DECLARATION
of 10 July 2017
amending Decree No. 31 / 1995 Coll., implementing Act No. 200 / 1994 Coll., on Geometry and amending and supplementing certain laws relating to its implementation, as amended
The Czech office of surveying and cadastral provides pursuant to § 20 paragraph 1 of Act No. 200 / 1994 Coll., on surveying and amending and supplementing certain laws related to its implementation, as amended by Act No. 186 / 2001 Coll., Act No. 319 / 2004 Coll., Act No. 189 / 2008 Coll. and Act No. 380 / 2009 Coll.:
Decree No. 31 / 1995 Coll., implementing Act No. 200 / 1994 Coll., on Geometry and amending and supplementing certain laws related to its implementation, as amended by Decree No. 212 / 1995 Coll., Decree No. 365 / 2001 Coll., Decree No. 92 / 2005 Coll., Decree No. 311 / 2009 Coll. and Decree No. 383 / 2015 Coll., is amended as follows:
1. Paragraph 10c, including the title, reads:
Forms of data provision database
(1) The data database is provided by the Geometry Authority to the extent and structure permitted by the Geometry Information System in the following forms:
(a) data sets,
(b) a viewing service; or
(c) data download service.
(2) Data in the form referred to in paragraph 1 (a) or (c) shall be provided on request containing:
(a) identification details of the applicant;
(b) the scope, content and format of the required data;
(c) the purpose for which the data are required; and
(d) method of transmission of data.
(3) Data in the form referred to in paragraph 1 (b) shall be provided free of charge; data of the database in the forms referred to in paragraph 1 (a) and (c) shall be provided for remuneration as set out in the Annex (point 11). ';
2. The following Sections 10d and 10e are inserted after Section 10c, including the headings:
Conditions for publication and use of database data
(1) The data provided for the database may only be published by the applicant in a passive form inseparable from the applicant's application or cartographic work.
(2) The use of database data shall be subject to the indication of their source and the date of the last database update prior to the date of data provision.
(3) If the applicant publishes data images of the database in electronic form, he / she is obliged to insert the text "© ČÚK 'in a raster file in an inseparable way. At least one of these texts shall be visible and legible for each image shift. In addition to the field of displayed data, the text" Baseline data © ČÚK' must be given.
Preventing access to the database
The Geometry Authority shall prevent the user by technical means from accessing a view service or data download service which:
(a) overloads the technological infrastructure of the viewing or download services;
(b) the viewing or downloading service makes non-professional use or abuse of data;
(c) extend the database data although it is not authorised to do so; or
(d) he has failed to fulfil his obligation to pay for the data provided. ';
3. In point 4 (4.7) of the Annex:
"4.7. The levelling points are numbered within the registration units, which are the levelling shows which define the individual levelling areas (Figure 10.1) or the area levelling networks. In a separate number series, the numbers expressed by Roman numerals are numbered by the basic levelling points. The position of the levelling points is shown in the documentation maps.

4. In point 5 of the Annex, the sentence "Weight points are numbered by numbers expressed in Arabic numerals in one continuous numerical line from 1 to 9999, where necessary subdivided into two decimal places' is inserted at the beginning of sub-point 5.6.
5. in the Annex, point 10 (10.2) (a) and (b) read:
"(a) If a detailed measurement is only attached to two points, two points of position points or auxiliary points shall be used, and, if a free polar position is used, both horizontal directions and lengths shall be measured for both points.
(b) In determining the coordinates of the opinion by intersecting from directions or intersecting from lengths or as a free polar opinion, the opinion shall have at least one angle between the directions used between 30 and 170 gon. ';
6. In the Annex, the following point 11 is added:

Notes:
(a) The remuneration shall be fixed for each unit of measurement initiated.
(b) The provision of data in the form of data sets may be carried out by transmission on a technical data medium or in a way that allows remote access.
c) Minimum amount of payment for data provided in the form of data files and download services after counting the discounts according to points (g) and (j) is CZK 200.
(d) Data shall be provided in the coordinate systems and formats published on the Office's website.
(e) The remuneration for the provision of data in the second and other format provided at the same time shall be 20% of the basic remuneration for each additional format.
(f) The remuneration shall be increased by 50% if the applicant uses the data provided pursuant to Paragraph 10d (1).
g) The basic remuneration includes the transmission of updated data, which is requested within 1 year of the application for initial data release. After one year of application, the remuneration for updated data shall be 20% of the basic remuneration.
h) The payment for the download service is fixed for a period of 1 year and is due in advance. The amount of payment shall be determined by the number of units of measurement in the territory from which the data are to be downloaded at the date of application.
(i) Schools, educational establishments and higher education institutions for the purposes of education and students for the purposes of the processing of bachelor's, diploma or other work carried out for the purpose of obtaining an academic degree on the basis of a written application certified by the School shall be reduced by 100% by the payment for the data provided; data shall be provided only to the extent necessary. Data thus provided shall not be subject to the minimum amount of remuneration referred to in point (c).
j) Persons who provide the Geometry Authority with data which are the content of the database under § 4a of the Geometric Act and on the basis of which the updating of the database can be carried out shall be granted a discount, the amount of which shall be determined with regard to the territorial scope and content of the data transmitted for updating; a discount of up to 80% of the basic remuneration may be granted. ';
Efficacy
This Regulation shall enter into force on 1 September 2017.
