of 22 September 2014
laying down the scope and conditions of the information obligation of the food business operator at the place of destination in relation to certain types of fresh fruit, fresh vegetables and potatoes
The Government mandates the implementation of Act No. 110 / 1997 Coll., on Food and Tobacco Products and on the amendment and addition of certain related laws, as amended by Act No. 166 / 1999 Coll., Act No. 306 / 2000 Coll., Act No. 119 / 2000 Coll., Act No. 146 / 2002 Coll., Act No. 131 / 2003 Coll., Act No. 274 / 2003 Coll., Act No. 94 / 2004 Coll., Act No. 316 / 2004 Coll., Act No. 558 / 2004 Coll., Act No. 227 / 2009 Coll., Act No. 281 / 2009 Coll., Act No. 229 / 2006 Coll., Act No. 296 / 2007 Coll., Act No. 120 / 2008 Coll., Act No. 227 / 2009 Coll.
Subject matter
(1) This Regulation, following Article 3 (6) of Regulation (EC) No 882 / 2004 of the European Parliament and of the Council of 29 April 2004 on official controls performed to ensure the verification of compliance with feed and food law, animal health and animal welfare rules, lays down the extent and conditions of the information obligation of the food business operator at the place of destination (hereinafter referred to as the "food consignee at the place of destination").
(2) This Regulation shall apply to:
(a) fresh fruit of the species
1. peaches,
2. pears,
3. apples,
4. strawberries,
5. Apricots,
6. plums and plums, and
7. cherries,
(b) fresh vegetables of the species
1. onions and garlic,
2. carrots, parsley root and celeriac,
3. Tomatoes, peppers, gherkins and cucumbers,
4. salads, Peking cabbage and asparagus,
5. head cabbage, head cabbage, Brussels sprouts, cauliflower, broccoli and kohlrabi,
(c) early potatoes and late potatoes.
(3) This Regulation shall apply only where the destination is the place of first reception, handling or handling of the food referred to in paragraph 2.
Scope and conditions of the information obligation
(1) The consignee of the food at the place of destination, if the food referred to in § 1 (2) and the destination referred to in § 1 (3) is concerned, shall inform the Regional Inspectorate of the State Agricultural and Food Inspectorate of:
(a) the type of food coming to its destination;
(b) the quantity of food arriving at the place of destination;
(c) the Member State and the name and address of the food business operator sending the food to its destination;
(d) the address of the destination and the food recipients; and
(e) the intended sales unit price at destination excluding value added tax (1).
(2) The information referred to in paragraph 1 of this Article shall be communicated by the food recipient at the place of destination by letter or in a way which allows the remote transmission of data to the competent Regional Inspectorate of the State Agricultural and Food Inspection no later than 48 hours before the arrival of the food at the place of destination.
Efficacy
(1) This Regulation shall enter into force on the day following that of its publication.
(2) This Regulation shall expire on 31 December 2014.
