supplementing the basic conditions for the supply of chemical, rubber, asbestos and cellulose and paper products
The Ministry of Chemical Industry, in agreement with the Ministry of Consumer Industry and after approval by the Chief Arbiter of the Czechoslovak Socialist Republic, provides pursuant to Section 192 of Act No. 69 / 1958 Coll., on Economic Relations between Socialist Organisations:
The Ordinance of the Ministry of Chemical Industry No 171 / 1958 Ú. l., *) issuing the basic conditions for the supply of chemical, rubber, asbestos and cellulose and paper products shall be added as follows:
The following shall be inserted after Paragraph 14, including the title, of Sections 14 (a) to (c):
"Receipt procedure and property penalties from liability for defects caused by the elasticity of artificial viscose and polyamide silk.
The quality of viscose silk and polyamide silk shall be determined in terms of elasticity when taken over by the customer according to the approved ethalons and the test method developed.
(1) The following shall apply in the detection of defects consisting of the presence of silk in the consignment delivered (i.e. in the detection of defective elasticity which does not correspond to the classification of the consignment delivered):
(a) for the supply of viscose silk
- in the case of silk identified by the supplier as Class I, where the flexibility of Class II is determined, the supplier shall provide a 30% discount on the price difference between Class I and Class II of the titre concerned,
- when determining the flexibility of the 3rd classification class for silk identified by the supplier as Class II, the supplier shall provide a discount of 30% of the price difference between Class II and Class III of the relevant titre,
- when determining the flexibility of the 3rd classification class for silk marked by the supplier as Class I, the supplier shall provide a 40% discount on the price difference between Class I and Class III of the titre concerned.
For Class III, elasticity is not considered as a product defect;
(b) for supplies of polyamide silk
- in the case of silk classified by the supplier as grade I, where the flexibility of class II is determined, the supplier shall provide a discount of 35% of the price difference between grade I and grade II of the relevant titre,
- in the case of silk identified by the supplier as Class II, the supplier shall provide a discount of 35% of the price difference between Class II and Class III of the titre concerned,
- in the case of silk identified by the supplier as Class I, where the flexibility of Class III is determined, the supplier shall provide a 70% discount on the price difference between Class I and Class III of the titre concerned.
For Class III and IV, elasticity is not considered as a product defect.
(2) The method of determining the classification grade is given in the technical standard for determining the degree of elasticity of continuous man-made fibres; * *) the elasticity of silk is not, however, grounds for changing the classification grade.
1. A supplier who has supplied viscose or polyamide silk whose defect consists solely in the fact that it causes elasticity of the fabric or knitted fabric shall be obliged to pay the customer a penalty payment of only 2%.
2. If the supply of viscose or polyamide silk is also defective for another reason, the supplier of the periodic penalty payment provided for in Section 140 of Act No. 69 / 1958 Coll. '
This decree shall take effect on the day of its publication.
