of 9 July 1993
on the labelling of certain travel documents and the shortening of their period of validity in connection with the disappearance of the Czech and Slovak Federal Republic
Parliament has decided on this law of the Czech Republic:
§ 1
Subject matter
This law governs
(a) the designation of certain travel documents of citizens of the Czech Republic and travel documents of stateless persons by the name of the State and the national symbol of the Czech Republic;
b) shortening the period of validity of certain travel documents of citizens of the Czech Republic.
Labelling of travel documents
§ 2
(1) The travel documents to be designated under this law are:
(a) passport, special passport, cross-border card and identity card issued pursuant to Act No. 63 / 1965 Coll., on travel documents,
(b) passport, diplomatic passport, service passport, cross-border card and identity card issued pursuant to Act No. 216 / 1991 Coll., on travel documents and travel abroad, provided that they are marked with the national emblem of the Czech and Slovak Federal Republic.
(2) The travel documents referred to in paragraph 1 (hereinafter referred to as "travel document") shall indicate the authorities responsible for issuing them (1) and the Czech diplomatic missions and consular posts abroad (hereinafter referred to as "competent authorities").
(3) The travel document is marked with the name of the State "Czech Republic" and the large national emblem of the Czech Republic.2)
§ 3
(1) The travel document is indicated on the application for the identification of the travel document (hereinafter referred to as the "application for designation").
(2) The application for a designation may be lodged:
(a) the holder of the travel document;
(b) the legal representative of the travel document holder to the extent referred to in paragraph 3;
(c) a State authority or legal entity established by a State, (3) which has submitted a request for the issue of a travel document (hereinafter referred to as the "sending authority") as a citizen.
(3) The legal representative is entitled to submit an application for designation as holder of a travel document
(a) less than 15 years old; or
(b) deprived of legal capacity or whose legal capacity is limited.
(4) The application for a designation shall be lodged with the competent authorities on the official form. The holder of the travel document shall indicate on the official form his name, surname, date of birth, birth number, type of travel document and its number, the address of his current and previous residence and the year of their beginning; The holder of a travel document which does not have a permanent residence in the Czech Republic shall indicate the country of residence and the address of the last residence in the Czech Republic, including the year of termination of the stay. The legal representative of the travel document holder shall indicate on the official form the information relating to the represented person. The sending authority shall indicate in the official form the information relating to the citizen for whom it makes the application for a designation. The travel document holder, his legal representative or the sending authority shall submit the travel document for the application for designation.
(5) When applying for a designation, they shall:
(a) the holder of the travel document submit a document confirming that he is a national of the Czech Republic, 4)
(b) legal representative of the travel document holder to submit a document confirming that the represented person is a national citizen of the Czech Republic, 4)
(c) sending authority to present a document confirming that the citizen for whom the application is submitted is a national citizen of the Czech Republic, 4)
(d) a stateless person to prove that he is resident in the Czech Republic.
§ 4
The identification of the travel document shall be carried out without undue delay upon submission of the request for designation; the identification shall not be made on an invalid document. 5)
Reducing the period of validity of travel documents
§ 5
The period of validity of passports and special passports issued after 30 June 1990 pursuant to Act No. 63 / 1965 Coll., passports and special passports whose validity has been extended after 30 June 1990 and passports, diplomatic passports and service passports referred to in § 2 (1) (b) shall be reduced to four years from the date of issue or renewal. Reducing the period of validity shall be indicated by the competent authorities at the same time as the designation referred to in Article 2 (3).
§ 6
The travel documents referred to in Article 2 (1) (b) may be issued only in the manner indicated in Article 2 (3) and only until 31 December 1993; the period of validity of passports, diplomatic passports and service passports so issued shall also be four years from the date of issue.
Transitional and final provisions
§ 7
A travel document which will not be marked in accordance with Paragraph 2 (3) before 31 December 1994 shall cease to be valid. where justified, the competent authorities may extend that period until 15 January 1995.
§ 8
This Act shall take effect 60 days after its publication.
