of 1 July 2011
on the scope, formalities and deadlines for the billing of electricity, gas or heat supplies and related services
According to Section 98a (2) (j) of Act No. 458 / 2000 Coll., on the Terms and Conditions of Business and on the Enforcement of State Administration in the Energy Sector and on the Amendment of Certain Laws (Energy Act), as amended by Act No. 158 / 2009 Coll.:
GENERAL PART
Subject matter
This decree sets out the scope, formalities and deadlines for the billing of electricity, gas or heat supplies and related services.
Definition of terms
For the purposes of this decree:
(a) the bill of lading of the document on the basis of which the overpayment or the underpayment resulting from the evaluation of the payments made for the performance provided and the total amount of the payment for the performance provided for the settlement or settlement period is made;
(b) due account of the accounts made for the settlement period;
(c) by the special bill of account
1. during the settlement period for the relevant part of the settlement period,
2. at the end of the collection of electricity or gas at the customer's sampling point; or
3. where the electricity, gas or distribution system operator has changed,
(d) by means of an amending bill of account, a document giving the correct or extraordinary bill of account;
(e) related electricity distribution services and other price control services provided by the distribution system operator to the customer under the electricity distribution contract or the electricity supplier as part of the service provided under the associated electricity supply service contract and gas distribution and other price control services provided by the distribution system operator's client under the gas distribution contract or the gas supplier as part of the service provided under the associated gas supply service contract;
(f) the heating accounting period for the period for which the heat energy supplier accounts the heat energy supply, covering all the days of that period, for which the heat consumption by the heat energy consumer was allowed, except in cases of interruption and limitation of the supply of heat energy under the Energy Act.
SCOPE OF ACCOUNTING ELECTRICITY SUPPORT, GAS OR HEALTH ENERGY AND ASSOCIATED SERVICES
Scope of the bill
(1) The billing provided by the electricity supplier or distribution system operator to a customer whose demand facility is connected to a low voltage network and the billing provided by the gas supplier or distribution system operator to a household or retail customer shall consist of:
(a) the general parts; the general part is denoted as PART A,
(b) detailed parts; the detailed part shall be identified as PART B,
(c) accompanying parts; the accompanying part shall be identified as PART C.
(2) The general part of the bill shall be provided by the electricity supplier or distribution system operator to a customer whose demand facility is connected to a low voltage network, or by the gas supplier or distribution system operator to a household or retail customer on a separate page of the sheet.
(3) Parts of the bill may contain additional information in excess of the mandatory requirements laid down in Sections 6 to 14 and other information, provided that other legislation so provides.
Narrowed settlement range
(1) The billing provided by the electricity supplier or distribution system operator to a customer whose demand facility is connected to a low voltage network, or the billing provided by the gas supplier or distribution system operator to a household or retail customer may be provided only to the extent of the general part or, where applicable, the general part and the detailed parts, provided that the customer so requests in writing, and at the same time the other parts of the bill are made available to the customer in a way that allows remote access or other equivalent.
(2) The billing provided by the heat energy supplier may be provided only to the extent provided for in Article 14 (1) or, where applicable, Article 14 (1) and (2), if the customer so requests in writing and at the same time the other part of the bill is made available to the customer in a way that allows remote access or other similar way.
(3) If the customer withdraws the application referred to in paragraph 1, the bill shall be provided to the extent provided for in paragraphs 1 to 3 of Section 3.
(4) If the customer withdraws the application referred to in paragraph 2, the bill shall be provided to the extent provided for in Paragraph 14.
INDICATORS FOR ACCOUNTING ELECTRICITY SUPPORT, GAS OR HEALTH ENERGY AND ASSOCIATED SERVICES
The electricity supplier, the gas supplier, the transmission system operator, the distribution system operator and the heat energy supplier shall report all the data in a true and clear, understandable and legible manner.
