DECLARATION

amending Decree No. 177 / 2009 Coll., on the Closer Conditions for Termination of Education in Secondary Schools by Graduate Examination, as amended
The Ministry of Education, Youth and Sports provides, pursuant to § 81 (11), § 91 (1) and § 113a (2) of Act No. 561 / 2004 Coll., on pre-school, primary, secondary, higher vocational and other education (Education Act), as amended by Act No. 242 / 2008 Coll., Act No. 49 / 2009 Coll., Act No. 472 / 2011 Coll., Act No. 370 / 2012 Coll. and Act No. 82 / 2015 Coll.:
Decree No. 177 / 2009 Coll., on the Closer Conditions for Termination of Education in Secondary Schools, as amended by Decree No. 90 / 2010 Coll., Decree No. 274 / 2010 Coll., Decree No. 54 / 2011 Coll., Decree No. 273 / 2011 Coll., Decree No. 371 / 2012 Coll. and Decree No. 173 / 2014 Coll., is amended as follows:
1. In Paragraph 9, "90 'is replaced by" 105';
2. In Section 9, the second sentence is deleted.
3. After Paragraph 19, the following Section 19a is inserted:
Replacement test from a foreign language
(1) The examination of a foreign language for which the pupil has applied for in accordance with § 4 (2) (c) or (e) may be replaced by a standardized examination in accordance with the Education Act evidencing the pupil's language skills at level B1 or higher in accordance with the Common European Framework of Reference for Languages.
(2) Information on standardised examinations which the school director may choose to replace the foreign language examination in accordance with paragraph 1 shall be published by the Ministry by 31 March of each year at the latest in a way that allows remote access. The information shall be valid for the spring test period and the autumn test period in the following calendar year.
(3) A written request to replace the examination shall be submitted by the student to the school director no later than 31 March for the spring examination and no later than 30 June for the autumn examination. The application shall always include a certified copy of the successful completion of the standardised language examination. ';
4. In Paragraph 24, the sentence "If a pupil has replaced the exam from a foreign language by an examination in accordance with § 19a shall be added at the end of paragraph 4, instead of" replaced "in the protocols for the relevant test. '
5. In Article 26, the following paragraph 4 is added:
"(4) If the pupil has replaced the exam from a foreign language part of the profile part of the graduation exam by the examination according to § 19a, the certificate of the relevant examination instead of the degree of benefit shall state the word" replaced. "This test shall not be part of the overall assessment referred to in paragraph 2. ';
6. In Paragraph 31, the sentence "If a pupil has replaced a foreign language examination by an examination in accordance with § 19a, a certified copy of the proof of successful completion of that examination is also annexed to the report. '
Transitional provisions
1. Section 9 of Decree No. 177 / 2009 Coll., as effective before the date of entry into force of the Decree, shall apply for the duration of the didactic test of mathematics in the autumn trial period 2015.
2. Information on tests replacing the foreign language examination of the profile part of the graduation exam which the school director may determine for the performance of the graduation exam in the spring and autumn test periods 2016 shall be published by the Ministry by 15 September 2015 at the latest.
Efficacy
This Decree shall take effect on 1 September 2015.
