DECLARATION
of 9 August 2007
amending Decree No. 241 / 2002 of the Ministry of Transport and Communications Coll., on the determination of water tanks and watercourses on which the navigation of vessels with combustion engines is prohibited and on the scope and use of surface water for navigation, as amended by Decree No. 39 / 2006 Coll.
The Ministry of Transport, in agreement with the Ministry of the Environment, provides for the Act No. 254 / 2001 Coll., on Water and on the amendment of certain laws (Water Act), as amended by Act No. 20 / 2004 Coll.:
Decree No 241 / 2002 Coll., on the determination of water tanks and watercourses on which the navigation of vessels with combustion engines is prohibited and on the extent and conditions of use of surface water for navigation, as amended by Decree No 39 / 2006 Coll., is amended as follows:
1. In Article 3 (2), the words "working days' are replaced by the words" Sundays, public holidays and other holidays (1a) ';
footnote 1a is replaced by the following:
"(1a) Act No. 245 / 2000 Coll., on public holidays, on other public holidays, on significant days and on days of work, as amended."
2. Paragraph 3 (3), including footnotes 1b to 1d, reads as follows:
"(3) Vessels intended for gliding under § 1a (c) and water scooters may only be operated:
(a) on surface waters which are not even partly located in the territory of the national park, protected landscape area, national nature reserves, natural reserves, national natural monuments, natural monuments, natural parks, European sites or bird areas1b),
(b) on water tanks and watercourses on which surface waters used for bathing are not 1c) or which do not immediately contiguous with such surface waters;
(c) on surface waters not listed in Annex 4 to this Decree;
(d) on surface waters identified by the corresponding navigational characteristics in accordance with the special legislation (1d);
(e) on surface waters on which access is ensured for vessels following reinforced access communication entering surface waters at a distance of not more than 1 km from the border referred to in (d);
(f) under good visibility;
(g) between 8 and 12 and 14 and 19 hours off Sunday, public holidays and other holidays.

1c) § 34 of Act No. 254 / 2001 Coll., on Water and on the amendment of certain laws (Water Act), as amended. Decree No 159 / 2003 Coll., laying down surface waters used for bathing persons, as amended by Decree No 168 / 2006 Coll.
1d) § 28 of Act No. 114 / 1995 Coll., on Inland Navigation, as amended. '
3. In Article 3, the following paragraph 4 is added:
"(4) The direct navigation of vessels intended to sail in glide or water scooters from the reinforced access communication referred to in point (e) to surface water referred to in point (d) and back, in the discharge mode of the voyage and in direct connection with the operation of the voyage on surface water referred to in point (d) shall be authorised under this Decree. The power / displacement ratio shall be calculated according to the relationship referred to in § 3 (1) (b) and the Frode number shall be calculated by dividing the maximum speed of the vessel V (m / s) by the square root of the product of the gravity constant (g = 9,81 m / s2) and the length of the main waterline L wl (m): Fn = V / (g.L wl) 1 / 2. '
4. In Annex 1, Table 1, point 51 is deleted.
Points 52 to 62 shall become points 51 to 61.
5. In Annex 4, the following point 7 is added to the table after point 6:
"7 4-17-01-011 New mills III Dyje Breclav."
Efficacy
This decree shall take effect on the day of its publication.