Forms of billing for the supply of electricity and related services to a customer whose demand facility is connected to a low voltage network
(1) PART A bill of supply of electricity and related services includes:
(a) the identification of the electricity supplier on the commercial documents referred to in the Commercial Code (1);
(b) the trading firm or the name and surname, or, where applicable, the name, addendum to the name and surname or surname, address, registered office or place of business of the client, and, where appropriate, other customer identification details;
(c) whether the accounts are duly, exceptional or corrective;
(d) the definition of the settlement period on the date of the first and last day of the settlement period;
(e) the total quantity of electricity delivered to the customer's sampling point or to the customer's sampling points for the settlement period;
(f) the amount of the total invoiced amount for the total quantity of electricity supplied and the associated value added tax services, excluding that tax;
(g) the total amount of advances paid by the customer for the total quantity of electricity supplied and the related services for the settlement period, where the obligation is to cover advances agreed in the contract for combined electricity supply services;
(h) the amount of the excess or arrears for the settlement period;
(i) the date on which the overpayment or underpayment is due and the method of payment thereof;
(j) contact with the electricity supplier's customer line and the fault telephone line of the distribution system operator or distribution system operator where PART A is provided to the customer for multiple demand points connected to the distribution systems by multiple distribution system operators;
(k) the information necessary for the customer's access to the accompanying, possibly accompanying and detailed part of the bill, provided that the customer's billing is provided to the extent provided for in Section 4 (1);
(l) other elements of the ordinary tax document, if the A tax bill under the Value Added Tax Act 2).
(2) PART B shall include the accounting for the supply of electricity and related services for each sampling point:
(a) the address and identification code number (hereinafter referred to as "the EAN code") of the sampling point (s);
(b) the electricity supplier's product, if agreed, and the electricity distribution rate;
(c) breakdown of payments and electricity supply prices and related services broken down by:
1. total payment for electricity supply and related services;
2. the total payment for the supply of power, with an indication of the price per unit of supplied electricity charged for the settlement period or of the prices per unit of supplied electricity charged for the part of the settlement period, where a change occurred during the accounting period, with a distinction by tariff band;
3. total payment for related services;
(d) the breakdown of payments for each related service, including the unit price of those services, charged for the settlement period or unit prices charged for the part of the settlement period, if it has been modified during the settlement period, broken down by:
1. payment for distribution of electricity, differentiated by tariff band, including separately quantified component to cover additional costs associated with the promotion of electricity from renewable sources, cogeneration and secondary sources;
2. payment for system services,
3. payment by the market operator for the clearing activity;
4. payment for non-compliance with the performer if the customer is obliged to pay such payment,
(e) the total amount of advances paid by the customer for the total quantity of electricity delivered and the related services for the settlement period and the breakdown of such advances according to the date of payment and their amount, where the obligation is to pay advances agreed in the contract for combined electricity supply services; in the case of a multi-point bill, the total amount of the advances for each sampling point;
(f) total quantity of electricity supplied and, for type measurements, C measurement data on the first day of the settlement period, on the last day of the settlement period and on the last day of the calendar year; If the last day of the calendar year is not the first or last day of the settlement period, this shall be determined as an indication of electricity consumption at the date of the change of regulated electricity prices under the legislation governing electricity measurement (3),
(g) the method of determining the measurement data according to the legislation governing electricity measurement (3);
(h) the nominal current value of the main circuit breaker before the measuring device;
(i) the quantity of electricity delivered to each demand point in the settlement period and at least two immediately preceding settlement periods comparable in terms of duration and consumption, where such data are available to the electricity supplier via the market operator's information system or the electricity supplier supplied electricity to the customer during those periods; information on the quantity of electricity supplied during the accounting periods shall be provided in such a form as to allow a clear comparison of electricity consumption.
(3) PART C of the bill for the supply of electricity and related services contains information on:
(a) the origin of the energy or share of individual sources in the total mix of fuels of the electricity supplier, broken down by:
1. the share of electricity produced from coal;
2. share of electricity produced in nuclear installations;
3. the share of electricity produced from natural gas;
4. the share of electricity produced from renewable energy sources;
5. share of electricity produced from secondary energy sources;
6. share of electricity from other sources,
(b) publicly available sources of information on the environmental impacts of electricity production, with data on CO2 emissions and radioactive waste from electricity produced, at least by reference to such publicly available source;
(c) the way in which the complaint is made to account for the supply of electricity and related services, including an indication of where and within which deadlines the complaint can be applied;
(d) the rights of the client where a dispute arises between the customer and the electricity supplier in respect of the supply of electricity and related services or their billing and the means of resolving such disputes;
(e) contact details for the Energy Regulatory Authority, the Ministry of Industry and Trade and the State Energy Inspection, indicating the address of the registered office including the address of the e-mail office, telephone number and website.
