on small establishments of national committees as legal persons
The Government of the Czech Socialist Republic orders pursuant to Article II (b) of the Act of the Czech National Council No. 115 / 1988 Coll., amending and supplementing the Act on National Committees:
(1) In order to meet local needs, the local national committee may establish small establishments of the national committee as legal persons (1) (hereinafter referred to as "a separate establishment").
(2) A separate establishment is an organisational unit of the local national committee, which, in legal relations, acts on its behalf and bears the property responsibility for such relations.
(3) The eligibility referred to in paragraph 2 shall be acquired by a separate establishment on the date of establishment; provide services and activities only if the local national committee is registered in the company registration.2)
(4) The activity of a separate establishment shall be managed by its manager, acting on his behalf.
The local national committee may combine, divide or disturb separate establishments; decide at the same time on the transfer of rights and obligations and, where appropriate, on their settlement.
(1) A separate establishment may provide only services and activities designated by the local national committee when it is established. the local national committee may change the subject matter of the activity.
(2) In accordance with the subject matter of the activity determined in accordance with paragraph 1, a separate establishment shall provide services and activities:
(a) citizens,
(b) national committees,
(c) health, school, cultural, social, business and public catering, sports and recreation organisations and establishments;
(d) organisations providing or providing paid services to citizens, public utility services or the administration and maintenance of household property;
(e) social organisations.
(3) A separate establishment may provide extracted raw materials and building materials, including transport, to bodies other than those referred to in paragraph 2, related to the use of local public landfill, fixed and liquid waste work and ancillary sales of products related to the services and activities provided.
(4) A separate establishment may produce and supply products for the internal market in accordance with the subject matter of the activity.
(5) The provisions of the specific provisions, provided that specific authorisations are required for the provision of certain services and activities covered by the activity of a separate establishment, remain unaffected.
A separate establishment shall manage the property entrusted to it by the local national committee when it is set up and the property acquired in the provision of services and activities; has the right and obligation to hold, use, dispose, protect and reproduce this property in socialist social ownership in order to achieve the best possible economic results and meet local needs.3)
(1) To cover expenditure on its activities, a separate establishment shall use:
(a) revenue from sales from citizens, national committees, organisations and facilities for services and activities provided under Article 3 of this Regulation;
(b) assigned non-investment funds transferred to it from the budget of the local national committee;
(c) dedicated investment funds for the purchase of machinery and equipment, except in the balance sheet of the State plan, and for the execution of the construction, up to CZK 200 000 for an individual action, in excess of the investment construction limit set for the local national committee, which has been transferred to it from the reserve fund and development fund or other additional revenue of the local national committee.
(2) The surplus of income referred to in paragraph 1 (a) above of expenditure after the payment of sickness insurance premiums 4) remains separate from the establishment. The local national committee may decide that the surplus or part thereof is its additional income.
(3) The local national committee shall set out separate tasks for the security of sales from the population in order to ensure the growth of such sales.
The remuneration of staff of a separate establishment shall be governed by specific rules. 5)
(1) Raw materials, materials and products are purchased and services and other activities are provided by a separate establishment at prices in accordance with the price regulations and decisions of the price authorities or designated organisations. 6)
(2) Specific rules apply to the management of funds, reporting and accounting. 7)
This Regulation shall enter into force on 1 January 1989.
