GOVERNMENT REGULATION
of 15 September 1999
laying down protective measures for the import of sugar
The Government orders pursuant to § 3 (2) of Act No. 252 / 1997 Coll., on Agriculture:
§ 1
Goods referred to in heading 1701 of the Customs Tariff (1) - cane or beet sugar and chemically pure sucrose, in solid form, shall be subject to the rate of import duty fixed by the Customs Tariff (1) for the tariff quotas set out in Annex 1 to this Regulation.
§ 2
(1) Following the exhaustion of the tariff quota provided for in Article 1, the rate of import duty fixed by the customs tariff shall apply to the goods defined in Article 1 (1), plus 80.
(2) If the duty calculated in accordance with paragraph 1 is less than 14 CZK / kg, the duty rate shall be 14 CZK / kg.
§ 3
(1) For the period of validity of this Regulation, the rates of duty laid down in the international contract shall not apply to goods originating in the Republic of Poland as defined in Paragraph 1 and under the conditions laid down here.2)
(2) Religious goods originating in the Republic of Poland are goods which meet the conditions laid down in the international contract. (2)
§ 4
(1) Paragraphs 1 and 2 do not apply to goods originating in the Slovak Republic.
(2) GOODS ORIGINATING IN THE REPUBLIC OF SWEDEN MEANS GOODS WHICH CONTAINING THE CONDITIONS LAID DOWN BY SPECIFIC REGULATION (3)
§ 5
(1) Paragraphs 1 and 2 shall not apply to goods originating in a developing country which is a member of the World Trade Organisation, (4) (hereinafter referred to as "developing countries"), provided that its share of imports of goods as defined in Section 1 does not exceed 3% of the total imports of those goods.
(2) Paragraph 1 shall not apply where the total import of goods as defined in Paragraph 1 originating in developing countries is more than 9%.
(3) The list of developing countries is set out in Annex 2 to this Regulation.
(3) Religious goods originating in a developing country are goods which meet the conditions laid down in specific provisions. 5)
§ 6
Government Decree No. 49 / 1999 Coll., laying down provisional safeguard measures on imports of sugar, is hereby repealed.
§ 7
(1) This Regulation shall enter into force on the day of its publication.
(2) This Regulation shall expire on 11 March 2003.