Formats for charging the supply of electricity to a customer whose demand facility is connected to a low voltage network
(1) PART And the billing of electricity supplies includes:
(a) the identification of the electricity supplier on the commercial documents referred to in the Commercial Code (1);
(b) the trading firm or the name and surname, or, where applicable, the name, addendum to the name and surname or surname, address, registered office or place of business of the client, and, where appropriate, other customer identification details;
(c) whether the accounts are duly, exceptional or corrective;
(d) the definition of the settlement period on the date of the first and last day of the settlement period;
(e) the total quantity of electricity delivered to the customer's sampling point or to the customer's sampling points for the settlement period;
(f) the amount of the total invoiced amount for the total quantity of electricity delivered with or without value added tax;
(g) the total amount of advances paid by the customer for the total quantity of electricity delivered for the settlement period where the obligation is to cover advances agreed in the electricity supply contract;
(h) the amount of the excess or arrears for the settlement period;
(i) the date on which the overpayment or underpayment is due and the method of payment thereof;
(j) contact with the electricity supplier's customer line and the fault telephone line of the distribution system operator or distribution system operator where PART A is provided to the customer for multiple demand points connected to the distribution systems by multiple distribution system operators;
(k) the information necessary for the customer's access to the accompanying, possibly accompanying and detailed part of the bill, provided that the customer's billing is provided to the extent provided for in Section 4 (1);
(l) other elements of the ordinary tax document, if the A bill for the supply of electricity by tax document under the Value Added Tax Act 2).
(2) PART B shall include the accounting for the supply of electricity for each sampling point:
(a) the address and the EAN code of the sampling point (s);
(b) the electricity supplier's product, if agreed;
(c) the total payment for the supply of electricity;
(d) the price per unit of supplied electricity charged for the settlement period or the prices per unit of supplied electricity charged for the part of the settlement period, if they have been changed during the accounting period, differentiated by the tariff zone;
(e) the total amount of advances paid by the customer for the total quantity of electricity delivered for the settlement period and the breakdown of such advances according to the date of payment and their amount, where the obligation to pay advances agreed in the electricity supply contract is; in the case of a multi-point bill, the total amount of the advances for each sampling point;
(f) total quantity of electricity supplied and, for type measurements, C measurement data on the first day of the settlement period, on the last day of the settlement period and on the last day of the calendar year; If the last day of the calendar year is not the first or last day of the settlement period, this shall be determined as an indication of electricity consumption at the date of the change of regulated electricity prices under the legislation governing electricity measurement (3),
(h) the method of determining the measurement data according to the legislation governing electricity measurement (3);
(i) the quantity of electricity delivered to each demand point in the settlement period and at least two immediately preceding settlement periods comparable in terms of duration and consumption, where such data are available to the electricity supplier via the market operator's information system or the electricity supplier supplied electricity to the customer during those periods; information on the quantity of electricity supplied during the accounting periods shall be provided in such a form as to allow a clear comparison of electricity consumption.
(3) PART C of the electricity supply bill contains information on:
(a) the share of individual energy sources in the total fuel mix of the electricity supplier, broken down by:
1. the share of electricity produced from coal;
2. share of electricity produced in nuclear installations;
3. the share of electricity produced from natural gas;
4. the share of electricity produced from renewable energy sources;
5. share of electricity produced from secondary energy sources;
6. share of electricity from other sources,
(b) publicly available sources of information on the environmental impacts of electricity production, with data on CO2 emissions and radioactive waste from electricity produced, at least by reference to such publicly available source;
(c) the manner in which the complaint is to be made to account for the supply of electricity, including an indication of where and within which time limits the complaint can be applied;
(d) the rights of the client where a dispute arises between the customer and the electricity supplier in a matter relating to the supply of electricity or its billing and the means of resolving such disputes;
(e) contact details for the Energy Regulatory Authority, the Ministry of Industry and Trade and the State Energy Inspection, indicating the address of the registered office including the address of the e-mail office, telephone number and website.
