amending Act No. 117 / 1995 Coll., on State Social Support, as amended, Act No. 435 / 2004 Coll., on Employment, as amended, Act No. 251 / 2005 Coll., on Labour Inspection, as amended, and Act No. 108 / 2006 Coll., on Social Services, as amended, Act No. 29 / 2007 Coll.
Parliament has decided on this law of the Czech Republic:
Amendment of the State Social Support Act
In Article 40a (1) of Act No. 117 / 1995 Coll., on State Social Support, as amended by Act No. 168 / 2005 Coll., Act No. 112 / 2006 Coll. and Act No. 134 / 2006 Coll., the words "a child with a long-term disability requiring emergency care 'are replaced by the words" a person dependent on the assistance of another natural person in grade II (moderate dependence), in degree III (severe dependency) or in grade IV (total dependency) in accordance with the special legislation (47)'.
Footnote 47d reads:
"47d) § 8 of Act No. 108 / 2006 Coll., on Social Services. '.
Amendment to the Employment Act
Act No. 435 / 2004 Coll., on Employment, as amended by Act No. 168 / 2005 Coll., Act No. 202 / 2005 Coll., Act No. 253 / 2005 Coll., Act No. 350 / 2005 Coll., Act No. 382 / 2005 Coll., Act No. 413 / 2005 Coll., Act No. 428 / 2005 Coll., Act No. 444 / 2005 Coll., Act No. 495 / 2005 Coll., Act No. 109 / 2006 Coll., Act No. 112 / 2006 Coll., Act No. 159 / 2007 Coll., Act No. 171 / 2007 Coll.
1. in Article 5 (c), point 2 is deleted;
Points 3 to 7 shall be renumbered 2 to 6.
2. In Section 5 (c) (2), the words "predominantly or completely helpless natural person or partially helpless natural person over 80 years of age 'are replaced by the words" natural person who, under a specific legislation, is considered to be dependent on the assistance of another natural person in stage II (moderate dependence), in stage III (severe dependence) or in stage IV (complete dependence) 3a)'.
footnote 3a is replaced by the following:
"3a) § 8 of Act No. 108 / 2006 Coll., on Social Services. '.
3. in Paragraph 41 (3) (e), the words "or for a child under the age of 18, if the long-term disabled requiring emergency care" are deleted.
4. In Paragraph 41 (3) (f), the words "predominantly or completely powerless natural person or partially powerless natural person over 80 years of age 'are replaced by the words" a natural person who, under a specific legislation, is considered to be dependent on the assistance of another natural person in stage II (moderate dependency), in stage III (severe dependency) or in stage IV (complete dependency) 3a'.
Transitional provision
The replacement period of employment referred to in § 41 (3) of Act No. 435 / 2004 Coll., on Employment, as amended by this Act, is also considered to be the period when the person named in § 41 (3) (e) and (f) of Act No. 435 / 2004 Coll., as amended by Act No. 264 / 2006 Coll.
Amendment of the Labour Inspection Act
Act No. 251 / 2005 Coll., on Labour Inspection, as amended by Act No. 230 / 2006 Coll. and Act No. 264 / 2006 Coll., is amended as follows:
1. in Paragraph 3 (1) (e), the words "caring for a predominantly or completely helpless person" shall be replaced by the words "continuously caring for a natural person who, under a specific legislation, is considered to be dependent on the assistance of another natural person in stage II (moderate dependence), in stage III (severe dependence) or in stage IV (total dependence) 3a)."
footnote 3a is replaced by the following:
"3a) § 8 of Act No. 108 / 2006 Coll., on Social Services. '.
2. in Articles 18 (1) (b) and (c) and 31 (1) (b) and (c), the words "caring for a predominantly or completely helpless natural person" shall be replaced by the words "continuously caring for a natural person who, under a specific law, is considered to be dependent on the assistance of another natural person in stage II (moderate dependence), stage III (severe dependence) or stage IV (complete dependence) 3a)."
Amendment of the Social Services Act
In Article 29 (4) of Act No. 108 / 2006 Coll., on Social Services, the words "living in the household with an entitled person 'are deleted and the words" and pension insurance' are replaced by the words "pension insurance and employment '.
EFFECTIVE
This Act shall take effect on the day of its publication.
