supply and sewerage;
3. identification of the person responsible for the operation of the water works;
4. Territorial competent authority of the water authority;
5. identification of the person responsible for the implementation of technicosecurity supervision (2) and of the person responsible for carrying out the technical revision of the water work declared under Article 15a of the Water Act;
(b) technical information on and related to the water works, which is:
1. the name, location and brief description of the water work and its function, the basic technical data on capacity or performance, the list of its parts and equipment covered by the operating rules;
2. details of the permit for the handling of waters relating to the water part, the building permit for the water part, the decision on its approval or the approval for the water part;
3. the category of water works under another legislation3),
4. details of the approval and validity of the handling rules, if any,
(c) operating data and indicators necessary to ensure sound and reliable operation
1. for water works pursuant to § 55 (1) (a), (d), (f), (g), (h), (i), (l) of the Water Act, according to the relevant section of the Technical Standard (7);
2. for water works pursuant to § 55 (1) (c) of the Water Act, according to the relevant parts of technical norem8),
3. for water works pursuant to § 55 (1) (e) of the Water Act, according to the relevant section of the Technical Standard 9),
(d) instructions for operation and maintenance, broken down by function and type of objects and equipment
1. for water works pursuant to § 55 (1) (a), (d), (f), (g), (h), (i), (l) of the Water Act, according to the relevant section of the Technical Standard (7);
2. for water works pursuant to § 55 (1) (c) of the Water Act, according to the relevant parts of technical norem8),
3. for water works according to § 55 (1) (e) of the Water Act, according to the relevant parts of the Technical Standard 9),
4. the determination of the period for carrying out revisions and maintenance of individual waterworks objects and equipment, suitable both for hydrological purposes and for ensuring the purpose of the waterworks;
5. the method and frequency of carrying out control measurements on discharge and sampling facilities, to the extent and time limits for the verification of capacity and specific curves;
(e) instructions for operation, maintenance and service during winter;
(f) operating and operating instructions in emergency situations, including those caused by the danger of a terrorist threat to the water works;
(g) lists of important addresses and communication links, in particular the relevant water law authority, zoning hygienist, fire department of the Czech Republic, police of the Czech Republic, medical rescue service, integrated rescue system components and crisis management bodies, competent inspectorate of the Czech Environmental Inspection Office, water flow manager, river basin manager; if the water work is part of the monitored waterway used for transport, the relevant branch of the State Navigation Administration shall be included in the list of important addresses and communication links,
(h) the principles of cooperation between persons involved in the operation of the water works and the common principles of the sub-operational rules;
(i) guidelines for ensuring the compliance of the operating rules with the related rules, such as the handling rules, the oversight programme under other legislation3), emergency and crisis plans (determination of the scope and frequency, location and type of regular measurements and observations needed for the operation of the water work);
(j) provisions on the extent, frequency, location and type of regular measurements and observations during the operation of water works for which the handling rules are not processed and technical safety oversight is not carried out;
(k) details of:
1. the period of validity of the working order of the waterworks;
2. the implementation of changes to the operating rules when the construction of the water works is changed or when the conditions of operation of the water works are changed;
3. keeping an operating journal, operating records and books of revisions, changes and maintenance;
4. a set of safety, fire and sanitary instructions,
5. an overview of measures ensuring the safety of workers;
(l) Annexes which include:
1. the drawing part of the project documentation to the extent and in the execution needed for the operation and maintenance of the water works;
2. a protocol to familiarise operators with the operating order of the water works.
(2) Where the water works are divided into integrated, functionally separated parts or are involved in the operation of multiple persons, the interconnected operational schedules for each part or, where appropriate, the technological equipment of the water works may be drawn up.
(3) The operating order of the water works intended for the treatment of waste water into a capacity of 50 equivalent inhabitants, the essential part of which according to § 15a (1) of the Water Act are the products marked CE according to Act No. 22 / 1997 Coll., on the technical requirements for products and the addition of certain acts, as amended, unless otherwise provided by the Water Authority in the building permit.
(4) The operating rules include title list 5), for which a list of its annexes is attached. The note shall draw attention to documents and the location of their storage which are stored outside the set of operating rules; the particulars referred to in paragraph 1 are further classified.
Transitional provision
Manipulative and operational rules developed and approved under existing legislation remain in force.
Repeal
Decree of the Ministry of Agriculture No. 195 / 2002 Coll., on the formalities for the handling and provocation of water works, is repealed.
Efficacy
This Decree shall take effect on 1 August 2011.
