on professional equipment for the application of preparations and amending Decree No. 384 / 2011 Coll., on technical equipment and on the labelling of wood packaging material and amending Decree No. 334 / 2004 Coll., on plant protection machinery
According to Section 88 (1) (c) of Act No. 326 / 2004 Coll., on Phytosanitary Care and on the Amendment of Certain Related Acts, as amended by Act No. 199 / 2012 Coll., ("the Act '), the Ministry of Agriculture provides for the implementation of § 61 (7), § 62 (1) and (3), § 64 (4) of the Act:

ON PROFESSIONAL ARRANGEMENTS FOR PRODUCT APPLICATION
§ 1
Subject matter
This decree implements the relevant provisions of the European Union1) and provides:
(a) details of the maintenance process and calibration of the professional equipment for the application of the products;
(b) restrictions on the use of individual professional devices for the application of products and procedures for their use depending on the type and method of application leading to minimisation of risks to health and the environment;
(c) procedures for the preparation of spray fluids and for cleaning professional equipment for the application of preparations;
(d) requirements to limit undesirable product leaps;
(e) the conditions of use of professional equipment for the application of products restricting the use of products under which the protective distances specified in the product authorisation decision need not be respected;
(f) the time limits for carrying out control testing of professional equipment for the application of products;
(g) technological requirements for professional equipment for the application of preparations;
(h) the technological procedure for the control testing of professional equipment for the application of products;
(i) technical conditions for the control testing of professional equipment for the application of preparations;
(j) the particulars and model of the certificate of performance of the professional equipment for the application of the preparations;
(k) the particulars and model of the label.
§ 2
Use of professional equipment for product application
(K § 61 (7) of the Act)
(1) The formalities for the maintenance and calibration of professional equipment for the application of the preparations are set out in Annex 1 to this Decree.
(2) Restrictions on the use of individual professional devices for the application of products and procedures for their use, depending on the type and method of application leading to minimisation of risks to health and the environment, are laid down in Annex 2 to this Decree.
(3) The preparation of the application fluid and the cleaning of professional equipment for the application of preparations must comply with the requirements set out in Annex 3 to this Regulation.
§ 3
Requirements for the restriction of undesirable product leaps and conditions of use of professional equipment for the application of product levers
(Paragraph 62 (1) and (3) of the Law)
(1) The requirements for limiting undesirable product leaps are set out in Annex 4 to this Decree.
(2) The conditions of use of a professional device for the application of products restricting the use of products in which the protective distance specified in the product authorisation decision is not to be respected are laid down in Annex 4 to this Decree.
§ 4
Time limits for carrying out control testing of professional equipment for the application of products
[K § 64 (4) (a) of the Act]
(1) The period from the date of entry into service of the professional device for the application of the products to the date of the first control test or the period between two control tests shall not exceed 3 years.
(2) A professional device for the application of products for which repair, modification or conversion has been carried out, which could affect the application of products, must be tested by inspection before its first use after such repair, modification or conversion.
§ 5
Technological requirements for professional equipment for product application and technological procedure for control testing of professional equipment for product application
[Paragraph 64 (4) (b) and (c) of the Law]
The technological requirements for professional equipment for the application of preparations and the technological procedure for the control testing of professional equipment for the application of preparations are set out in Annex 5 to this Decree.
§ 6
Technical conditions for control testing of professional equipment for product application
[K § 64 (4) (d) of the Act]
(1) The technical conditions for the control testing of professional equipment for the application of preparations must allow compliance with the technological procedure set out in Part B of Annex 5 to this Decree.
(2) The control testing facility must be equipped with:
(a) testing equipment, instruments and aids listed in Annex 6 to this Regulation, depending on the types of professional equipment for the application of the products subject to control testing;
(b) operating instructions and routine maintenance of tested types of professional equipment for the application of products;
(c) remote access to the phytosanitary management information system in which professional equipment for the application of products for which a certificate of performance has been issued and professional equipment for the application of products for which this document has not been issued is kept.
