GOVERNMENT REGULATION
of 15 June 2016
amending Government Regulation No. 30 / 2014 Coll., laying down binding rules on the provision of financial contributions to forest management and selected hunting activities, as amended
The Government mandates pursuant to § 46 (9) of Act No. 289 / 1995 Coll., on Forests and on the amendment and amendment of certain laws (Forest Act), as amended by Act No. 501 / 2012 Coll., and pursuant to § 62 (2) of Act No. 449 / 2001 Coll., on hunting, as amended by Act No. 501 / 2012 Coll. and Act No. 357 / 2014 Coll.:
Government Regulation No. 30 / 2014 Coll., on the establishment of binding rules on the provision of financial contributions to forest management and selected hunting activities, as amended by Government Regulation No. 308 / 2014 Coll. and Government Regulation No. 51 / 2015 Coll., is amended as follows:
1. Paragraph 2 (7) reads as follows:
"(7) The notification of the applicant for a financial contribution to forest management pursuant to Part Two, Titles I, II, III, IV and VII shall be forwarded by the applicant to the Ministry of Defence, the Ministry of the Environment or to the competent regional authority before the start of work on the subject of the financial contribution, not earlier than 1 September; in the case of a financial contribution to forest management under Title I, II, III and IV of Part Two, the declaration may be delivered no later than 31 March. The notification shall be valid for the period from the date of receipt of the notification until 31 August. The notification shall be submitted in aggregate for all works carried out during the period of validity of the notification. ';
2. In Paragraph 2 (8), "Registration 'is replaced by" Notification'.
3. In Article 2, the following paragraph 9 is added:
"(9) In the event of a change to one of the elements mentioned in the declaration or application relating to the applicant, his address for service or bank connection, the applicant shall notify the Ministry of Defence, the Ministry of the Environment or the competent regional authority without undue delay of the change and provide supporting evidence. ';
4. In Article 3 (2), the words "in the case of a contribution covered by paragraph 3 (b), also for other forests, if they are not State owned 'are replaced by the words", if they are not State owned, by other forests'.
5. in Paragraph 3 (3) (d), the words "before recovery" shall be replaced by the words "on recovery."
6. In Article 3 (4), the words "within 3 months' shall be inserted after the words" within 3 months' and the words "until 30 September for a period of 12 calendar months immediately preceding that date 'shall be replaced by" but not later than 31 August for the period of validity of the declaration'.
7. In Article 3 (5), the second sentence is replaced by the following: "Where Annex 1 to the application for a financial contribution to environmental and nature-friendly forest management technology received by the competent regional authority has more than one party, the applicant shall provide the data contained in the application and Annex 1 thereof also electronically as determined by the Ministry of Agriculture, the Ministry of Agriculture shall publish this method on its website. The application shall be accompanied by copies of the invoices indicating the type of technology used and the number of technical units corresponding to Part I of Annex 1 to this Regulation as proof of compliance with the subject of the financial contribution referred to in paragraph 3. Copies of invoices shall be accompanied by an extract of forest economic records and, where appropriate, production technical documents indicating the crop groups in which the technology was used and the corresponding number of technical units. In the event of the completion of the subject of the financial contribution by itself, a statement of forest economic records or production documents shall be attached as proof of the subject of the financial contribution. '.
8. In footnote 7, the words "Council Regulation (EC) No 1698 / 2005 of 20 September 2005 on support for rural development by the European Agricultural Fund for Rural Development (EAFRD), as amended, 'are deleted.
9. In Article 4, at the end of paragraph 1, the words "or other non-State-owned forests which are not in the territory of national parks and their protection zones or under the influence of Imis A, B8 'shall be added.
10. in Article 4 (2) (d), the word 'repeated' is replaced by 'repeated';
11. in Article 4 (3), the words "or the competent regional authority within 3 months" shall be inserted after the word "defence," and the words "until 30 September for a period of 12 calendar months immediately preceding that date" shall be replaced by "but no later than 31 August for the period of validity of the declaration."
12. In Paragraph 4, the sentence "In case Annex No 1 of the application for a financial contribution for the renewal, reinsurance and rearing of forest areas of up to 40 years of age received by the competent regional authority has more than one party, the applicant shall provide the data contained in the application and Annex No 1 thereof also electronically set out by the Ministry of Agriculture, the Ministry of Agriculture shall publish that method on its website. '
13. In the second sentence of Article 4 (5), the words "the forests must be returned to the authorised person (hereinafter referred to as" restitution forests ") or those classified 'are deleted.
14. In Article 7, the following paragraph 3 is inserted after paragraph 2:
"(3) On the area for which the financial contribution for the artificial renewal of seed has been granted first, at least 80% of the number of seedlings listed by the applicant in the Annex to the application shall be respected for a period of 5 years from the date of completion of the financial contribution for artificial renewal of seed. '
Paragraphs 3 and 4 shall be renumbered paragraphs 4 and 5.
15. In Section 8, the word "repeated 'is replaced by" repeated'.
16. in Paragraph 8 (1), after the words "reproductive material12)," comma shall be replaced by "a" and "and, in the case of forests, the restitution document for the return of ownership to the entitled person" shall be deleted;
17. the words "and by this Regulation" shall be inserted after the words "in the woods."
