DECLARATION
of 5 June 2008
implementing the Law on certain measures relating to the prohibition of chemical weapons
According to Article 35 (5) of Act No. 19 / 1997 Coll., on certain measures related to the prohibition of chemical weapons and amending and supplementing Act No. 50 / 1976 Coll., on Territorial Planning and Construction Regulations (Construction Act), as amended, Act No. 455 / 1991 Coll., on Business Enterprise (Trade Code Act), as amended, and Act No. 140 / 1961 Coll., Criminal Act, as amended, as amended, Act No. 138 / 2008 Coll., ("Act '):
Subject matter
This decree provides:
(a) the content of the reports on activities carried out for protective purposes;
(b) lists of highly dangerous, dangerous and less dangerous substances;
(c) objectives1) in which highly hazardous substances can be produced;
(d) the content of the reports on the handling of highly dangerous, dangerous and less dangerous substances and on the production of certain organic chemicals;
(e) the concentration of a dangerous substance and less dangerous substances in a mixture with other substances and the method of packaging of products containing dangerous substances and less dangerous substances for the purposes of their reporting and transmission;
(f) details of keeping records of highly dangerous, dangerous and less dangerous substances.
Protection activities
(Paragraph 6 (2) of the Act)
The content of the reports on activities carried out for protective purposes is set out in Annex 1.
List of highly dangerous, dangerous and less dangerous substances
(K § 7 (2) of the Act)
The scheduled substances are included in each list as follows:
(a) highly dangerous substances to List 1, as contained in Annex 2;
(b) dangerous substances to List 2, which is contained in Annex 3;
(c) less dangerous substances to List 3, as contained in Annex 4.
Production of highly hazardous substances
(K § 9 (3) of the Act)
Highly hazardous substances can only be produced:
(a) in a single single-purpose low-tonnage facility, the reactors in production lines are not adapted for continuous operation, the volume of each reactor does not exceed 100 litres and the total volume of all reactors is not more than 500 litres;
(b) in a single object for protective purposes, the actual aggregate production in that object does not exceed 10 kg per year;
(c) in objects for research, medical or pharmaceutical purposes, the actual aggregate production of such objects is more than 100 g per year but does not exceed 10 kg per year per object;
(d) in laboratories for research, medical or pharmaceutical purposes, where the actual aggregate production does not exceed 100 g per year per laboratory.
Report on the handling of highly hazardous substances
(K § 18 of the Act)
The content of the report on the handling of highly dangerous substances is set out in Annex 5.
Hazardous substance management report
(K § 20 (3) of the Act)
(1) The quantity and concentration of the dangerous substance in the mixture with other substances are determined as follows:
(a) 0,1 kg of dangerous substance marked "*" in List 2 of Part A,
(b) 10 kg of other hazardous substance listed in List 2 of Part A;
(c) 100 kg of dangerous substance listed in List 2 of Part B;
(d) 30% by weight of the dangerous substance listed in List 2 of Part B and 300 kg of the total quantity of the mixture.
(2) The content of the reports on the handling of dangerous substances and on plants for their production, processing or consumption is set out in Annex 6.
Concentration of a dangerous substance in a mixture with other substances and method of packaging of products containing dangerous substances
(Paragraph 22 (2) of the Law)
The concentration of a dangerous substance in a mixture with other substances and the method of packaging of products containing dangerous substances shall be determined as follows:
(a) 1 percentage by weight of the hazardous substance listed in List 2 of Part A;
(b) 10% by weight of the dangerous substance listed in List 2 of Part B,
(c) products packaged for retail sale or for individual use.
Report on the handling of less dangerous substances
(Paragraph 23 (3) of the Law)
(1) The quantity of less dangerous substance and the concentration of less dangerous substance in a mixture with other substances shall be determined as follows:
(a) 1000 kg less dangerous substances listed in List 3;
(b) 30% by weight of the less dangerous substance listed in List 3 and 3000 kg of total mixture.
(2) The content of the reports on the handling and production of less dangerous substances is set out in Annex 7.
Concentration of a less dangerous substance mixed with other substances and method of packaging products containing less dangerous substances
(Paragraph 25 (2) of the Law)
The concentration of a less dangerous substance in a mixture with other substances and the method of packaging products containing less dangerous substances shall be determined as follows:
(a) 30% by weight of the less dangerous substance listed in List 3,
(b) products put up for retail sale or for individual use.
Keeping records of highly hazardous, dangerous and less dangerous substances
(Paragraph 25a (2) of the Law)
(1) The register consists of individual registers, which must be bound and numbered on a continuous basis so that the particulars contained therein cannot be amended retrospectively. The model of the sheet is set out in Annex 8.