(3) The test equipment must comply with the requirements set out in Annex 6 to this Regulation.
§ 7
Details and model of the professional equipment functional certificate for the application of the products
[Paragraph 64 (4) (e) and (f) of the Act]
The formalities and models of the professional equipment performance certificates for the application of the preparations are set out in Annex 7 to this Regulation. The certificate of performance of the professional device for the application of the products shall include a control sticker, the particulars and model of which are set out in points 8.1 and 8.4 of Part B of Annex 5 to this Regulation.
§ 8
Transitional provision
Until 1 January 2020, the period from the date of entry into service of the professional equipment for the application of the products until the date of the first control test or between two control tests shall not exceed 5 years.

Annex No 1 to Decree No 207 / 2012 Coll.
Continuous maintenance and calibration of professional equipment for product application
The operator of the professional device for the application of the products shall maintain the machine in good operational technical condition between regular control tests and periodically adjust the machine to ensure its optimum function. It shall in particular be aimed at:
(a) the state of the tanks and the distribution of the liquid (tightness, abrasion, sealing),
b) the functionality of nozzles (uniform cutting pattern, wear of nozzles up to 10%),
(c) selection of the type and size of nozzles (conformity or symmetrical positioning, if applicable, of the sewers),
(d) spray or jet frame condition (possible damage, nozzle spacing);
(e) the height of the application frame of the sprinkler above the surface (adjustment functionality, tolerance allowed);
(f) adjustment of the working pressure of the liquid (range, functionality);
(g) fan status (grinder, air-assisted sprinklers),
(h) adjustment of the volume, direction and speed of the air (sewers, air-assisted sprayers);
(i) the choice of the unit dose;
(j) the functionality and tightness of the dosing of mordant and seed (seeds).
The requirements for these elements of the professional device for the application of the products are laid down in Annex 5 to this Decree.

Restrictions on the use of professional equipment for product application
The operator of a professional device for the application of products shall use this device only in good agro-technical terms and in optimal weather conditions. In addition, it must select an optimal setting of the equipment working mode to minimise risks to health and the environment.
A. Optimal weather conditions for professional equipment for the application of products without anti-shock components:
(a) wind speed up to 3 m / s;
(b) air temperatures up to 25 ° C; and
(c) relative humidity greater than 60%.
B. Optimal setting of professional device operating mode for application of products without anti-shock components:
a) optimal frame height above the surface - according to nozzles,
(b) working speed up to 8 km / h; and
(c) a dose of 200 l.ha-1 and more.
In the case of correctly selected anti-relief measures, when applied to parts of the parcel not subject to the requirements associated with the protective distances, the values of both the speed of travel and wind speeds may be up to twice as high when the surrounding surfaces, including surface water, drinking water sources and non-target organisms are protected against drift.
Prescribed values by point A may be exceeded only if there is a need to avoid imminent damage to the crop and it is not possible to choose a different agrotechnical term, taking into account circumstances not originating in the operator of the professional plant for the application of the products.

Preparation of application fluid and cleaning of professional equipment for application of preparations
A. Preparation of application fluid
The following requirements shall be complied with when performing a professional device for the application of spray-bearing agents (especially water) or preparation:
(a) The carrier shall be free from mechanical impurities.
b) Perform filling of the tank through the filling sieve or filling filter.
(c) If the professional device for the application of the products is equipped with its own filling device, the suction hose shall be terminated by the basket and the carrier shall be guided through the suction filter. This additional device may only be used if the carrier is sucked from an impermeable tank from which there is no risk of contamination of surface or groundwater.
(d) The mixing device shall be in operation.
(e) Where incorporation equipment is provided, it must be used.
(f) When multiple applications are carried out at the same time, their concentrates are added to the tank separately.
g) Mix the contents of the container thoroughly before starting the application. The mixing device must also be in operation during application.
