DECLARATION
of 21 May 2012
amending Decree No 14 / 2005 Coll., on pre-school education, as amended by Decree No 43 / 2006 Coll.
The Ministry of Education, Youth and Sports provides, pursuant to § 23 (3), § 35 (2) and § 123 (5) of Act No. 561 / 2004 Coll., on pre-school, primary, secondary, higher vocational and other education (Education Act), as amended by Act No. 49 / 2009 Coll.:
Decree No 14 / 2005 Coll., on pre-school education, as amended by Decree No 43 / 2006 Coll., is amended as follows:
1. Paragraph 1a (5) reads as follows:
"(5) The head of the parent school shall agree in writing with the legal representative of the child to attend the parent school. In the case of children under Paragraph 34 (9) of the Education Act, an extension of the attendance of a child who has not been restricted in the scope of the education decision may be agreed with effect from the first day of the second calendar month following the conclusion of the agreement; the conclusion of this Agreement shall be immediately communicated by the Director of the Parent School to the legal representative of the child who is being educated in the remainder of the period of time. ';
2. In Paragraph 1a, the following paragraph 7 is added:
"(7) Where an individual integrated education is provided in the parent school class, the principal of the parent school shall create conditions corresponding to the individual educational needs of the child leading to its versatile development. ';
3. In Article 2, the following paragraph 4 is added:
"(4) A child who is regularly educated at a nursery school for a shorter period than that corresponding to the relevant operation and another child who is educated in the remaining period under Section 34 (9) of the Education Act shall be classified in the same class. For the purposes of assessing compliance with the highest number of children in the class referred to in paragraphs 2 and 3, only 1 child shall be counted. ';
4. Paragraph 6 (3) reads as follows:
"(3) The remuneration for the school year concerned shall be fixed at the same monthly rate for all children of the same type of parent school. In the case of children in all-day or boarding school who are restricted by the child's parent for the purpose of receiving the parental allowance, the amount of the remuneration corresponding to a maximum of 2 / 3 of the amount of the remuneration laid down for all-day operation shall be determined separately in accordance with paragraph 1. ';
footnotes 3 and 4 are deleted.
5. In Article 6, the following paragraph 4 is inserted after paragraph 3:
"(4) For a child who, in accordance with § 34 (9) of the Education Act, does not count in the number of children in a kindergarten for the purpose of assessing compliance with the maximum authorised number of children registered in the school register and school establishments, the level of remuneration shall be determined by the principal of the school but shall not exceed 2 / 3 of the amount of remuneration in the relevant operation. ';
Paragraphs 4 to 6 shall be renumbered paragraphs 5 to 7.
6. Paragraph 6 (6), including footnotes 5 to 7, reads:
"(6) Free from payment is
(a) a legal representative of a child who receives a recurring dose of assistance in a material emergency (5);
(b) a legal representative of a dependent child, if the child is entitled to an increase in the care allowance (6);
(c) a parent to whom an increase in the childcare allowance is due (6) because of the care of an uninsured child; or
(d) a natural person who personally looks after the child and receives foster care benefits for the care of the child (7);
where this is demonstrated by the director of the parent school.
5) § 4 (2) of Act No. 111 / 2006 Coll., on aid in material distress, as amended by Act No. 366 / 2011 Coll.
6) Article 12 (1) of Act No. 108 / 2006 Coll., on Social Services, as amended by Act No. 366 / 2011 Coll.
7) Sections 36 to 43 of Act No. 117 / 1995 Coll., as amended. '
7. In Article 6 (7), "5 'is replaced by" 6';
Efficacy
This decree shall take effect on the first day of the calendar month following its publication.