18. in Paragraph 8 (4):
"(4) On the area for which a repeated financial contribution for artificial renewal has been granted, at least 80% of the number of semi-grown and rootstock mentioned by the applicant in the annex to the application shall be respected for a period of 5 years from the date of completion of the financial contribution for artificial renewal for each wood. '
19. in Paragraph 8, paragraph 6 is deleted;
Paragraph 7 shall become paragraph 6.
20. in the third sentence, the words "and" shall be replaced by a comma at the end of the text of the second sentence, and at the end of the text of the second sentence, the words "and the word" and the word "and" shall be inserted at the end of the text of the second sentence. "
Footnote 30 reads:
"30) Annex No 2 to Decree No. 29 / 2004 Coll., implementing Act No. 149 / 2003 Coll., on trade in forest reproductive material, as amended."
21. in Paragraph 12 (2) (d), the word 'repeated' is replaced by 'repeated';
22. In Article 12 (3), the words "within 3 months' and the words" until 30 September for a period of 12 calendar months immediately preceding that date 'are replaced by the words "but not later than 31 August for the period of validity of the declaration'.
23. In the second sentence of Article 12 (5), the words' must be restitution or classification 'are deleted.
24. In Article 15, the following paragraph 4 is inserted after paragraph 3:
"(4) On the area for which a financial contribution has been granted for the artificial renewal of the meliorative and strengthening timber by the first planting plant, the number of seedlings listed by the applicant in the Annex to the application shall be kept by at least 80% for a period of 5 years from the date of completion of the financial contribution for artificial renewal by the meliorative and strengthening timber by the first planting plant for each wood. '
Paragraphs 4 and 5 shall become paragraphs 5 and 6.
25. In Section 16, the word "repeated 'is replaced by" repeated'.
26. in Article 16 (1), the words "and, in the case of forest, the restitution proof of the return of ownership to the beneficiary" shall be deleted.
27th Paragraph 16 (5) reads:
"(5) On the area for which a financial contribution has been granted for the artificial renewal of the meliorative and reinforcing timber by planting repeated, the number of semi-fruit and seeds mentioned by the applicant in the Annex to the application shall be kept at least 80% for a period of 5 years from the date of completion of the financial contribution for the artificial renewal of the meliorative and strengthening timber by planting repeated for each wood. '
28. in Paragraph 22 (3) (d), "repeated" is replaced by "repeated."
29. in Paragraph 22 (3), the word "or" shall be added at the end of point (g).
30. in Paragraph 22 (3), the comma at the end of point (h) shall be replaced by a dot and points (i) and (j) shall be deleted;
31. in Article 22 (4), the words "within 3 months" and the words "until 30 September for a period of 12 calendar months immediately preceding that date" shall be replaced by "but not later than 31 August for the period of validity of the declaration."
32. In Article 22, at the end of paragraph 5, the following sentence is added: "In the event that Annex 1 to the application for a financial contribution for measures to restore forests damaged by imims and forests withering due to anthropogenic effects received by the competent regional authority has more than one party, the applicant shall provide the data contained in the application and Annex 1 thereof also electronically as determined by the Ministry of Agriculture, the Ministry of Agriculture shall publish this method on its website. '
33. In Paragraph 22 (9), the words "in the renewed parts of the crop groups" shall be inserted after the words "Pinus mugo," and at the end of the text of the paragraph the words "or on the crops whose age is more than 45 years in the year of completion of the financial contribution."
34. footnote 21 reads as follows:
"(21) Commission Regulation (EU) No 1407 / 2013 of 18 December 2013 on the application of Articles 107 and 108 of the Treaty on the Functioning of the European Union to de minimis aid. '
35. In Paragraph 25, the following paragraph 4 is inserted after paragraph 3:
"(4) On the area for which the financial contribution for the artificial renewal of seed has been granted first, at least 80% of the number of seedlings listed by the applicant in the Annex to the application shall be respected for a period of 5 years from the date of completion of the financial contribution for artificial renewal of seed. '
Paragraph 4 shall become paragraph 5.
36. In Section 26, the word "repeated 'is replaced by" repeated'.
37. in Article 26 (2) (a), the words "and this Regulation" shall be inserted after the words "in the woods."
38. In Paragraph 26, the following paragraph 4 is inserted after paragraph 3:
"(4) On the area for which a repeated financial contribution for artificial renewal has been granted, at least 80% of the number of seedlings, semi-plants and seedlings listed by the applicant in the Annex to the application shall be respected for a period of 5 years from the date of completion of the financial contribution for artificial renewal for each wood. '
Paragraphs 4 to 6 shall be renumbered paragraphs 5 to 7.
39. in Paragraph 34 (4), "30 September" is replaced by "31 August."
40. in Paragraph 34 (5), "Annex No 7" is replaced by "Annex No 6."
41. in Article 35 (4), the words "within 3 months" and the words "until 30 September for a period of 12 calendar months immediately preceding that date" shall be replaced by "but not later than 31 August for the period of validity of the declaration."