B. Cleaning of professional equipment for product application
After the completion of the application or during the rotation of the products, a thorough cleaning of the professional equipment for the application of the products (daily cleaning) must always be done. At regular intervals, the complete rendering of the entire professional device for the application of the products must also be carried out, at least after the end of the season, for a longer period or before its planned control testing.
The cleaning of professional equipment for the application of the products shall be carried out in places designated for this or in a field followed by spraying the residue at the edge of the treated parcel. The operator shall use adequate protective equipment when cleaning, follow the instructions on the product label and, where appropriate, follow the instructions for use of the detergent.
1. Daily cleaning
Daily cleaning consists of a thorough rinsing of all parts of the application fluid, tank and nozzle distribution. It shall be carried out at places designated for this or on the treated parcel using the professional rinsing system for the application of the products. The outer parts of the professional device for the application of the products shall be rinsed after the shift has been completed with clean water.
2. Total rendering
In addition to daily maintenance, a thorough external cleaning, drainage of professional equipment for the application of preparations (protection against freezing of liquid residues) and corrosion treatment and possible dismantling of certain parts shall be carried out. The protected professional device for the application of the products should be protected against weather effects.
3. Internal rendering
Dilute the residue of the spray fluid with water and spray to the area where the application was made.
Dilute the residue of the spray fluid twice more and spray again to the area where the application was made.
Only diluted liquid which cannot be sprayed is removed from the field. This residue must be stored and secured prior to leakage into the environment after exhaustion of the tank. Such residues must be treated as hazardous waste.
4. External cleaning
The remains of the products from the professional equipment for the application of the products shall be cleaned on the property. It is changed instead of cleaning in order to avoid repeated loading of the land with residues of preparations.
If the professional equipment for the application of the products is cleaned on the holding, a place where rinse water is used for further processing or disposal shall be selected.

Annex No 4 to Decree No 207 / 2012 Coll.
Requirements for the restriction of product leaching and the use of professional equipment for the application of products limiting the leaching of products for reducing the protective distance
General conditions:
1. The reduction of the protective distance is not possible if it is excluded in the instructions for use or if the protective distance results from limiting the risks of a standardised sentence (1).
2. If a protective distance from surface water is indicated in the instructions for use in case of application on sloping land, the product shall not be applied to those parts of sloping land which are less distant from surface water than at a specified protective distance.
A. Requirements for the restriction of product drift
The anti-relief classification divides professional equipment for the application of products into three classes of drift limitation, marked 50%, 75% or 90%.
For the inclusion of a professional device for the application of products in the list of professional devices for the application of products with a view to limiting unwanted drift, test results demonstrating the degree of reduction of drift and any restrictions on use shall be submitted.
B. Use of professional equipment for the application of products limiting the use of products for reducing the protective distance provided for in the decision authorising the product
Practical implementation of the use of anti-relief measures is conditional on compliance with the design requirements for professional equipment for the application of products, requirements for technical measures, in particular the use of anti-relief nozzles, and technological measures aimed at the working mode of professional equipment for the application of the products, in particular compliance with the running speed, working pressure and height of nozzles above the application as set out in Annex 2 to this Decree.
If the product has a protective distance, this may be reduced by applying anti-relief measures.
If a table with prescribed protective distances and possibilities for shortening is included in the product instructions for use, using appropriate professional devices for the application of products classified in each class of drift limitation, the final distance shall be governed by this table.
Where only the prescribed protective distance is included in the instructions for use without shortening, the possibility of shortening it by using the appropriate professional equipment for the application of the products classified in each class of drift restriction with the tables that the plant health administration declares in the Journal.

Annex No 5 to Decree No 207 / 2012 Coll.
Technological requirements for the performance of professional equipment for the application of preparations and the technological procedure under which control testing is carried out
A. Technological requirements
1. General provision
The technological requirements shall be applied taking into account the design specificities of the professional equipment for the application of the products and in accordance with their designation in points 2 to 6.
