amending and supplementing the Act of the Czech National Council No. 134 / 1973 Coll., on the competence of the authorities of the Czech Socialist Republic in the field of prices, as amended by the Act of the Czech National Council No. 39 / 1983 Coll.
The Czech National Council decided on this law:
The Act of the Czech National Council No. 134 / 1973 Coll., on the competence of the Czech Socialist Republic bodies in the field of prices, as amended by the Act of the Czech National Council No. 39 / 1983 Coll., is amended as follows:
1. In Sections 1 to 3 and 6, the words "Czech Price Office 'are replaced by the words" Ministry of Finance, Prices and Wages of the Czech Socialist Republic'.
2. Paragraph 2 (2) (c) shall be deleted.
3. in Article 2 (2), the provisions under (d) are renumbered (c) and the legislative abbreviation used therein "(hereinafter referred to as" products ")" shall be preceded by "and real estate."
4. Paragraph 2 (2) (e) shall be deleted and the provisions referred to in point (f) shall be referred to as (d).
5. Article 2 (4) reads as follows:
"(4) The Ministry of Finance, Prices and Wages of the Czech Socialist Republic may, within the framework of its competence in pricing, entrust other bodies of the Czech Socialist Republic, the Central Council of Cooperatives, the Association of Cooperatives of the Czech Socialist Republic and the Central Authorities of Social Organisations in the Czech Socialist Republic and, after prior agreement with them, organisations in their field of competence."
6. The following Section 2a is inserted after Section 2:
The Czech Commission for Planning and Scientific and Technological Development, in cooperation with the Ministry of Finance, Prices and Wages of the Czech Socialist Republic, carries out analyses of the development and performance of prices for price planning purposes, elaborates guidelines for the development of the Czech Socialist Republic's price development plan and draft price development plan as part of the state plan of the Czech Socialist Republic. "

(1) The Central Authorities of the Czech Socialist Republic, the Central Council of Cooperatives, the associations of Cooperatives of the Czech Socialist Republic and the Central Authorities of Social Organisations in the Czech Socialist Republic submit as organisations in their field of competence
(a) to the Ministry of Finance, Prices and Wages of the Czech Socialist Republic, proposals for price measures, supporting documents set out to ensure price measures, including the necessary analyses and justifications and price control plans, as well as reports on their implementation;
b) Czech Commission for Planning and Scientific and Technological Development proposals for the Price Development Plan.
(2) The Central Authorities of the Czech Socialist Republic, the Central Council of Cooperatives, the associations of Cooperatives of the Czech Socialist Republic and the Central Authorities of Social Organisations in the Czech Socialist Republic ensure in organisations in their area of competence the implementation of price control, impose additional charges on them and take other measures according to specific regulations.
(3) The Regional National Committees and the National Committee of the City of Prague shall submit to the Ministry of Finance, Prices and Wages of the Czech Socialist Republic and to the Czech Commission for Planning and Scientific and Technological Development the documents referred to in paragraph 1 for organisations and installations managed or managed by national committees and for state-owned enterprises set up by national committees (hereinafter referred to as "organisations within the competence of national committees") as well as for national committees of lower degrees.
(4) The Regional National Committees and the National Committee of the City of Prague set and changes the prices of products
(a) organisations within the competence of national committees and small establishments of national committees,
(b) non-agricultural production of agricultural organisations under the responsibility of the Ministry of Agriculture and Nutrition of the Czech Socialist Republic;
(c) cooperative organisations, except consumer cooperatives;
(d) social organisations;
(e) supplied by citizens,
except in the case of prices whose determination and change is the responsibility of other bodies under the special regulations (1), or whose determination and changes are reserved by the Ministry of Finance, Prices and Wages of the Czech Socialist Republic.
(5) The Regional National Committees and the National Committee of the City of Prague shall provide for additional charges in the organisations referred to in paragraph 4, in small establishments of the National Committees and in the case of citizens supplying products for the performance of price checks, and shall impose additional charges on them and take other measures in accordance with specific rules.
(6) The Regional National Committees and the National Committee of the City of Prague may be entrusted with:
(a) the exercise of their powers under paragraphs 4 and 5 of the national committees of lower degrees;
(b) the exercise of its powers under paragraph 4, by prior agreement, of other bodies of the Czech Socialist Republic and of their controlled or established organisations.
(7) The Regional Financial Administration and the Financial Administration in the capital city of Prague carry out price checks for organisations within their respective areas of competence. On the basis of the results of the check, they impose additional levies and take other measures in accordance with specific rules. Under the authority of the Ministry of Finance, Prices and Wages of the Czech Socialist Republic, the Regional Financial Administration and the Financial Administration in the capital of Prague are involved in price controls carried out by another financial administration. "
8. In Article 4 (1), the words "The staff of the Czech Price Office entrusted with the control of prices are authorised in the context of the performance of the control activity, unless specified otherwise," shall be replaced by the words "The staff of the Ministry of Finance, Prices and Wages of the Czech Socialist Republic, or any other body which has been entrusted with the control of prices under this Act, shall be entitled in the context of the performance of the control activity, unless specified otherwise."
9. In Article 4 (2), the words "the Czech Price Office or its authorised staff 'are replaced by the words" the Ministry of Finance, Prices and Wages of the Czech Socialist Republic, or any other body carrying out price controls under this Act or by their mandated staff'.
10. In Paragraph 4 (3), the words "The Czech Price Office may" shall be replaced by the words "The Ministry of Finance, Prices and Wages of the Czech Socialist Republic, or any other authority carrying out price controls under this Act may."
11. Article 4 (4) shall be deleted.
12. § 5 is released.
From the date of the entry into force of this Act, the Ministry of Finance, Prices and Wages of the Czech Socialist Republic has ceased to exercise control over the prices of separated workplaces established in Prague and in the seats of the regional national committees pursuant to § 5 of the Act of the Czech National Council No. 134 / 1973 Coll., on the competence of the authorities of the Czech Socialist Republic in the field of prices, as amended by the Act of the Czech National Council No. 39 / 1983 Coll. The rights and obligations of the employees of the Ministry of Finance, Prices and Wages of the Czech Socialist Republic, whose agreed place of work is a separate place of work for the performance of price control, are transferred to the Financial Administration in the capital of Prague on the date of the effective date of this Act, as regards workers working at a separate place of work in Prague and the respective regional financial administration, as regards workers working at separate places of work in the offices of the regional national committees.
The Bureau of the Czech National Council is hereby authorised to publish in the Collection of Laws the full text of the Act of the Czech National Council No. 134 / 1973 Coll., on the competence of the authorities of the Czech Socialist Republic in the field of prizes, as is apparent from the laws amending it and supplementing it.
This Act shall take effect on 1 January 1989.
