DECLARATION
of 3 July 2009
amending Decree No. 136 / 2004 Coll., laying down details of the marking of animals and their registration and registration of holdings and persons provided for by the Breeding Act, as amended by Decree No. 199 / 2007 Coll.
The Ministry of Agriculture provides, pursuant to Article 33 of Act No. 154 / 2000 Coll., on the breeding, breeding and registration of livestock and on the amendment of certain related laws (Breeding Act), as amended by Act No. 282 / 2003 Coll. and Act No. 130 / 2006 Coll., ("the Act ') for the implementation of § 22 (13), § 23 (5), § 23a (4), § 23b (8), § 23c (4) and § 24 (11) of the Act:
Čl. I
Decree No. 136 / 2004 Coll., laying down the details of the marking of animals and their registration and registration of holdings and persons provided for by the Breeding Act, as amended by Decree No. 199 / 2007 Coll., is hereby amended as follows:
1. in Article 1 (2), the words "and farmed game" shall be added at the end of point (a).
2. in Article 1 (2) (b), the words "farmed game," shall be deleted;
3. in Article 2 (e):
"(e) flock - a group of poultry of one species and one category which is kept in one holding hall and which is present in that hall at the same time, '.
4. in Paragraph 2, the following points (i) to (l) are replaced at the end of the dot:
"(i) hall - building of a holding where a flock of poultry is kept,
(j) stocking density - total live weight of chickens in the hall at the same time, per square metre of usable area,
(k) daily mortality rates - the number of chickens that died in one hall on the same day, including chickens slaughtered for disease or for other reasons, divided by the number of chickens found in that hall on that day, multiplied by 100,
(l) cumulative daily mortality rates - sum of daily mortality rates. ';
5. in Article 4 (g), including footnotes 11a and 11b:
"(g) electronic identifier for sheep and goats 11a) and electronic identifier for horse11b);
11a) Council Regulation (EC) No 21 / 2004 of 17 December 2003 establishing a system for the identification and registration of ovine and caprine animals and amending Regulation (EC) No 1782 / 2003 and Directives 92 / 102 / EEC and 64 / 432 / EEC.
11b) Commission Regulation (EC) No 504 / 2008 of 6 June 2008 implementing Council Directives 90 / 426 / EEC and 90 / 427 / EEC as regards methods of identification of equidae. '
6. Paragraph 13, including the title and footnote 12, reads:
„§ 13
Method and term of labelling of horses and donkeys and their hybrids
(1) Breeding horses shall be identified by the methods given in the various orders of breeding books of the horse (12), namely:
(a) word and graphic description and electronic identification11b); or
(b) a word and graphic description, an electronic identificationrem11b) and a fire, where such a fire is given in the appropriate breeding book rules (12).
(2) In the case of breeding horses of the breeds of the Old Kladubsk horse, the lipian horse, the Shagyaarab, the nork, the Silesian nork, the Czech Moravian Belgian horse and the Moravian warm-cell can be marked
(a) in accordance with the procedure referred to in paragraph 1; or
(b) by word and graphic description and embossing, where this means of labelling is given in the appropriate rules of the breeding book (12).
(3) Horses not registered in the herd book, donkey and their cross-breeds are identified by word and graphic description and by an electronic identifier in accordance with Commission Regulation (EC) No 504 / 200811b).
(4) Each foal of a horse, donkey and their cross-breeds shall be marked before weaning in such a way that the identification of the horse is made no later than 31 December of the year of birth of the horse in question, or within 6 months of the date of birth, whichever is later.
(5) The person carrying out the marking of horses shall designate a horse, donkey or their cross-breed within 28 days of the date on which the owner was invited to do so.
12) Paragraph 14 (1) (e) of Decree No. 448 / 2006 Coll., on the implementation of certain provisions of the Breeding Act. '
7. In Paragraph 14 (3), "owner 'is replaced by" breeder'.
8. In Paragraph 14 (4), "owner 'is replaced by" breeder'.
9. In Paragraph 14 (4), the words "authorised person (4) 'are replaced by the words" issuing authority (11b)';
10. Paragraph 15, including the title and footnote 12a, reads as follows:
„§ 15
Labelling by electronic identifier and embossing
(1) The identification of the horse shall be recorded by electronic identification11b) or by a fire by the person carrying out the identification of the horse in the horse registration book and on the admission note, where appropriate on the registration report of the horse and the permanent import report. This is without prejudice to the obligation of the issuing authority to record the horse's licence under the directly applicable European Community12a).
(2) The ignition and its location are part of the order of breeding books.
