Law on the service income and wages of state and of certain other public employees, called for a presentative service or military training at certain starting dates

on the service income and salary of state and certain other public servants, who are called up to the presence service or military training on certain starting dates.
The Constitutional National Assembly of the Czechoslovak Republic decided on this law:
§ 1.
(1) The provisions of this Act apply to:
(a) employees of the State, the volumes of the local government and other public corporations and foundations;
(b) staff members belonging to, or managed by, the bodies referred to in (a);
(c) the staff members to whom the teaching law applies;
(d) professors of theological dieceses (§ 211 of the salary law);
where it does not determine whether the employment relationship is public or private (contractual).
(2) The provisions of this Act shall not apply to staff of nationalised and national enterprises and their central or regional authorities, nor to staff of Central Bank and Regional Bank Administration, Insurance Board and Regional Insurance Board.
§ 2.
(1) The staff referred to in Paragraph 1 (1), called for a presentative service or military training at the starting dates of 1945 and 1946 and 1 April, 2 May and 1 July 1947, or, in the case of staff born in 1922, at a later date, for as long as such service or training takes place in the form of a staff member or at the rank of a representative of a presentative service, in the place of any other service benefits or wages under other regulations, if:
a) o zaměstnance svobodné, kteří ze zákonné nebo mravní povinnosti poskytují příbuzným do 4. stupně, sešvagřeným do 2. stupně, osvojeným dětem nebo schovancům, osvojitelům nebo pěstounům nebo nemanželským dětem ve vlastní domácnosti byt a výživu, dále pak o zaměstnance ženaté, rozvedené, rozloučené nebo ovdovělé 60%,
b) o zaměstnance ženaté, kteří vydržují domácnost alespoň pro jedno dítě, na něž přísluší výchovné nebo rodinný přídavek 75%
služebního příjmu nebo mzdy, na které mají nárok.
(2) The provisions of paragraph 1 shall also apply to staff born in years corresponding to the years of birth of staff called in the starting dates referred to in paragraph 1 who have been or will be called for a presentative service or military training at the starting dates of others.
(3) The service income referred to in paragraph 1 shall be the non-educational (corresponding to part of the contract salary), the salary allowance according to the decree of the President of the Republic of 20 August 1945, No 58 Coll., on the contribution of state and certain other public servants, the special allowance provided for in the Act of 13 December 1945, No 159 Coll., on the special allowance of state and certain other public employees, and on the amendment of certain provisions on the temporary adjustment of civil servants' salaries, as amended by the Act of 2 April 1947, No 69 Coll., the special allowance provided for by the Act of 28 February 1942, No 129 Coll.
(4) The cost of education is, if legal conditions are met, at full cost.
(5) Wages referred to in paragraph 1 shall mean basic wages, corresponding to working hours of 48 hours a week without any allowances or allowances.
(6) The service income (wage) in the area referred to in paragraph 1 with the education referred to in paragraph 4 may not be less than the national maintenance allowance under the relevant provisions on the provision of a national maintenance allowance to the families of persons performing a military service. Any difference shall be paid to the staff member at his request, which shall be submitted no later than 6 months after completion of the service or military training.
(7) If the presence service or military training has been extended by more than 30 days from the sentence, the service income (salary) in the area referred to in paragraph 1 shall not be subject to the training referred to in paragraph 4 for the duration of that extension.
§ 3.
The basis for calculating the amounts referred to in Article 2 (1) shall be the service income or salary referred to in Article 2 (3) or (5) after deduction of the allowances which a staff member would pay under the relevant public social insurance rules.
§ 4.
The family members of the staff referred to in Paragraph 1 (1) shall not be entitled to a national maintenance allowance in accordance with the relevant rules on the provision of a national maintenance allowance to the families of persons performing a military service.
§ 5.
The service income (salary) referred to in Paragraph 2 (1) and the education allowance may be paid to the staff member or to the person empowered by the staff member to receive such service income (wages).
§ 6.
The provisions and arrangements for more favourable employees, as well as the provisions of § 8, paragraph 1 of the Act of 31 March 1925, No 61 Coll., on the maintenance of the working (service) conditions during the training in arms (service), and the provisions of § 1 of the Law of 16 January 1946, No 18 Coll., on the working conditions of persons entering the service, remain unaffected.
§ 7.
This Act shall take effect on 1 October 1945; it shall be carried out by all members of the Government.
