Decree of the Czech Labour Safety Authority and the Czech Mining Authority, which determines reserved gas installations and lays down certain conditions to ensure their safety

The Czech Labour Safety Authority pursuant to § 5 (1) (d) and (f) of Act No. 174 / 1968 Coll., on State Professional Safety Supervision, (hereinafter referred to as "the Act ') and the Czech Mining Authority pursuant to § 57 (1) (d) of Act No. 41 / 1957 Coll., on the Use of Mineral Wealth (Upper Act), and pursuant to § 10 (a) and (c) of the Czech National Council Act No. 24 / 1972 Coll., on the organisation and extension of supervision of the State Mining Administration, in an agreement with the relevant central authorities provides:
§ 1
Scope
(1) The Decree is binding on organisations covered by the competence of national professional labour safety authorities (1) and on legal and natural persons engaged in business activities under the Specific Regulations (5) (hereinafter referred to as "organisations").
(2) The Decree does not apply to products designated for conformity assessment under the Specific Law (2a) and the Decree of the Government (2b) before they are placed on the market and to technical equipment subject to supervision by the authorities referred to in § 3 (2) (a) and (b) of the Act.
§ 2
Reserved gas installations
Reserved gas installations within the meaning of § 4 (d) to (g) of the Act (hereinafter referred to as "the installations') are:
(a) gas production and treatment, 3)
(b) storage and transport of gases;
(c) filling of vessels with gases, including pressure stations;
(d) liquefaction and evaporation of gases;
(e) increasing and reducing gas pressure;
(f) gas distribution;
(g) gas consumption by combustion.
§ 3
Authorisation of organisations
(1) Organisations may install, repair, carry out, in a supplier's way, revisions and tests and fill gas pressure vessels only by authorisation ("approved organisation").
(2) The authorisation is issued by the Labour Safety Inspectorate (hereinafter referred to as the "Supervisory Authority"), in whose area the organisation has its permanent residence, where appropriate, at the written request of the organisation.
(3) The organisation shall indicate in the application how the reliability and safety of gas equipment is ensured, in particular how:
(a) technical inspection;
(b) during assembly and testing, the possibility of training workers who operate equipment;
(c) service;
(d) the competence of personnel to carry out assembly, repair, revision and testing;
(e) the delivery of the prescribed technical documentation to the operator, adjusted according to actual implementation, including instructions for operating and carrying out revisions.
(4) When checking the organisation's competence, the supervisory authority shall determine whether its technical level and the competence of its personnel provide a guarantee that the activity with respect to the scope of the required authorisation will comply with the requirements of safety of work and technical equipment.
(5) The supervisory authority may, on the basis of the results of the proficiency check, lay down additional conditions to ensure the safety of work and technical equipment for the issue of authorisations. The organisation must demonstrate compliance with these conditions before issuing the authorisation.
(6) Where the supervisory authority finds that the conditions are not complied with or that the rules to ensure safety of work and technical equipment are infringed during the operation of the authorisation, it shall restrict the scope of the authorisation or withdraw it from the organisation.
(7) The provisions of paragraphs 1 to 6 shall not apply to gas and demand gas installations when they are assembled and repaired by gas undertakings. 4)
(8) The production or assembly organisation shall notify in writing to the supervisory authority responsible for the location of the installation at least 15 days in advance of the location and the duration of the tests6)
(a) gas filling pressure vessels;
(b) compression and control stations with high and very high pressure;
(c) for the distribution of gases with high and very high pressure;
(d) for the consumption of gases by combustion with an individual output exceeding 3,5 MW;
(e) for the production of flammable gases with individual output above 5 m3 / h;
(f) for the production of oxygen with a unit power exceeding 1500 m3 / h.
(9) The equipment referred to in paragraph 8 may be submitted by the production or assembly organisation to the customer only after a successful test of the equipment confirmed by the supervisory authority.
(10) For imported equipment, the customer organisation shall ensure compliance with the obligations referred to in paragraphs 8 and 9.
§ 4
The revision technician shall have a certificate of competence issued by the supervisory authority on the basis of the test carried out to carry out the revisions and tests of the equipment.
Professional competence for operation and assembly
§ 5
(1) Operators authorised to operate an installation must be informed of the operating organisation (hereinafter referred to as "operator") of the operating rules and of the related safety regulations, the fire rules, the alarm guidelines and must be trained in the operation of such facilities. The operator shall check before entrusting the separate operator to the installation.
(2) The operator shall determine the level of familiarity and the length (syllabus) of the training, taking into account the nature and extent of the activity carried out on the type of equipment concerned, and verify the knowledge of the personnel referred to in paragraph 1 by a revision technician who has a valid certificate of competence of the type and scope every three years.
(3) Testing and checking by a revision technician is not required for the operation of the gas equipment referred to in § 2 (g) whose total power is less than 50 kW.
§ 6
(1) The conditions of professional competence for the installation of demand gas and gas equipment are laid down in a separate Regulation (4).
(2) The installation of other equipment may be entrusted only to persons who have been informed within the scope of their activities of the installation rules and training. They must be familiar with the relevant regulations and have at least one year of professional experience, meaning practical activity on equipment of the species concerned and must pass examinations with the supervisory authority.
§ 7
The organisation authorised to install or repair equipment shall ensure the testing of the equipment after completion of the installation or reconstruction to the extent specified by the relevant regulations and project documentation.
§ 8
Operation of equipment
The operator shall:
(a) ensure that checks and operational revisions are carried out in accordance with specific regulations, instructions and instructions of the manufacturer and supplier, as appropriate;
(b) ensure that the installation and repair of equipment is carried out only by authorised organisation and operation of the equipment by qualified personnel;
(c) to draw up, within one month of the start of operations, the local operating rules according to the supporting documents in the project and supply documentation, the manufacturer's instructions and on the basis of operational experience;
(d) in the case of equipment where toxic and non-breathable gases are used, to provide breathing and reviving techniques before commencing operations, to maintain it in a state of operation and, in the event of an emergency (accident, failure, etc.), to provide antigas or rescue services;
(e) keep the prescribed technical documentation, register the equipment and keep the documents provided for by legislation or technical standards.
§ 9
Inspection visits and tests
(1) For the purposes of national professional supervision, the operator shall prepare the equipment for inspection or testing within a specified time limit and under the conditions laid down by the supervisory authority.
(2) The technical acts necessary for the proper conduct of the inspection or test are managed and carried out by a revision technician or other expert designated by the operator.
Transitional and final provisions
§ 10
(1) Organisations carrying out the activities referred to in Article 3 are obliged to apply for them within six months of the effective date of the decree.
(2) Authorisations issued to organisations and certificates issued to workers before the expiry of this Decree shall remain valid for three years from the date on which the Decree became effective.
§ 11
Paragraph 1 (d) of Decree No 151 / 1969 Coll., determining reserved technical installations, is hereby repealed.
§ 12
This Decree shall take effect on 1 July 1979.
