DECLARATION

of 21 May 2021

on the declaration of the National Natural Monuments of Řežabenec and the establishment of its closer protection conditions

The Ministry of the Environment provides pursuant to § 79 (5) (g) of Act No. 114 / 1992 Coll., on the Conservation of Nature and Landscape, as amended by Act No. 349 / 2009 Coll., Act No. 123 / 2017 Coll. and Act No. 225 / 2017 Coll.:

§ 1

Announcement of a national natural monument

(1) The National Natural Monument of Řežabinec ("the National Natural Monument") is announced.

(2) A natural department, as defined in paragraph 3, shall be declared a national natural monument for the protection of:

(a) wetland ecosystems of reeds and vegetation of high seeds, vegetation of annual humid herbs, macrophyte vegetation of naturally eutrophous and mesotrophic standing waters and saltwater and transition peat,

(b) grassland ecosystems;

(d) draw stops and non-violent gatherings of waterbirds;

(e) the pond biotope of the community of nesting aquatic and wetland species;

(f) fish biotope of amphibians,

(g) the biotope of a rare and endangered species of a plant of herbaceous plants (Hamatocaulis vernicosus), including its population.

(3) The national natural monument is situated in the territory of the South Bohemia Region, in the cadastral territories of Kestřany, Putim and Rajice. The boundaries of the national natural monument shall be determined by a closed geometric pattern with direct sides whose vertices are determined by coordinates of the uniform trigonometric network of the cadastral1). The list of coordinates of the vertices of the geometric pattern as they follow in the pattern is given in Annex 1 to this decree.

(4) The protection zone of the national natural heritage is situated in the territory of South Bohemia, in the cadastral territories of Lhota near Kestrán, Putim and Rajice. The boundaries of the national natural heritage protection zone shall be determined by a closed geometric pattern with direct sides whose vertices are determined by coordinates of a single trigonometric network of cadastral1). The list of coordinates of the vertices of the geometric pattern as they follow in the pattern is given in Annex 2 to this decree.

(5) An indicative graphical representation of the territory of the national natural heritage and its protection zone is given in Annex 3 to this Decree.

§ 2

Closer protection conditions

The whole territory of the national natural heritage can only be approved by the nature conservation authority

(a) permit or make changes to the types of land or to their exploitation (2);

(b) to place construction, advertising or information equipment, permit or carry out construction, modification of completed structures or changes of buildings before their completion;

(c) to adjust the surface of the road using non-local natural material of the same or similar geological origin and chemical composition;

(d) use biocides, fertilisers or chemicals or chemical mixtures;

(e) to cut down timber on parcels intended for the performance of forest functions;

(f) planting or planting plants or releasing animals;

(g) to carry out the collection of plants or capture of animals, with the exception of the fishing of fish meat;

(h) indicate cycling or hiking routes;

(i) enter outside the marked tourist routes;

j) ride a bike outside the cycling routes;

(k) riding;

(l) to sail on board vessels, except for a voyage for the needs of the owner or charterer of the water areas to the extent necessary to ensure the pond industry;

(m) to change the water level on the pond by more than 20 cm in the period of less than 14 days between 1 March and 31 July of the calendar year;

(n) camp;

o) start fires;

(p) to establish new feeding facilities or slanisks;

(q) feed or bait animals outside feeding facilities;

(r) hunting animals; or

(s) to drive vehicles; consent is not required for vehicles of the essential components of the integrated rescue system3) and of the armed forces of the Czech Republic in the performance of their tasks, vehicles of other public authorities in the exercise of their responsibilities in the field of public administration, vehicles needed to ensure the management and care of land, vehicles needed to ensure veterinary care and vehicles needed to ensure the operation, removal of disturbances, maintenance and replacement of electrical system equipment.

§ 3

Consent-bound activities in the protection zone

In the protection zone, national natural monuments may be authorised only with the consent of the nature conservation authority.

(a) hunting animals; or

(b) to feed or bait animals outside the feeding establishment.

§ 4

Efficacy

This Decision shall enter into force on 1 July 2021.