12a) Article 11 (3) of Commission Regulation (EC) No 504 / 2008. '
11. Sections 16 and 17 shall be deleted, including the headings.
12. in Paragraph 19 (1), the word "four-digit" shall be deleted;
13. in Paragraph 20 (2) (b):
"(b) an alphanumeric code which expresses part of the registration number of the holding in which the pig was born;"
14. in Part 2, the following Section 7 is added:

Labelling of farmed deer and muflon
§ 27a
Method and term of labelling of farmed deer and muflon
(1) Farmed Deer and Muflon ("Deer and Muflon") are marked with one plastic eartag.
(2) Each deer or muflon, including cuts slaughtered on the holding, must be marked before leaving the holding in which it was born.
§ 27b
Ear tags used for the labelling of deer and muflon and their models
(1) Plastic ear tags shall be used for the marking of deer and muflon, which shall be at least 25 mm high, at least 9 mm wide and the height of the alphanumeric characters indicated therein shall be at least 5 mm high.
(2) The plastic ear tag used for the labelling of deer and muflon shall contain:
(a) country of origin designation - letters "CZ" for the Czech Republic,
(b) an alphanumeric code expressing part of the registration number of the holding where the animal was born;
(c) the competent authority code.
(3) The model of the plastic ear tag used for the labelling of deer and muflon is set out in Annex 4a.
§ 27c
Method and term of labelling of deer and muflon moved from other Member States or imported from third countries
(1) Deer and Muflon movements from other Member States or imports from third countries shall be marked as described in Sections 27a and 27b within 72 hours of the date of arrival at the place of destination.
(2) The provisions of paragraph 1 shall not apply to deer and muflons moved from other Member States or imported from third countries which are identified by an individual code of the animal from which the holding where the animal was first identified, and to deer and muflons imported for the purpose of participating in the dispatch of the animals.
(3) In the case of transfers of deer and muflon from another Member State or imports of deer and muflon from third countries directly to slaughterhouses, the deer and muflon shall no longer be identified. ';
15. in Paragraph 29 (2) (a), the word "entrepreneur" shall be replaced by the words "agricultural business12b)."
Footnote 12b reads:
"12b) § 2e of Act No. 257 / 1997 Coll., on Agriculture, as amended by Act No. 85 / 2004 Coll., Act No. 441 / 2005 Coll., Act No. 409 / 2006 Coll. and Act No. 267 / 2006 Coll. '.
16. in Paragraph 29 (2) (a) (1), the word "entrepreneur" shall be deleted;
17. in Paragraph 29 (2) (a) (4), "workplace address" is replaced by "contact address."
18. in Paragraph 29 (2) (b):
"(b) not for agricultural business12b)."
19. in Paragraph 29 (3), the word "Entrepreneur" is replaced by "Agricultural Entrepreneur 12b)."
20. In Article 32, the sentence "For the equine register on the holding, the consent of the authorised person (4) shall be added at the end of paragraph 1. '
21. in Article 34 (3), the following point 5 is added at the end of point (f):
"5. the result of the inventory of kept animals carried out in an interval of no more than a calendar year, for recording the result of the annual inventory, may be used by the document issued by the mandate4), which, after the inventory has been carried out, becomes an annex to the stables register,"
22. in Paragraph 34 (3) (g):
"(g) in the case of animals moved from other Member States or imported from third countries which have not been marked in accordance with the provisions directly applicable to the European Communities, the original ear tag number."
23. in Paragraph 36 (1), the words "if it is bovine," shall be added at the end of point (f).
24. in Article 38 (1) (e) (5), the word "market" shall be inserted after the word "aspects."
25. in Paragraph 39 (4) (e):
"(e) the breed, if not known, of the colour of the animal;"
26. In Paragraph 39 (4), the words "if known 'shall be added at the end of point (g).
27. in Paragraph 42 (4), the words "and the determination of the genetic type" shall be deleted;
28. Paragraph 42 (5) is deleted.
Paragraphs 6 to 8 shall become paragraphs 5 to 7.
29. in Paragraph 42 (5):
"(5) In the case of registration of older, previously unregistered horses, horses without origin and donkeys and their cross-breeds with horses, the fourth admission note shall be replaced by a declaration of registration of the horse. ';

„§ 44
Registration of a horse moved from another Member State or imported from a third country
(1) In the case of horses moved from another Member State or after importation of a horse from a third country, with the exception of a horse moved or imported to participate in the dispatch of animals (hereinafter referred to as "permanent importation of a horse '), the owner of the horse authorised by the person (4) shall send a report of the permanent importation of the horse within 30 days of the movement or within 30 days of the completion of the border veterinary inspection.
