DECLARATION
of 26 June 2017
amending Decree No. 107 / 2005 Coll., on school meals, as amended
The Ministry of Education, Youth and Sports provides, pursuant to § 35 (2), § 121 (1) and § 123 (5) of Act No. 561 / 2004 Coll., on pre-school, primary, secondary, higher vocational and other education (Education Act) and in agreement with the Ministry of Health under § 121 (2) of the Education Act:
Decree No. 107 / 2005 Coll., on school meals, as amended by Decree No. 107 / 2008 Coll., Decree No. 463 / 2011 Coll. and Decree No. 17 / 2015 Coll., is amended as follows:
1. Paragraph 2 (5), including footnotes 9 and 10, reads:
"(5) The food service operator shall use, when providing dietary meals, recipes approved by:
(a) nutritional therapy9),
(b) a doctor with specialised competence (10)
1. practical medicine for children and adolescents,
2. pediatric medicine;
3. internal medicine,
4. general medical practice,
5. endocrine and diabetic, or
6. gastroenterology; or
(c) a doctor with special specialcompetence (10) in the field of
1. hygiene of children and adolescents,
2. hygiene of nutrition and objects of normal use,
3. pediatric endocrine and diabetic studies; or
4. pediatric gastroenterology and hepatology.
9) Article 15 of Act No. 96 / 2004 Coll., on the conditions for obtaining and recognising eligibility for the pursuit of non-medical medical professions and for carrying out activities related to the provision of healthcare and amending certain related laws (Law on non-medical medical professions).
10) Act No 95 / 2004 Coll., on the conditions for obtaining and recognising professional competence and specialised competence for the exercise of the medical profession of doctor, dental practitioner and pharmacist, as amended. Decree No. 185 / 2009 Coll., on specialisation training of doctors, dentists and pharmacists and certified courses, as amended. '
2. In Article 3, at the end of paragraph 6, the sentence "Other food services provided to children, pupils and students shall comply with the nutritional standards laid down in Annex 1 to this Regulation or with the nutritional requirements laid down in the Decree on food requirements for which advertising is permitted and which may be offered for sale and marketed in schools and educational establishments (11)."

3. in Article 5, the following paragraph 4 is inserted after paragraph 3:
"(4) School catering facilities may provide for an advance payment of up to two months, unless otherwise agreed with the legal representative of a minor or an adult student. '
Paragraph 4 shall become paragraph 5.
Efficacy
This Order shall take effect on the first day of the second calendar month following its publication.