Forms of billing for electricity distribution to a customer whose demand facility is connected to a low voltage network
(1) PART And billing for electricity distribution includes
(a) the identification data of the distribution system operator on the commercial documents referred to in the Commercial Code (1);
(b) the trading firm or the name and surname, or, where applicable, the name, addendum to the name and surname or surname, address, registered office or place of business of the client, and, where appropriate, other customer identification details;
(c) whether the accounts are duly, exceptional or corrective;
(d) the definition of the settlement period on the date of the first and last day of the settlement period;
(e) the total quantity of electricity distributed to or from the customer for the settlement period;
(f) the amount of the total invoiced amount for the distribution of electricity and other services subject to price regulation with and without value added tax;
(g) the total amount of advances paid by the customer for the distribution of electricity and other services subject to price regulation paid by the customer for the settlement period, where the obligation is to pay advances agreed in the electricity distribution contract;
(h) the amount of the excess or arrears for the settlement period;
(i) the date on which the overpayment or underpayment is due and the method of payment thereof;
(j) contact with the distribution system operator's fault line;
(k) the information necessary for the customer's access to the accompanying, possibly accompanying and detailed part of the bill, provided that the customer's billing is provided to the extent provided for in Section 4 (1);
(l) other elements of the ordinary tax document, if the A bill of distribution of electricity by tax document under the Value Added Tax Act 2).
(2) PART B shall include the accounting for electricity distribution for each sampling point:
(a) the address and the EAN code of the sampling point (s);
(b) electricity distribution price and electricity distribution rate;
(c) the breakdown of payments and charges for the distribution of electricity and other price control services, including the unit price of those services, charged for the settlement period or unit prices charged for the part of the settlement period, if it has been modified during the settlement period, broken down by:
1. total payment for distribution of electricity and other services subject to price control;
2. payment for distribution of electricity, differentiated by tariff band, including separately quantified component to cover the additional costs associated with the promotion of electricity from renewable sources, cogeneration and secondary sources;
3. payment for system services,
4. payment by the market operator for the clearing activity;
5. payment for non-compliance with the performer if the customer is obliged to pay such payment;
(d) the total amount of advances paid by the customer for the distribution of electricity and other services subject to price regulation for the settlement period and the breakdown of those advances according to the date of payment and their amount, where the obligation is to pay advances agreed in the electricity distribution contract; in the case of a multi-point bill, the total amount of the advances for each sampling point;
(e) the total quantity of electricity distributed and, for type C measurements, the measurement figure on the first day of the settlement period, on the last day of the settlement period and on the last day of the calendar year; If the last day of the calendar year is not the first or last day of the settlement period, this shall be determined as an indication of electricity consumption at the date of the change of regulated electricity prices under the legislation governing electricity measurement (3),
(f) the nominal current value of the main circuit breaker before the measuring device;
(g) the method of determining the measurement data according to the legislation governing electricity measurement (3).
(3) PART C of the electricity distribution bill contains information on:
(a) the way in which the claim for electricity distribution is applied, including where and within which deadlines the claim for electricity distribution can be applied;
(b) the rights of the client where a dispute arises between the customer and the distribution system operator in a matter relating to the distribution of electricity or its billing and the means of resolving such disputes;
(c) contact details for the Energy Regulatory Authority, Ministry of Industry and Trade and State Energy Inspection, including address of the registered office, telephone number and address of the website.
Forms of billing the supply of electricity and related services and the distribution of electricity provided to the customer whose demand facility is connected to a high or very high voltage network
(1) The accounts for the supply of electricity and related services include separately quantified unit price, quantity and total payment for:
(a) the distribution of electricity by tariff band, including a separately quantified component to cover the additional costs associated with the promotion of electricity from renewable sources, cogeneration and secondary sources;
(b) system services;
(c) the clearing activity by the market operator;
(d) the supply of power;
(e) non-compliance with the performer and the unsolicited supply of reactive energy if the customer is obliged to pay such payment;
(f) exceeding the booked capacity or the booked power.
