DECLARATION
of 25 May 2005
amending Decree No 299 / 2003 Coll., on measures to prevent and control diseases and diseases communicable from animals to humans, as amended
The Ministry of Agriculture provides pursuant to Section 78 of Act No. 166 / 1999 Coll., on Veterinary Care and on the amendment of certain related laws (Veterinary Act), as amended by Act No. 131 / 2003 Coll. and Act No. 316 / 2004 Coll., ("the Act ') for the implementation of Section 10 (3) (g) of the Act:
Čl. I
Decree No. 299 / 2003 Coll., on measures to prevent and control diseases and diseases communicable from animals to humans, as amended by Decree No. 356 / 2004 Coll. and Decree No. 389 / 2004 Coll., is amended as follows:
1. In Article 2 (l), the words "including industrial kitchens and breeders' households' are replaced by the words" including breeders' households and, where appropriate, meat-processing industries'.
2. in Article 74 (1) (e) (2), after the word "poultry", the comma is replaced by a dot and the sentence "This holding must be monitored in accordance with Article 72 (2)," is added.
3. The following Section 75a is inserted after Section 75:
„§ 75a
Regional Veterinary Administration in accordance with § 49 (1) (c) and (d) of the Act
(a) lay down rules within the framework of emergency veterinary measures allowing the movement of eggs and poultry to be monitored;
(b) it shall:
1. poultry farmers to provide the authorities carrying out national veterinary surveillance at any time on their request with information on the movement of poultry and eggs from or to their holdings;
2. persons involved in the transport of and trade in poultry and eggs to provide the authorities carrying out national veterinary surveillance with all information on the movement of poultry and eggs in which they have been or have been involved in transport. ';
4. in Article 86 (1) (e) (2), after the word "poultry", the comma is replaced by a dot and the phrase "This holding must be monitored in accordance with Article 84 (2). Where day-old chicks or ready-to-lay pullets cannot be moved to holdings in the surveillance zone, they may be moved, with the agreement of the Regional Veterinary Administration and in accordance with a Commission decision requested in accordance with § 48 (1) (o) (2) of the Act, to a holding situated outside the surveillance zone and monitored in accordance with § 84 (2), '.
5. In Paragraph 86, the following paragraph 4 is added:
"(4) Where the epidemiological investigation confirms that an outbreak is caused by an infection which is not spreading, the scope of the protection zone may be reduced and the duration of the disease reduced, with the agreement of the Commission. '
6. In Paragraph 87, the following paragraph 3 is added:
"(3) Paragraph 86 (4) shall apply mutatis mutandis to any reduction in the scope and duration of the surveillance zone."
7. The following Section 87a is inserted after Section 87:
„§ 87a
Regional Veterinary Administration in accordance with § 49 (1) (c) and (d) of the Act
(a) lay down rules within the framework of emergency veterinary measures allowing the movement of eggs, poultry and captive birds to be monitored;
(b) it shall:
1. to owners of poultry, pigeons and other captive birds to provide the authorities carrying out national veterinary surveillance on their request with information on the movement of poultry and eggs from or to their holdings, as well as on the exhibitions or competitions at which postal pigeons participated;
2. to persons involved in the transport and trade of poultry, eggs, pigeons and other captive birds in order to provide the authorities carrying out official veterinary surveillance with all information on the movement of poultry, eggs, pigeons and other captive birds for which they have participated or have traded. ';
8. In Paragraph 92, the following paragraph 4 is added:
"(4) The State Veterinary Administration shall inform the Commission, through the Standing Committee on the Food Chain and Animal Health, of the disease situation and of the protection and control measures referred to in paragraphs 1 and 3, in accordance with Article 48 (1) (o) (2) of the Law. ';
9. In Annex No 16, Part A, point 3 (a), the words "as referred to in Act No 154 / 2000 Coll., on breeding, breeding and registration of livestock and amending certain related laws (Breeding Act), as amended, 'shall be inserted after the words" sheep'.

Efficacy
This Decree shall take effect on 1 June 2005.
