amending Government Regulation No 74 / 2017 Coll., laying down certain conditions for granting aid for the supply of fruit, vegetables, milk and school products and amending certain related government regulations, as amended
The Government mandates pursuant to § 2b (2) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll., Act No. 441 / 2005 Coll. and Act No. 291 / 2009 Coll., and under § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 128 / 2003 Coll., Act No. 441 / 2005 Coll. and Act No. 179 / 2014 Coll.:
Government Regulation No. 74 / 2017 Coll., laying down certain conditions for the granting of aid for the supply of fruit, vegetables, milk and school products and amending certain related government regulations, as amended by Government Regulation No. 128 / 2018 Coll., Government Regulation No. 190 / 2019 Coll. and Government Regulation No. 228 / 2021 Coll., are amended as follows:
1. in Article 2 (1) (a), the words "packed fresh fruit and vegetables or cut fresh fruit and vegetables," shall be deleted;
2. in Paragraph 2 (1) (b), the word "juice" shall be replaced by the word "juice 18);
Footnote 18 reads:
"18) Decree No. 248 / 2018 Coll., on the requirements for beverages, fermented vinegar and yeast. '.
3. Paragraph 2 (2) reads as follows:
"(2) The aid shall be granted in addition to the products referred to in paragraph 1 for the accompanying educational measures referred to in Article 3 (1) of Commission Delegated Regulation (EU) 2017 / 40, as amended. ';
4. In Article 2 (3), the words "points (a) to (d) may be used for printed educational material containing information on products; their use for other purposes is not permitted 'is replaced by' the milk products listed in Annex V to Regulation (EU) No 1308 / 2013 of the European Parliament and of the Council, as amended '.
5. footnote 17 shall read:
"17) Decree No. 397 / 2021 Coll., on requirements for preserved fruit and preserved vegetables, nuts, mushrooms, potatoes and their products and bananas."
6. footnotes 3 and 5 are deleted, including the footnotes.
7. In Article 5 (1) (c), the words "or packaging of cut fresh fruit or vegetables' are deleted.
8. In Article 5 (5), the word "said 'is replaced by" or, in the case of unpackaged products, the word "marked' is replaced by 'marked'.
9. In Article 5, paragraphs 6 and 7 are added:
"(6) The proportion of portions of products referred to in Article 2 (1) originating in organic products13 shall be at least 10% of the total number of portions of those products delivered to primary schools with which the applicant has a contract to supply products during the school year concerned.
(7) In the event of failure to comply with the minimum proportion of portions of organic products, the Fund shall reduce the funds for the supply of the products referred to in Article 2 (1) (a) and (b) and the products referred to in Article 2 (1) (c) and (d) corresponding to the approved applicant in the given school year by:
(a) 10% in the case of supplies of products from organic farming of 5% and less than 10%;
(b) 20% in the case of supplies of organic products of less than 5%. "
10. in Article 6 (4) (b) (3), the words "including, where appropriate, the seasoning ingredient, which shall indicate the percentage of added sugar, fat and salt 'shall be deleted;
11. At the end of the text of footnotes 7 and 14, the words "as amended 'shall be added.
12. in Article 7 (2), the words "and to implement accompanying educational measures" shall be inserted after the words "schools."
13. in Article 7 (3), the words "printed education" are replaced by the words "teaching."
14. In Article 7, the following paragraph 7 is added:
"(7) The approved applicant shall inform the schools of the accompanying educational measures available."
15. At the end of footnote 11, the sentence "Article 6 of Commission Delegated Regulation (EU) 2017 / 40, as amended, is added to the separate line. '
16. in Paragraph 10 (2), the word "a" shall be replaced by a comma at the end of (c).
17. In Article 10, at the end of paragraph 2, the dot is replaced by "a 'and the following point (e) is added:
"(e) documents proving the selection process of the supplier, unless it is an applicant pursuant to Article 7 (6)."

Transitional provisions
1. The application for aid for products for the school year 2021 / 2022 shall be subject to Government Regulation No 74 / 2017 Coll., as effective before the date of entry into force of this Regulation.
2. Regulation No 74 / 2017 Coll., as effective before the date of entry into force of this Regulation, shall apply to the application for aid for accompanying educational measures for the school year 2021 / 2022.
Efficacy
This Regulation shall enter into force on 1 September 2022, with the exception of Article I (9), which shall take effect on 1 September 2023.