(2) The accounting for electricity distribution shall include separately quantified data as referred to in paragraph 1 (a) to (c), (e) and (f).
(3) The accounting for the supply of electricity shall contain the separately quantified figure referred to in paragraph 1 (d).
(4) The accounts referred to in paragraphs 1 and 2 shall also contain a separately quantified indication of:
(a) the maximum measured value of the quarter-hour electrical power taken by the customer;
(b) the amount of unsolicited supply of reactive power.
(5) In addition, the accounts referred to in paragraphs 1 to 3 shall contain additional elements of the ordinary tax document, provided that the accounting is a tax document under the Value Added Tax Act (2).
Forms of billing for gas supply and related services to a household or retail customer
(1) PART A bill of gas supply and related services includes:
(a) the gas supplier's identification data on the commercial documents referred to in the Commercial Code (1);
(b) the trading firm or the name and surname, or, where applicable, the name, addendum to the name and surname or surname, address, registered office or place of business of the client, and, where appropriate, other customer identification details;
(c) whether the accounts are duly, exceptional or corrective;
(d) the definition of the settlement period on the date of the first and last day of the settlement period;
(e) the total quantity of gas delivered to the customer's sampling point or to the customer's sampling points for the settlement period in energy units;
(f) the amount of the total invoiced amount for the total quantity of gas delivered and the associated value added tax services, excluding that tax;
(g) the total amount of advances paid by the customer for the total quantity of gas delivered and related services for the settlement period, where the obligation is to cover advances agreed in the contract for combined gas supply services;
(h) the amount of the excess or arrears for the settlement period;
(i) the date on which the overpayment or underpayment is due and the method of payment thereof;
(j) contact with the gas supplier's customer line and the fault telephone line of the distribution system operator or distribution system operator where PART A is provided to the customer for multiple demand points connected to multiple distribution systems by multiple distribution system operators;
(k) the information necessary for the customer's access to the accompanying, possibly accompanying and detailed part of the bill, provided that the customer's billing is provided to the extent provided for in Section 4 (1);
(l) other elements of the ordinary tax document, if the A bill for the supply of gas and related services by tax document under the Value Added Tax Act 2).
(2) PART B shall include the accounting for the supply of gas and related services for each sampling point:
(a) the address and the alphanumeric code (hereinafter referred to as "EIC code") of the sampling point (s);
(b) the gas supplier's product, if agreed;
(c) the value of gas consumption used to include the customer's demand point in the demand zone;
(d) breakdown of payments and gas supply prices and related services, broken down by:
1. total payment for gas supply and related services,
2. the total payment for the supply of gas, specifying the price for the energy unit of the supplied gas charged for the settlement period or the prices for the unit of supplied gas charged for the part of the settlement period, where it has been changed during the accounting period;
3. total payment for related services;
(e) the breakdown of payments for each related service, including the unit rate charged for the settlement period or unit rates charged for the part of the settlement period, if it has been modified during the settlement period, broken down by:
1. payment for the distribution of gas and its breakdown into payment for the gas collected and payment for the permanent salary or capacity component of the price;
2. payment by the market operator for the clearing activity;
(f) the total amount of advances paid by the customer for the total quantity of gas delivered and the related services for the settlement period and the breakdown of those advances according to the date of payment and their amount, where the obligation is to pay advances agreed in the contract for combined gas supply services; in the case of a multi-point bill, the total amount of the advances for each sampling point;
(g) the total quantity of gas delivered in energy units, including the value of the GCV and the conversion rate and, for type C measurements, the measurement figure on the first day of the accounting period on the last day of the accounting year and on the last day of the calendar year; If the last day of the calendar year is not the first or last day of the settlement period, the measurement by the consumption budget shall be determined according to the Associated Type Delivery Diagram according to the legislation which sets out the Rules of the Gas Market (4), unless the customer sends a self-reading carried out on the last day of the calendar year in accordance with the legislation that regulates the measurement of fluent 5),
