Act amending and supplementing the legal measure of the Federal Assembly Bureau No 366 / 1992 Coll., on measures in relation to the Federal Republic of Yugoslavia (Serbia and Montenegro)

THE LAW
of 10 July 1993
amending and supplementing the statutory measures of the Federal Assembly Bureau No 366 / 1992 Coll., on measures relating to the Federal Republic of Yugoslavia (Serbia and Montenegro)
Parliament has decided on this law of the Czech Republic:
Čl. I
The legal action of the Bureau of the Federal Assembly No 366 / 1992 Coll., on measures in relation to the Federal Republic of Yugoslavia (Serbia and Montenegro) shall be amended as follows:
1. In Article 2 (1), the words "Czechoslovak flag and aircraft imatriculated in the Czech and Slovak Federal Republic 'are replaced by the words" flag of the Czech Republic and aircraft imatriculated in the Czech Republic'.
2. In Article 2 (2), a comma is inserted after the word "purposes' and the words" and foodstuffs' are replaced by the words "food and other necessary humanitarian needs'.
3. In Article 2, the following paragraph 4 is inserted after paragraph 3:
"(4) In the case of the sale or supply of weapons and military equipment, the prohibition set out in paragraphs 1 and 3 shall apply to all States in the territory of the former Socialist Federal Republic of Yugoslavia. ';
4. The following Section 2a is inserted after Section 2:
„§ 2a
The import, export and transit of goods and products in the areas of the Republic of Croatia protected by the United Nations forces and in the areas of the Republic of Bosnia and Herzegovina controlled by the Bosnian Serbs, with the exception of basic humanitarian supplies, including medical supplies and foodstuffs distributed by international humanitarian organisations, shall be permitted only with the consent of the Government of the Republic of Croatia or the Government of the Republic of Bosnia and Herzegovina. ';
5. In Article 3 (1), the words "and any natural or legal person controlled or directly or indirectly controlled by such entities, regardless of their registered office or residence 'shall be inserted after the words" in the Federal Republic of Yugoslavia (Serbia and Montenegro)'.
6. in Article 3 (2), the words "in the Federal Republic of Yugoslavia (Serbia and Montenegro) 'are replaced by the words" in paragraph 1';
7. the following Sections 4a, 4b, 4c and 4d are inserted after Section 4:
„§ 4a
The provision of services, both financial and other, by domestic persons to natural and legal persons for the purposes of any business in the Federal Republic of Yugoslavia (Serbia and Montenegro) shall be prohibited. This prohibition shall not apply to telecommunications, postal services and legal assistance, as well as services necessary for humanitarian or other exceptional purposes, provided that authorisation has been granted pursuant to Paragraph 7.
§ 4b
The entry into the territorial waters of the Federal Republic of Yugoslavia (Serbia and Montenegro) of commercial vessels flying the flag of the Czech Republic, except in cases of emergency or on the basis of an authorisation granted under Section 7, shall be prohibited.
§ 4c
It shall be prohibited to allow natural and legal persons holding sports matches in the territory of the Czech Republic to participate in them by persons or groups representing the Federal Republic of Yugoslavia (Serbia and Montenegro).
§ 4d
Any domestic activity, as well as any activity of other persons in the territory of the Czech Republic towards scientific and technical cooperation, as well as cultural exchanges and visits involving persons or groups officially supported by or representing the Federal Republic of Yugoslavia (Serbia and Montenegro), shall be prohibited. ';

„§ 6
The transit of goods and products through the territory of the Federal Republic of Yugoslavia (Serbia and Montenegro) via the Danube may be carried out by domestic persons only on the basis of an authorisation granted under Section 7; transit permits under Section 7 may be granted by other means only in exceptional cases. '

„§ 7
(1) The activities referred to in § 2 (2), § 4a, 4b and 6 may only be carried out on the basis of an authorisation granted by the competent central administration in each justified case. When granting authorisation, this authority shall proceed with the obligations arising for the Czech Republic from membership of the United Nations.
(2) The general rules on administrative procedures shall not apply to the authorisation referred to in paragraph 1.
(3) The application for authorisation referred to in paragraph 1 shall be submitted to:
(a) Ministries of Industry and Trade, if they are for export authorisation pursuant to Article 2 (2);
(b) the Ministry of Transport, if it is for authorisation to enter territorial waters under § 4b or transit under § 6,
(c) the Ministry of Foreign Affairs, if it is for authorisation to provide services under § 4a; a request for consent pursuant to Paragraph 2a shall also be submitted to this Ministry.
If the goods and products are exported from the Czech Republic, the border customs office shall withdraw the permit on exit. '
10. In Section 8, the words "and Slovak Federative" are deleted.
Čl. II
Where the legal measure refers to Czechoslovak natural and legal persons, this means domestic persons, i.e. natural persons resident in the Czech Republic, and legal persons established in the Czech Republic.
Čl. III
This Act shall take effect on the day of its publication.
