of 23 June 2000
on the mitigation of certain property injustices caused by the Holocaust and amending Act No. 243 / 1992 Coll., adjusting certain issues related to Act No. 229 / 1991 Coll., on the modification of property relations with land and other agricultural property, as amended by Act No. 93 / 1992 Coll.
Parliament has decided on this law of the Czech Republic:
AMENDMENT OF CERTAIN MODIFIED HOLOCAURTS
(1) In order to mitigate certain property injustices suffered during the period from 29 September 1938 to 8 May 1945 by Jewish municipalities, foundations and associations by the withdrawal of their property as a result of transfers or transfers of property which were declared invalid by the President of the Republic No. 5 / 1945 Coll. or by Act No. 128 / 1946 Coll., they shall be transferred free of charge to the Federation of Jewish Communities in the Czech Republic or to the Jewish Communities in the Czech Republic of a State on the date of application of this Act, which before such transfers or transitions declared invalid by the Jewish municipalities, foundations and associations, no later on
(a) agricultural land and forest land as defined by national parks, national nature reserves, national natural monuments, natural reserves and natural monuments and the first zone of protected landscape areas;
(b) the matters which the Czech Republic necessarily needs in order to fulfil its legal functions and to fulfil those functions, other matters cannot be used;
(c) land built by construction which does not belong to property taken from Jewish municipalities, foundations and associations; or
(d) a parcel which is built by construction to which the provisions of point (b) apply or which forms a single functional unit with it.
(2) State-owned cases listed in the Annex to this Act are transferred free of charge to the Jewish Museum in Prague within 30 days of the date of entry into force of this Act.
(1) The Federation of Jewish Communes in the Czech Republic shall, by 30 June 2002, submit to the Government a list of the cases referred to in Article 1 (1) in which it shall determine to whom the cases in question are to be transferred free of charge.
(2) The Government, by regulation, shall determine the cases referred to in Paragraph 1 which shall be transferred free of charge pursuant to paragraph 1 and shall determine the procedure for their transfer.
(1) Works of art which were removed from the period from 29 September 1938 to 4 May 1945 by natural persons as a result of transfers or transfers of property rights which were declared invalid by the President of the Republic No. 5 / 1945 Coll. or by Act No. 128 / 1946 Coll., and which are owned by the State on the date of entry into force of this Act, shall be transferred free of charge to the property of the natural person who owned them before withdrawal and, if that person has died, shall be transferred to the property of his spouse or his descendants, if the original owner and his spouse have already died.
(2) The transfer referred to in paragraph 1 shall be free of charge on the basis of an application which may be made against the holder of the property in question under a specific law.
The free transfer of cases pursuant to § 1 must be carried out by whoever manages the property in question owned by the Czech Republic under special legislation.
Disputes concerning the application of this part of the law shall be settled by the courts.
Amendment to Act No. 243 / 1992 Coll., which regulates certain issues related to the Land Act, as amended
Act No. 243 / 1992 Coll., adjusting certain issues related to Act No. 229 / 1991 Coll., on the Treatment of Property Relations with Land and Other Agricultural Property, as amended by Act No. 93 / 1992 Coll., Act No. 441 / 1992 Coll., the Constitutional Court Found No. 29 / 1996 Coll. and Act No. 30 / 1996 Coll., is amended as follows:
1. In Article 2, the following paragraph 2 is inserted after paragraph 1:
"(2) The person entitled is also a citizen of the Czech Republic, who has lost his property to the extent specified by the special regulations (2) between 29 September 1938 and 8 May 1945 and who has acquired property rights under the Presidential Decree No. 5 / 1945 Coll., on the invalidity of certain property-law negotiations from the period of infreedom and on the national administration of property values of Germans, Hungarians, traitors and collaborators and certain organisations and institutions, although according to the Act No. 128 / 1946 Coll., on the invalidity of certain property-law negotiations from the period of non-freedom and other policies in respect of the assets of the second world war, it was neither compensated under these rules nor compensated under the international treaties concluded between the Czech Republic and other states after the Second World War."
Paragraphs 2 and 3 shall become paragraphs 3 and 4.
2. In Article 2 (3), the words "or 2 'shall be inserted after the words" paragraph 1'.
3. Paragraph 3 (1) reads as follows:
"(1) Real estate which has been transferred to the State or to another legal person shall be issued to authorised persons under the conditions set out in § 2 (1) and (2). '
4. Article 6, including footnote 5a, reads:
(1) The case cannot be issued,
(a) if it has already been issued under a special law,
(b) if a privatisation project has been approved on the date of its effectiveness;
(c) if a decision on its privatisation has been taken on the date of the law's effectiveness;
(d) where a decision on that entitlement has been exercised in respect of its issue.
(2) The authorised person is entitled to a refund which is granted under a specific legislation. (5a) Refunds on immovable property which cannot be granted and the procedure for the application of refunds shall be laid down in specific legislation. 5)
5a) Paragraph 18a (2) of Act No. 229 / 1991 Coll., as amended by Act No. 183 / 1993 Coll. '.
5. In Paragraph 11a, the following paragraph 3 is added:
"(3) The person authorised under Paragraph 2 (2) may exercise the right to issue real estate under this Act by 30 June 2001 at the latest. '
EFFECTIVE
(1) The provisions of Part One of this Act take effect on the first day of the second month following the date of publication.
(2) The provisions of Part Two of this Act take effect on the date of its publication.