(2) The model of the permanent import report for a horse is set out in Annex 8.
(3) Where a permanent imported horse is accompanied by a horse passport issued in accordance with the provisions directly applicable to the European Communities, the owner of the horse shall send a report of the permanent importation of the horse by the authorised person referred to in paragraph 1 (4); This is without prejudice to the obligation to send a horse pass to the issuing authority (11b) pursuant to Article 8 (1) of Commission Regulation (EC) No 504 / 2008. If the horse is accompanied by a certificate of origin, the owner of the horse shall send a copy together with the report. The authorised person (4) shall register the horse and, within 7 days of its arrival, shall send the horse's passport and, where appropriate, a copy of the certificate of origin back to the owner of the horse.
(4) If the horse permanently imported from third countries is not accompanied by a horse passport issued in accordance with the directly applicable provisions of the European Communities, the owner of the horse shall send to the issuing authority (11b) a report of the permanent importation of the horse, completed by the horse-marking person. On the basis of this notification, the issuing authority shall issue a horse identification card; if the imported horse is accompanied by a certificate of origin, the owner of the horse shall send the issuing authority 11b a copy of the certificate of origin. ';
31. in Paragraph 46 (2), the words "authorised person (4)" shall be replaced by the words "issuing authority (11b)";
32. in Article 45 (3), the words "or electronic identifier number" shall be added at the end of point (d).
33.In Paragraph 46 (5):
"(5) When moving a horse to a slaughterhouse or a rendering undertaking, the original owner of the horse shall notify this fact to the authorised person (4) by sending a change report within 5 working days of the date on which the transfer took place, and at the same time passing the horse's identification card to the slaughterhouse, or to the rendering undertaking which, after the horse has been slaughtered or the horse's body has been processed, sends it to the authorised person (4), within 5 working days of the date of the slaughter of the horse or the working of the horse's body. If it is not the issuing authority, the authorised person (4) shall hand over the horse licence to the competent issuing authority (11b). ';
34. in Paragraph 46 (6):
"(6) The breeder shall send the horse a change message to the authorised person within the 30-day period provided for in Article 19 (5) of Commission Regulation (EC) No 504 / 200811b. ';
35. in Article 48 (l), the word "or" shall be replaced by "the number of the electronic identifier, where applicable."
36. In Section 48, at the end of point (p), the dot is replaced by a comma and the following points (q) to (t) are added:
"(q) the known status of the animal as not intended to be slaughtered for human consumer20a),
(r) details of duplicates of the horse's licence issued and of the replacement cards of the horse;
(s) for stallions registered in the central register of breeders, the number of the genetic type certificate,
(t) for foals born after insemination or transmission of embryos, the number of the certificate of verification of origin.
20a) Article 21 (1) (l) and Annex I, Section IX, Part II to Commission Regulation (EC) No 504 / 2008. ';
37. Paragraph 49 shall be deleted, including the title.
38. Paragraph 50 shall be deleted, including the title.
39. in Paragraph 53 (1):
"(1) Each breeder, trader, slaughterhouse operator, rendering undertaking, user establishment or assembly centre shall transmit to the authorised person (4) the data referred to in Article 52 (3) in the report on the birth of pigs, their mortality, loss, slaughter and transfer. Part of this report is the number of sows."
40. in Paragraph 55 (b) (2), "calendar month" is replaced by "date."
41. Paragraph 64, including the title, reads:
„§ 64
Register of poultry on the holding where the flock producing eggs is kept
(1) For each holding where a flock of more than 100 poultry with hatching eggs is kept and, in the case of chickens, a flock of laying hens with table eggs marketed, the poultry farmer shall keep a register of poultry on the holding either in paper form or electronically in the form of a computerised database (Section 32). The register of poultry on the holding shall be kept in individual halls. The register also records transfers between halls.
(2) Each register of poultry on the holding shall include:
(a) the name and, where appropriate, the name and surname or business name of the breeder;
(b) the registration number of the holding;
(c) the address of the holding;
(d) the species and category of poultry for which the poultry register is kept on the holding;
(e) the total number of halls, their identification and the identification of the hall for which the poultry register is kept on the holding.
(3) The poultry register on the holding shall be registered:
(a) the starting number of poultry;
(b) any change in the number of poultry, in particular the movement of animals, their mortality, loss or culling, recorded,
1. the number of poultry concerned by this amendment;
2. the date of the change;
3. the nature of the change (income, mortality, sale, transfer, transfer),
4. the registration number of the holding, hatchery, establishment of the slaughterhouse, rendering plant or user establishment from which or where the animals have been moved, or the country code, where applicable, if the animals are moved from or to other Member States or imported from or exported to third countries;
(c) the final number of poultry after the change of number.
