DECLARATION
of 26 June 2009
amending Decree No. 364 / 2005 Coll., on the management of school and school documentation and school matrices and on the transmission of data from school and school documentation and school matrices (Ordinance on school and school documentation), as amended
The Ministry of Education, Youth and Sports provides, pursuant to § 28 (6) of Act No. 561 / 2004 Coll., on Pre-School, Basic, Medium, Higher Vocational and Other Education (Education Act), as amended by Act No. 383 / 2005 Coll. and Act No. 49 / 2009 Coll.:
Amendment of the Decree on documentation of schools and school establishments
Decree No. 364 / 2005 Coll., on the management of documentation of schools and school establishments and school matrices and on the transmission of data from school documentation and school institutions and from school matrices (Decree on documentation of schools and school establishments), as amended by Decree No. 389 / 2006 Coll. and Decree No. 226 / 2007 Coll., are amended as follows:
1. In Article 1 (f), the words "and the manner in which it is carried out 'shall be inserted after the word" attendance'.
2. In Article 3 (3), the second sentence is deleted.
3. In Article 3, paragraphs 4 and 5 are added:
"(4) Upon transmission of the data referred to in paragraph 1, the legal person shall indicate his telephone and fax connections and e-mail address and, where appropriate, the name and surname of the natural person who prepared the data for transmission.
(5) The data referred to in paragraph 1 shall be transmitted to a database managed for this purpose by an organisation set up by the Ministry of Education, Youth and Sports (hereinafter referred to as "the Ministry ') in a format enabling their processing in that database. To the extent necessary for the performance of their tasks, regional authorities and municipal authorities with extended scope shall also have access to this database, which, in the cases provided for in this Decree, ensures the receipt of the data transmitted to the database. Only the Ministry and the organisation set up by the Ministry shall have access to individual data in the database.';

The organisation set up by the Ministry shall anonymise the personal data processed under this Order as soon as the purpose for which they were collected has ceased, but no later than 30 years after their first processing. '
5. In Annex 1, in Article 1 (1), the words "to the competent administrative authority 'are replaced by the words" to the database referred to in Article 3 (5)'.
6. In Annex 1, point (b) of Article 1 (1), "31 October 'is replaced by" 15 October'.
7. In Article 1 of Annex 1, the following paragraphs 3 and 4 are added:
"(3) The legal person shall, on the basis of the individual data it has transmitted, receive from the database referred to in Article 3 (5) by electronic means an extract of the statistical information from the data transmitted and, if deficiencies are identified in the inventory, shall ensure that it is corrected. Thereafter, without undue delay, the school director shall confirm the extract of the statistical information by signature and shall subsequently send it to the Regional Office or the Regional Office of the Municipality with extended scope, if the school is established by the municipality or association of municipalities.
(4) Individual data shall not be transmitted on students in the field of education in the field of security law in higher professional schools established by the Ministry of Interior. "
8. In Annex 1, point (f) (1) of Article 2 (1), the words "including the last two or three digits associated with the accredited training programme 'shall be inserted after the words" education'.
9. In Annex 1, in Article 5 (1) of the introductory part of the provision, the words "with the exception referred to in paragraph 3," shall be inserted after the word "school."
10. in Annex 1, point (c) of Article 5 (1):
"(c) the method of prior education of the pupil,"
11. In Article 5 of Annex 1, the following paragraph 3 is added:
"(3) The data referred to in paragraphs 1 and 2 shall not be transmitted to pupils who are trained at the primary school because of their stay in the medical establishment in which the school is established. ';
12. The second sentence of Article 1 (3) of Annex 2 reads: "The data referred to in Article 8a shall be transmitted electronically by 10 June of the current school year at the latest at the relevant date of 31 May of the current school year. '
13. In Annex 2, in Article 1 (5), the words "and 26 'are deleted.
14. The following paragraph 7 is added to Article 1 of Annex 2:
"(7) The dates referred to in paragraphs 3 to 5 shall apply to the transmission of aggregated data to an organisation set up by the Ministry, if it is a school or a school establishment set up by the Ministry, the municipal authority of the municipality with extended competence, if it is a school or a school establishment established by a municipality or association of municipalities, and the regional authority, if it is other schools and educational establishments. The organisation and the public authorities referred to in the first sentence shall verify the completeness and logical accuracy of the data and, if deficiencies are found, shall invite the legal person who transmitted the data to remedy it. In doing so, it provides methodological support to the legal entity. The full and correct information shall be accepted by the municipal authority of the municipality with extended competence and by the regional authority in the database referred to in § 3 (5). '
15. in Article 2 (1) and (2) of Annex 2:
"(1) Data for the previous school year:
(a) participation of children, pupils and students in swimming courses, ski courses and recovery stays organised by the school by type of school;
(b) courses for basic education and courses for basic education by type of school, the number of pupils who have successfully passed the examination at the end of the course for basic education, including pupils who have successfully completed the examination without prior training in the course for basic education;
(c) the benefits of scholarships, the remuneration for productive activities and the remuneration for education by type of school;
(d) continuing education in secondary, conservatory and higher vocational schools.
