GOVERNMENT REGULATION
of 28 June 2023
amending Government Regulation No 463 / 2022 Coll., on the determination of electricity and gas prices in an exceptional market situation supplied for losses in distribution systems and on the compensation granted for the supply of electricity and gas for losses at specified prices
The Government orders the implementation of § 19d paragraphs 1 and 4 and § 19f paragraph 8 of Act No. 458 / 2000 Coll., on the Terms and Conditions of Business and on the Enforcement of State Administration in the Energy Sector and on the amendment of certain laws (Energy Act), as amended by Act No. 287 / 2022 Coll. and Act No. 365 / 2022 Coll.:
Government Decree No. 463 / 2022 Coll., on the determination of electricity and gas prices in an exceptional market situation supplied for losses in distribution systems and on the compensation granted for the supply of electricity and gas for losses at specified prices, is amended as follows:
1. In Article 1 (1), the words "the extent of the supply of electricity or gas for losses in which the specified prices of electricity and gas for losses apply, the range 'are replaced by the words" electricity and gas prices for losses, the range'.
2. Paragraph 8 (2) reads as follows:
"(2) In the case of a distribution system connected to the distribution system of the distribution system of the distribution system operator, to which the Energy Regulatory Authority determines the fixed price of the distribution system service or other distribution systems in the defined territory of such distribution system operator, the unit amount of the demonstrable losses and the reasonable profit from the electricity supply activity of the distribution system operator in CZK / MWh shall be determined as the difference between the lower of the electricity price of the electricity loss of the distribution system agreed by the distribution system operator for the electricity supply of electricity for the loss of electricity and the electricity price for the assessment of non-compliance with the power system operator's energy regulatory authority in accordance with paragraph 1 and the determined electricity price of losses referred to in Article 3 (2). ';
3. In Paragraph 8, the following paragraph 3 is inserted after paragraph 2:
"(3) If the price of electricity for the loss of electricity in the distribution system is agreed after 30 June 2023 or if, after that date, the price of electricity for the loss of electricity in the distribution system is agreed by the distribution system operator or if, as a positive difference between the price of electricity reached in the commercial hour of the day on the organised market by the operator in the CZK / MWh plus a premium of CZK 250 / MWh and the price of electricity for the loss in the distribution system in accordance with § 3 (1) or (2), the price of electricity for the distribution system is determined. '
Paragraphs 3 to 6 shall be renumbered paragraphs 4 to 7.
4. In Article 8, the following paragraph 5 is inserted after paragraph 4:
"(5) If the price of gas for gas losses in the distribution system is agreed after 30 June 2023 or if after that date the price of gas for gas losses in the distribution system is agreed by the distribution system operator, the unit amount of the demonstrable loss and reasonable profit from the gas supply activity for gas losses in the distribution system in CZK / MWh shall be determined as a positive difference between the price of gas in the index of the organised gas market of EEX European Gas Spot Index for the gas day for the trading zone of the Czech Republic EGSI CZ for gas in CZK / MWh plus a surcharge of 150 CZK / MWh plus the determined gas prices for gas losses in the distribution system in accordance with § 3 (3)."
Paragraphs 5 to 7 shall be renumbered paragraphs 6 to 8.
5. In Article 8 (6), the words "or 3 'shall be inserted after the words" paragraph 1' and after the words "paragraph 2 '.
6. In Paragraph 8 (7), "3 'is replaced by" 4 or 5'.
7. In Paragraph 9 (1), the word 'twelfth' is replaced by 'fourteenth'.
8. In Article 9 (4) (e), the words "and where the unit amount of the demonstrable losses and reasonable profit per calendar month is derived from the agreed price of electricity for the loss of electricity, the identification number or other identifier and the date of the contract with the distribution system operator, or the date of the negotiation of the last change in the contract content of the part concerning the price of electricity for the loss of electricity in the distribution system, if such change has been agreed," shall be inserted after the text "CZK / MWh.
9. in Paragraph 9 (5) (e), the words "or the date on which the last amendment to the content of the contract in the part concerning the price of gas for gas losses in the distribution system was negotiated," shall be inserted after the word "system."
10.Paragraph 10 (2) reads as follows:
"(2) In the case of a new application by an electricity or gas trader pursuant to the third sentence of Paragraph 19f (5) of the Energy Act, the procedure laid down in Article 9 (2) shall be followed. '
11. in Paragraph 13, paragraph 2 is deleted;
Paragraphs 3 and 4 shall become paragraphs 2 and 3.
Transitional provision
For the period of supply of electricity to the distribution system connected to the distribution system of the distribution system operator to which the Energy Regulatory Authority determines the fixed price of the distribution system service, or in other distribution systems within the defined territory of such distribution system operator by 30 June 2023, the unit amount of the demonstrable losses and reasonable profit from the electricity supply activity of the distribution system in CZK / MWh shall be determined in accordance with Article 8 (2) of Decree-Law No 463 / 2022 Coll., as effective before the date of entry into force of this Regulation.
Efficacy
This Regulation shall take effect on 1 July 2023.