(4) The supervisory authorities (15) record in the register of poultry on the holding the checks carried out, the date of the inspection, the name and, where appropriate, the name, surname and signature of the person carrying out the inspection and the name of the supervisory authority.
(5) The model of the poultry register on the holding is set out in Annex 12, Part 1 and is binding only on its contents. ';
42. After Paragraph 64, the following Sections 64a and 64b are inserted:
„§ 64a
Register of poultry on a holding where a flock for rearing or fattening is kept outside chickens kept for meat production
(1) For each holding where a flock of more than 500 poultry is kept, with the exception of the holdings referred to in Section 64 (1), the poultry breeder shall keep a register of poultry on the holding, either in paper form or electronically in the form of a computerised database (Section 32). The poultry register may be kept in individual halls, in which case the register shall also record the movement between the halls.
(2) Each poultry register on the holding shall include the following particulars on the front page:
(a) the name and, where appropriate, the names and surname or business name of the breeder;
(b) the registration number of the holding;
(c) the address of the holding;
(d) the species and category of poultry for which the poultry register is kept on the holding;
(e) the total number of halls, their identification and the identification of the hall for which the register of poultry on the holding is kept, if the breeder keeps the register of poultry on the holding on a case by case basis.
(3) The poultry register on the holding shall be registered:
(a) the number of poultry stored;
(b) any change in the number of poultry kept, recording
1. the number of poultry concerned by this amendment;
2. the date of the change;
3. the nature of the change (income, mortality, sale, transfer, transfer),
4. the registration number of the holding, hatchery, establishment of the slaughterhouse, rendering plant or user establishment from which or where the animals have been moved, or the country code, where applicable, if the animals are moved from or to other Member States or imported from or exported to third countries;
(c) the final number of poultry after the change of number.
(4) The supervisory authorities (15) record in the register of poultry on the holding the checks carried out, the date of the inspection, the name and, where appropriate, the name, surname and signature of the person carrying out the inspection and the name of the supervisory authority.
(5) The model of the poultry register on the holding is set out in Annex 12, Part 1 and is binding only on its contents.
§ 64b
Register of poultry on the holding where the chickens reared for meat are kept
(1) For each holding where a flock of more than 500 chickens of the species Chickens of the species Gallus gallus is kept for meat (hereinafter referred to as the "meat chickens'), the breeder shall keep a register of poultry on the holding for each chicken-keeping hall in paper form or electronically in a computerised database (Section 32). The breeder shall keep a register of poultry on the holding in accordance with the model set out in Section 64a (5).
(2) The register of poultry on the holding where the chickens for meat are kept contains, in addition to the particulars referred to in § 64a (2) to (4), the following entries:
(a) on the front page of the statement for which the poultry register is kept on the holding;
(b) on the front page, a usable area, which is the area of litter at any time accessible to chickens kept for meat, in m2;
(c) on the front page, an indication of the maximum allowable capacity of the hall in kg live weight of chickens reared for meat;
(d) the indication of the hybrid or breed of chickens stored for meat, if known,
(e) for each inspection, the number of chickens reared for meat found dead, indicating the causes, if known, as well as the number of chickens reared for meat slaughtered for disease or for other reasons,
(f) in the case of a stocking density exceeding 33 kg / m2, the daily mortality rate and the cumulative daily mortality rate. ";
43. Paragraph 66, including the title and footnote 20b, reads:
„§ 66
Reporting of poultry stocks on holdings where a flock producing eggs is kept
(1) Any poultry farmer keeping a flock of more than 100 poultry with hatching eggs and, in the case of chickens, a flock of laying hens for the production of table eggs placed on the market, shall transmit to the authorised person (4) in the poultry status report:
(a) the species, category and number of poultry kept on the holding;
(b) farming methods, number of flocks kept and maximum farm capacity;
(c) the number of poultry in or out of storage, to be reported
1. the species, category and number of poultry in or out of storage;
2. the date on which the entry into or removal from storage took place;
3. in the case of movement of poultry, the registration number of the holding, establishment of the slaughterhouse, rendering plant or user establishment from which or where the poultry have been moved, or the country code 20b, where applicable, shall be the number of the poultry imported or exported from third countries or moved to another Member State.
(2) The breeders referred to in paragraph 1 shall send reports on the poultry stocks authorised by the person (4) once a month, by the 10th day of the following calendar month, for the whole calendar month.
(3) The status report for poultry is sent on a form to be provided to the breeder by the authorised person (4).