(2) Data for the current school year:
(a) teacher numbers by type of school, number of secondary school teachers, conservatories and higher vocational schools by class, number of foreign language teachers by language and type of school, number of teachers in classes or study groups for children, pupils or students with special educational needs by type of school;
(b) the number of leading teaching staff by type of school, the number of other teaching staff, social care staff;
(c) the number of students in the field of education in the field of security law in higher vocational schools established by the Ministry of Interior;
(d) number of pupils by type of school, use of information technology in teaching. ';
16. In Annex 2, in Article 4 (1), the words ", recovery stays' are deleted.
17. in Annex 2, point (d) of Article 4 (2):
"(d) children by citizenship and foreigners by residence regime,"
18. In Annex 2, in Article 5 (1), the words ", recovery stays, supplementary indicators' are deleted.
19. In Annex No 2, Article 5 (2) at the end of point (j) of the comma is replaced by the dot and point (k) is deleted.
20. Article 5 of Annex 2 is deleted.
21. In Annex 2, points (b) and (c) of Article 7 (1) are deleted.
Point (d) shall be renumbered (b).
22. in Annex 2, point (i) of Article 7 (2) shall be deleted;
Point (j) shall be renumbered (i).
23. in Annex 2, point (i) of Article 7 (2), "(d)" is replaced by "(b)";
24. Article 7 of Annex 2 is deleted.
25. Article 8 (1) of Annex 2 reads as follows:
"(1) Data for the previous school year: graduates by field of education, type, length and form of education and by gender."
26. Article 8 of Annex 2 is deleted.
27. In Article 8a (1), the first sentence of Article 8a (2) reads: "Data for the current school year: the number of candidates enrolled and admitted to the first year of training in the first round of the recruitment procedure by field of education, type and length of education and previous place of work, the number of entries in the first round of the admission procedure by field of education, type and length of training. '
28. In Annex 2, Article 9, including the title, reads:
Transmission of aggregated data on primary school preparatory classes and primary school preparatory stage special
(1) Data for the previous school year: cessation of gender-based attendance.
(2) Data for the current school year:
(a) the number of classes of the preparatory stage, children in the preparatory stage by year and sex, by type of disability;
(b) the number of preparatory classes and the number of children in the preparatory class by sex;
(c) newly adopted children to the preparatory stage;
(d) age composition of children at the preparatory stage by sex;
(e) children by citizenship, foreigners by residence. ';
29. In Article 10, Annex 2, paragraph 1, the words ", foreigners who have passed the Czech language examination in order to obtain proof of the knowledge of the Czech language under the Act on the residence of foreigners in the territory of the Czech Republic (5a), foreigners who have passed the exam successfully, and foreigners who have performed the exam without charge."

30. In Annex 2, in Article 10 (2), the words "including Czech language courses' shall be inserted after the words" courses'.
31. in Annex 2, point (a) of Article 11 (2):
"(a) pupils according to the type of study, years and fields of art with the assignment of foreigners,"
32. In Annex 2, Article 12, including the title, reads:
Transmission of aggregated data from school matrices and documentation of secondary school on sports training and the class focused on physical education
Data for the current school year: pupils by sport sector, the number of trainers by sport sector, the number of sports classes and classes aimed at teaching physical education, the number of pupils in these classes. '
33. In Annex 2, in Article 15 (2) (c), the words "foreigners according to access to school services," shall be deleted.
34. Article 16 of Annex No 2 is deleted.
35. In Annex 2, in Article 18 (2), the words "who do not have access to school services under the same conditions as nationals of the Czech Republic 'are deleted.
36. in Annex 2, point (a) of Article 19 (2), the words "with the expatriation of foreign citizens" shall be deleted;
37. in Annex 2, Article 20 (b), the words "under the conditions of access to school services" shall be deleted;
38. In Annex No 2, Part Four is deleted.
Efficacy
This Decree shall take effect on 1 August 2009, with the exception of the provisions of Article I (13), (24) and (38), which shall take effect on 1 January 2010, and of Article I (1) and (2) thereof. I points 20 and 26, which take effect on 1 January 2011.
