DECLARATION
of 3 October 2014
amending Decree No 314 / 2013 Coll., on the submission of statements to the Czech National Bank by persons belonging to the financial institutions sector
The Czech National Bank provides pursuant to § 41 paragraph 3 and § 43 paragraph a) of Act No. 6 / 1993 Coll., on the Czech National Bank, as amended by Act No. 227 / 2013 Coll.:
Decree No 314 / 2013 Coll., on the submission of statements to the Czech National Bank by persons belonging to the financial institutions sector, is amended as follows:
1. footnote 1 shall read:
"(1) Article 5 of Protocol (No 4) on the Statute of the European System of Central Banks and of the European Central Bank. Council Regulation (EC) No 2533 / 98 of 23 November 1998 concerning the collection of statistical information by the European Central Bank, as amended. Regulation (EU) No 1071 / 2013 of the European Central Bank of 24 September 2013 on the balance sheet of the MFI sector (recast) (ECB / 2013 / 33). Regulation (EU) No 1073 / 2013 of the European Central Bank of 18 October 2013 on statistics on the assets and liabilities of investment funds (recast) (ECB / 2013 / 38). Regulation (EU) No 1075 / 2013 of the European Central Bank of 18 October 2013 on statistics on the assets and liabilities of FVCs involved in securitisation transactions (recast) (ECB / 2013 / 40). Regulation (EU) No 1409 / 2013 of the European Central Bank of 28 November 2013 on statistics on payments (ECB / 2013 / 43). Regulation (EC) No 184 / 2005 of the European Parliament and of the Council of 12 January 2005 on Community statistics on balance of payments, international trade in services and foreign direct investment, as amended. ';
2. footnote 3 shall read:
"(3) Article 2 of Regulation (EU) No 1071 / 2013 of the European Central Bank."
3. in Article 3 (f), including footnotes 4 and 5:
"(f) an FVC pursuant to a directly applicable European Union regulation governing the statistics of the assets and liabilities of FVCs involved in securitisation transactions (4), or a person who, under this directly applicable European Union law, is responsible for the submission of FVCs' statements in securitisation transactions (5) (hereinafter referred to as FVCs);
4) Article 1 (1) of Regulation (EU) No 1075 / 2013 of the European Central Bank.
5) Article 2 (3) of Regulation (EU) No 1075 / 2013 of the European Central Bank. '
4. In Article 3, at the end of point (g), the dot is replaced by a comma and the following points (h) to (j) are added:
"(h) savings and credit cooperatives (hereinafter referred to as the" cooperative reserve "),
(i) a payment institution and a branch of a foreign payment institution operating in the territory of the Czech Republic (hereinafter referred to as "payment institution");
(j) an electronic money institution and a branch of a foreign electronic money institution operating in the territory of the Czech Republic (hereinafter referred to as the "electronic money institution"). "
5. The following Section 9a is inserted after Section 9, including the title:
Statement of cooperative reserve, payment institution and electronic money institution
(1) The cooperative deposit at the end of each calendar year draws up the statement DZ (ČNB) 11-01 "Annual statement of payment by the cooperative reserve."
(2) At the end of each calendar year, payment institutions and electronic money institutions draw up a statement of PLT (CNB) 12- 01 "Annual statement of payment by payment institution and electronic money institution."
(3) The cooperative deposit office, payment institutions and electronic money institutions shall submit to the Czech National Bank the statements referred to in paragraphs 1 and 2 by 20 February of the following calendar year.
(4) The content of the statements referred to in paragraphs 1 and 2 is set out in Annex 7 to this order. "
6. In footnote 8, the last sentence on a separate line is replaced by "Article 1 (a) of Regulation (EU) No 1071 / 2013 of the European Central Bank."
7. the following Annex 7 is inserted after Annex 6:
"Annex No 7 to Decree No 314 / 2013 Coll.
Content of the statement of the cooperative reserve, payment institution and electronic money institution
DZ (ČNB) 11-01 "Annual statement of payment of cooperative bookmarks"
PLT (ČNB) 12-01 "Annual statement of payment by payment institution and electronic money institution'
The statement shall contain information on the number and type of accounts held by the clients, the number and volume of client transactions by type of payment service in the geographical breakdown, the number and volume of payment transactions made by the card issuer, the type and type of payment transactions made by the card, the number and volume of client transactions by type of payment service in the geographical breakdown, the number and volume of payment transactions made by the customer account or by the trader. ';
Efficacy
This Decree shall enter into force on 1 January 2015.