(2) The register contains:
(a) front page
1. details of the identification of the natural person (name, surname and address at which he is permanently present) or of the legal person (name, registered office or place of establishment, identification number, if any),
2. the date from which the alerts are made;
3. the name and surname of the statutory body or its members, the address at which it is permanently present and the signature of the statutory authority or its members;
4. the name and surname of the staff member designated for keeping records, the address at which he is permanently present and his signature;
5. the name of the specified substances for which the register is kept;
6. in the case of licence holders, details of the licences granted, indicating the number of the licence or amendments thereto, including the date of award,
(b) on the first page, a list of scheduled substances; the list contains the serial number of the specified substance and the first page of the occurrence of the entry in the register.
(3) For each specified substance, the records shall be kept on separate separate sheets in the register.
(4) The incorrect data are corrected in such a way that the original entry remains legible and each correction is signed by the employee who keeps the register. The staff member shall attach to the signature the date of the repair.
(5) If the number of pages reserved in the register for a particular item is exhausted, the list on the first page of the register may be set out in the same register for the same specified substances of the new consecutive page and supplemented by this entry.
(6) Registration books shall be kept separately for substances listed in the lists referred to in Article 3 (a) to (c).
(7) Where records are kept in electronic form, the records shall be printed and tied on 31 December of each calendar year in such a way that the particulars given therein cannot be amended retrospectively.
Report on the production of certain organic chemicals
(Paragraph 26 (4) of the Law)
The content of the report on the production of certain organic chemicals and their production facilities is set out in Annex 9.
Efficacy
This Decree shall take effect on 1 July 2008.

STATEMENT OF DECLARATION ON CHEMICAL PROTECTION PROGRAMMES
1. Data on the reporting person
1.1. the name and surname of the natural person, the name of the legal person or the organisational entity of the State handling the specified substances for protective purposes,
1.2. Identification number, if assigned,
1.3. The address at which the natural person, seat or place of establishment of the legal person is permanently present,
1.4. Reporting period,
1.5. the date and signature of the report, the name and surname of the person authorised to act for the entity referred to in point 1.1.
2. Data on the provision of chemical weapons protection programmes
2.1. Information on the provision of chemical weapons protection programmes, including the general characteristics of these programmes, i.e. whether they relate to:
(a) protection of troops against chemical weapons attack;
(b) protection of the population against chemical weapons attacks.
2.2. Means of providing protective equipment for the armed forces or the population, e.g.:
(a) government-supported research and development;
(b) the selection procedure;
(c) abroad.
3. Data on the main research and development activities relating to protective purposes in each area, such as:
3.1. Respiratory protection,
3.2. Protective clothing,
3.3. collective protection,
3.4. Decontamination of terrain, persons and materials,
3.5. detection / identification of combat chemicals,
3.6. Laboratory analysis of combat chemicals,
3.7. Medical countermeasures,
3.8. Modelling risk situations.
4. Data on units whose essential function may be protection against chemical weapons
Brief definition of the tasks of military units for chemical weapons protection (such as collective protection, decontamination, detection, medical countermeasures).
5. Data on training programmes relating to protective purposes
5.1. Information on training of military units using real combat chemicals or simulants;
5.2. information on training of military units in the following areas:
(a) the use of personal protective equipment;
(b) decontamination;
(c) detection;
(d) health aspects of protection.
5.3. Information on the provision of training of military forces or the population in the protection against possible chemical weapons attacks in the past year.
6. Data on the protection of the population
6.1. Information on programmes for the protection of the population against chemical weapons in case of use or threat of use of chemical weapons,
6.2. Information on exercises involving a response to chemical weapons attack against the population,
6.3. Information on training the population to protect against the effects of chemical weapons attacks;
6.4. Information on training documentation regarding protection against chemical weapons attacks (e.g. leaflets, websites).
7. Additional information
A publicly available scientific publication published in the reference year concerning the purpose of protection against chemical weapons.

Content of the report on the handling of highly hazardous substances
I. Report on the production of highly hazardous substances
(a) reporting of past activities
1. Data on the reporting person
1.1. Name of the legal entity that owns or operates the production facility;
1.2. Identification number, if assigned,
1.3. Location or place of establishment,
1.4. The date and signature of the report, the name and surname of the person authorised to act for the entity referred to in point 1.1.
2. Object details
2.1. Name or designation of object,
2.2. The exact location including geographical coordinates;
2.3. The following information for each highly dangerous substance:
(a) chemical name and CAS registration number (if no CAS registration number is assigned, its structural formula),
(b) the quantity produced and, in the case of manufacture for protective purposes, the methods used;
(c) the name and quantity of precursors referred to in lists 1, 2 or 3 used for the manufacture of highly hazardous substances;
(d) the quantity consumed on the premises and the purpose of consumption;
(e) quantities transferred to other objects within the Czech Republic; the quantity, consignee and purpose for each transmission,
(f) the maximum quantity stored at any time during the year;
(g) quantities stored at the end of the year.
2.4. Information on any changes in the premises or parts thereof relevant for the management of highly hazardous substances during the year compared to the previously provided detailed technical description of the object.