42. In Paragraph 35 (5), the text "Annex No 8" is replaced by "Annex No 7."
43. In Paragraph 35 (7), the last sentence is replaced by the following: "The applicant who is not a payer of value added tax or is a payer of value added tax which does not claim to deduct value added tax on the performance received for the preparation of the forest economic plan shall indicate the amount of costs, including value added tax. The applicant who pays value added tax and claims to deduct the value added tax in full for the performance received for the preparation of the forest economic plan shall indicate the amount of the costs excluding value added tax. The applicant who is the payer of value added tax and who claims to deduct value added tax in part for the performance received for the preparation of the forest economic plan shall indicate the amount of the costs excluding value added tax, including that part of the input tax for which he cannot claim the deduction of value added tax. '
44. In Part Two, the following Title 8 is inserted after the title and footnote 31:
FINANCIAL CONTRIBUTION TO DIFFERENT ECONOMY IN MILITARY WOODS
(1) A financial contribution to the difficult management of military forests may be granted to the forest owner or person referred to in Article 2 (5).
(2) A financial contribution to the difficult management of military forests is granted if it is not State-owned military forests.
(3) The subject of the financial contribution to the difficult management of military forests is the adaptation of the military forests to the state defence regime. 31).
(4) The application for a financial contribution to the difficult management of military forests shall be submitted by the applicant to the Ministry of Defence by 31 August for a period of 12 calendar months immediately preceding that date.
(5) The application for a financial contribution for the difficult management of military forests shall be submitted on a form, a model of which is set out in Annex 8 to this Regulation.
(6) The financial contribution for the difficult management of military forests is granted under the de minimis aid scheme).
(7) The amount of the financial contribution to the difficult management of military forests is determined by the product of the area of the land intended to fulfil the functions of the forest, which are objects of importance for State defence and are not owned by the State, in hectares and the rates of CZK 5,000 per ha.

45. in Article 36 (1) to (4), "41" is replaced by "39 and 41."
46. in Paragraph 36 (2), "30 September" is replaced by "31 August."
47. in Paragraph 36 (5), "40" is replaced by "39."
48. in Paragraph 37 (1) (a):
"(a) establishment or maintenance of fields for game with a maximum area of 1 ha; a field for game shall be understood as a parcel established for the purpose of increasing the maintenance of hunting animals, sown or planted with at least two crops, which are a food ingredient of game and which are not located in the immediately downstream agricultural crops in the chase on which the crops are managed so that the crops are not harvested and the composition of the crop provides grazing animals, or cover possibilities for most of the year, especially in winter, ';
49. in Article 37 (2) (a), the words "for cloven-hoofed or small game," shall be deleted;
50. in Paragraph 37 (2) (d), the words "and registration of installation" shall be deleted;
51. in Paragraph 37 (3) (a), the words "for cloven-hoofed or small game" shall be deleted and after the words "1 ha," shall be inserted the words "the distance between the different boxes for game is not less than 6 m in any place."
52. In Article 37 (4), "to (f) shall be granted once every 10 years' shall be replaced by" to (d) and (f) shall be granted once every 10 years and, in the case of the subject matter of the contribution referred to in paragraph 1 (e), once every 5 years'.
(53) In Paragraph 38 (2), the words "in the case of the subject of the contribution referred to in paragraph 1 (a) and (b)" shall be inserted at the beginning of point (a).
54. in Paragraph 38 (2), the words "in the case of the subject matter of the contribution referred to in paragraph 1 (a) and (b)" shall be inserted at the beginning of point (b).
55. in Paragraph 38 (2), the following point (c) is inserted after point (b):
"(c) in the case of the subject matter of the contribution referred to in paragraph 1 (a) and (b), a final consent granted to imports of live game or its development stages;"
Points (c) and (d) shall be renumbered points (d) and (e).
56. In Paragraph 38 (2) (d), the words "or, as the case may be, final consent to the import of live game and its development stages," shall be deleted.
57. Paragraph 40 shall be deleted, including the title.
58. In Paragraph 43 (3), "30 September 'is replaced by" 31 August'.
(59) In Paragraph 44 (3), the text "30 September" is replaced by "31 August."

Transitional provisions
1. Financial contributions to the activities referred to in § 3 (3) (a) and (c) to (e) and § 4 (2) of Government Decree No. 30 / 2014 Coll., as effective from the date of entry into force of this Regulation, shall not be granted in the territory of national parks and their protection zones in the case of forests which are not military forests and which are not State-owned, only if the work carried out in the course of fulfilling the subject of the financial contribution was started at the earliest on the date of entry into force of this Regulation.
2. The notification of the applicant for a financial contribution to forest management pursuant to Title I of Part Two, with the exception of the financial contribution to the clearance or closeness of horsemen in forestry and Title II of Government Regulation No 30 / 2014 Coll., on the establishment of binding rules for the provision of financial contributions to forest management and selected hunting activities, as effective from the date of entry into force of this Regulation, shall be sent by the applicant to the competent regional authority in 2016 before the start of work on the subject of the financial contribution, no later than 31 July 2016.
Efficacy
This Regulation shall be binding in its entirety and directly applicable in all Member States.
