on the classification of municipalities into size categories by population, on the territorial breakdown of municipalities by grouping of cadastral territories, on the level of basic prices per floor area of flats, on the target values of monthly rent per m2 of floor area of an apartment, on the maximum increases in monthly rent and on the procedure for seeking the maximum increase in rent for a particular apartment
The Ministry of Local Development, in accordance with Section 4 of Act No. 107 / 2006 Coll., on unilateral increases in rent from the apartment and amending Act No. 40 / 1964 Coll., Civil Code, as amended ("the Act '), declares for the application of the unilateral increase in rent from the apartment between 1 January 2009 and 31 December 2009:
• classification of municipalities into size categories by population (without Prague and Brno) - listed in Annex 1,
• the territorial breakdown of Prague and Brno by grouping their cadastral territories - listed in Annex 2,
• basic prices in CZK for 1 m2 floor area of apartments and target value of monthly rent in CZK for 1 m2 floor area of apartment - listed in Annex 3,
• maximum monthly rent increases expressed as a percentage - listed in Annexes 4 and 4a,
• the procedure for finding the maximum monthly rent increase for a particular apartment.
According to the regions, Annex 1 lists all municipalities, except Prague and Brno, with a population of 2 000 or more and are classified in size categories depending on the population. The municipalities of the same name located in the same county are marked in brackets by the respective district. The municipalities with a population of less than 2 000 are not listed by name in this Annex; for the purposes of the search for the basic price and the target rent in Annex 3 and for the purposes of the search for the maximum monthly rent increase in Annex 4 and 4a, municipalities with a population of less than 2 000 inhabitants in the respective region belong to the size category "up to 1 999 inhabitants'. The municipalities are sorted into size categories based on data from the Czech Statistical Office on population as of 1 January 2008.
Annex No 2 lists all cadastral territories in Prague and Brno and is grouped into individual areas marked with numbers. This breakdown was taken over by Decree No. 3 / 2008 Coll., implementing certain provisions of Act No. 151 / 1997 Coll., on the valuation of assets and amending certain laws (Law on the valuation of assets), as amended.
Annex No. 3 lists the basic prices in CZK for 1 m2 of floor area of flats expressing the mean value of purchase prices of real estate based on statistics of real estate prices of the Ministry of Finance. In addition, the target values for monthly rent in CZK for 1 m2 of floor area of the apartment are shown for individual size categories of municipalities in individual regions and for individual areas of Prague and Brno; These targets can be reached at the earliest by 1 January 2010 (Section 2 (c) of the Act). These values were calculated using the formula in the Annex to the Act. The target values for monthly rent are given separately for lower-quality apartments, which are those defined in § 2 (e) to (g) of the Act. The floor area of the apartment is defined in § 2 (d) of the Act.
Annex No. 4 lists the maximum monthly rent increases as a percentage calculated for the current rent - i.e. the rent paid at the date of calculation of the unilateral increase - (in CZK / m2) according to the formula in the annex to the law and rounded to one decimal place. The current rent does not include rent for apartment equipment (§ 2 (b) of the Act), nor payments for services associated with the use of the apartment or for heating and energy. The values of the current rent broken down by size categories of municipalities in individual regions and by areas in Prague and Brno are given in CZK per 1 m2 floor area and rounded to two decimal places. The values of the current rent are not mentioned here, for which there is a low probability of their occurrence in the individual size categories of municipalities and in the areas of Prague and Brno, or values higher than the respective target rent. Annex 4a lists, in the same structure, the value of the current rent and corresponding maximum increases in rent for low-quality apartments.
The principle of raising rent under the law:
• The increase in rent during the duration of the lease relationship is negotiated by agreement between the lessee and the lessor, or unilateral, but limited, increase in rent under the law.
• A unilateral increase in rent must not exceed the maximum increase in monthly rent (percentage) determined for each specific value of the current rent - i.e. rent paid at the date of calculation of the unilateral increase - per 1 m2 floor area of the apartment in the respective size category of municipalities or regions of Prague and Brno.
• Maximum monthly rent increases can be calculated according to the formula set out in the Annex to the Act. For direct calculation of the maximum monthly rental increase for a particular apartment according to the formula in the annex to the Act, the basic prices or target values of the rent shall be used in CZK per 1 m2 floor area of the apartment depending on the size category of the municipality in the respective region of Prague or Brno, where the specific apartment is located. These values are given in Annex 3. The maximum monthly rent increases already calculated may alternatively be found in Annex 4 or 4a.
Procedure for seeking the maximum monthly rent increase for a particular apartment in the annexes to this Communication and determining the higher rent for the following increase:
1. Find out in Annex 1, within the respective region, the size category (by population) where the municipality where the specific apartment is located.
2. If a specific apartment is located in Prague or Brno, search the area to which the apartment belongs in Annex 2 according to the relevant cadastral area.
3. In Annex No. 4 (or 4a for apartments with reduced quality) in a horizontal line corresponding to the size category of the municipalities or regions of Prague or Brno (as indicated on the left side of the page), find the value corresponding to the actual current rental - i.e. the rent paid at the date of calculation of the unilateral increase ("AN"). If you do not find a specific value of the current rent, search the nearest lower value (to the right) in the same horizontal row. The values of the current rent equal to or higher than the target rent for the given size category of municipalities or the region of Prague and Brno are not listed here because the current rent cannot increase unilaterally for such values.
4. Subsequently, look in the header - i.e. in the first line above - of the column in which the actual rent is sought, for the maximum increase in monthly rent ("MP") expressed as a percentage.
5. By the maximum increase in the monthly rent "MP '(%), the lessor may increase the rent between 1 January 2009 and 31 December 2009. This means that the increased rent" ZN "(in CZK / m2) is derived from the current rent (i.e. rent paid at the date of calculation of the unilateral increase)" AN "(in CZK / m2) as follows:

AN * MP100 + 1 = ZN
An example of the procedure for finding the maximum monthly rent increase for a particular apartment:
For example - the apartment is located in Pečky in the Central Bohemian Region, it is of reduced quality and it is paid the current monthly rent 18.13 CZK for 1 m2 of floor space.
In Annex 1, the municipality of Pečka is listed in the size category "Municipality of 2000 - 9999 inhabitants' as shown in the following figure:

On the basis of this classification of the village of Pečky into the relevant size category (2000 - 9 999 inhabitants), the value of the current rent in CZK / m2 (18,13) is sought in Annex 4a (it is an apartment with reduced quality). This specific value is not given here; In the same row, however, the value closest to the lower shall be reported (right), 18,12.
In the header of the relevant column (at the top of the page) there is an increase of 64,8% (maximum increase in monthly rent as a percentage), as shown in the following picture:

The calculation of the increased rent by 64.8% shall be done by multiplying the value of the current rent (in CZK / m2) by 1,648:

18,13 * 64,8100 + 1 = 18,13 * 1,648 = 29,88 CZK / m2
The increased monthly rent for 1 m2 floor area of the selected apartment is 29,88 CZK / m2 in 2009.