2. Specific requirements for professional equipment for the application of field crop spraying products
2.1. Pump
2.1.1. The pump power shall be:
a) when using the largest nozzles and when setting working pressures between 0,4 and 0,6 MPa, allow application; and
(b) allow visible mixing of the liquid in the tank if the professional device for the application of the products is fitted with a hydraulic mixing device; or
(c) achieve at least 90% of its original nominal flow, as specified by the manufacturer.
2.1.2 The pump, if the professional device for the application of the products is equipped with a hydrostatic pump, shall not be visibly pulsed.
2.1.3 The safety valve, if equipped with it, must function reliably.
2.1.4 The pump must be tight.
2.2. Mixing equipment
The mixing device shall allow for visible swirling of the liquid in the tank when the device operates at the rated speed of the power supply shaft or the propulsion of the mixing device. The tank is filled with about half the nominal volume with water.
2.3 Tank
2.3.1. The container shall not leak or from it and the filling hole of the container, if the cover is closed, shall not leak the liquid.
2.3.2. In the filling hole of the tank, the sieve shall be in good condition.
2.3.3. The pressure compensation shall be ensured in the tank.
2.3.4. The container shall be provided with a clearly legible worksign visible from the driver's place and from the filling point.
2.3.5 It shall be possible to easily capture emptied spray fluid, without tools, reliably and without spillage (e.g. using a tap).
2.3.6. If the professional device for the application of the products is equipped with a spray fluid preparation device, it shall work reliably and there shall be a grid in the tank of the equipment.
2.3.7. Where a professional device for the application of preparations is equipped with a device for cleaning packaging from preparations, it shall work reliably.
2.4 Measuring, control, control and control system ("regulation")
2.4.1. All control devices must function reliably and be tight.
2.4.2. Control elements important for the application must be connected so that they can be easily reached from the operating site. The head or upper torso rotation is accepted.
2.4.3. The pressure gauge shall be clearly legible from the operating site and suitable for the range of working pressures used. They shall be divided by at least:
(a) 0,02 MPa for working pressures up to and including 0,5 MPa,
(b) 0,1 MPa for working pressures from 0,5 to 2,0 MPa inclusive;
(c) at 0,2 MPa for working pressures above 2,0 MPa.
2.4.4 The analog pressure gauges shall have a minimum diameter of 63 mm.
2.4.5 The accuracy of the pressure gauge shall be:
(a) ± 0,02 MPa for working pressures up to and including 0,2 MPa,
(b) ± 10 per cent of the actual value for working pressures from 0,2 MPa.
The pressure gauge shall remain stable.
2.4.6 The flow meters of a professional device for the application of products whose activity is related to the setting of a flat dose must measure the maximum error of 5% from the actual values.
2.5. Liquid distribution
2.5.1 The liquid distribution must be tight even at the maximum permitted working pressure.
2.5.2 The hose of the liquid distribution shall be so located as to avoid gold or abrasion and shall not be suspended in working positions within the spray range.
2.5.3. The drop in pressure between the point of measurement of the working pressure of the applied liquid (the pressure gauge of the professional device for the application of the preparations) and the outermost nozzle of each section of the spray frame shall not exceed 10% of the pressure level on the pressure gauge.
2.6 Filtration
2.6.1. At least one filter shall be placed on the pump pressure branch. If a professional device for the application of the products is equipped with a hydrostatic pump, one filter shall also be placed on the suction branch of the pump. Nozzle filters are not considered to be a pump pressure branch filter.
2.6.2 Filters shall be replaceable.
2.6.3. If a separation device is provided, it shall be possible to clean the filters with the tank filled to its nominal volume without leaking any spray fluid, except for the one that may be in the filter housing and in the suction line.
2.7 Spray frame
2.7.1. The spray frame shall be stable in all directions, shall be free from any connection and shall not be bent. The right and left side of the spray frame shall have the same length.
