implementing Act No. 301 / 2000 Coll., on Matrices, Names and Surnames and on the amendment of certain related laws
The Ministry of the Interior provides pursuant to Section 96 of Act No. 301 / 2000 Coll., on Matrices, Name and Surname, and on the amendment of certain related laws, hereinafter referred to as "the Act":
Preliminary provisions
§ 1
Matrix offices and their administrative circuits
(1) The matrix authorities are:
(a) municipal authorities;
(b) in the capital of Prague, the authorities of the urban areas,
(c) in territorial subdivisions of statutory cities, urban districts or urban areas,
(d) for the territory of military depots, the central authorities.
(2) The list of matrix offices and the definition of their administrative districts are set out in Annex 1.
§ 2
Models of matrix forms and models of paternity declarations
Annex 2 sets out the models of the following matrix forms and the models of the following declarations of paternity:

§ 2a
Forms
(1) The matrix forms listed in Annex No 2 in models 9 to 14, 20, 23 and 30 are strictly negotiable forms with security features against counterfeiting and alteration. Each form shall bear a letter or letters identifying the series and a six-digit number of each series from 000001 to 999999. After the numbers of the series are exhausted, the series marked in alphabetical order.
(2) The matrix forms referred to in paragraph 1 are printed on 100% pulp A4-free paper, 110 g / m2, without optical brightener with full chemical protection.
(3) The security features of the matrix forms referred to in paragraph 1 shall, in addition to the full chemical protection of the paper, be owned by a unique and unmistakable continuous watermark of the lion in the shield and of the leaves, safety visible fibres, safety invisible fibres with fluorescence in UV light and safety plantations with fluorescence in UV light.
(4) The Registry shall keep an overview of the forms received, issued, damaged or degraded as referred to in paragraph 1; it shall destroy the damaged and degraded forms in a protocol.
(5) Where data on parents of the same sex (7) are entered in the matrix forms set out in Annex 2 in models 5, 6, 17, 19 and 22), the words "father" and "mother" are crossed by a horizontal line.
§ 2b
Model certificate
(1) Annex 5 provides a model of confirmation by the health service provider of the initiation of treatment for sex change.
(2) Annex 6 provides a model of confirmation by the health service provider of termination of treatment for sex change.
Details of the technical way of keeping matrix books
§ 3
(1) The matrix book consists of matrix forms bound in bundles. Each volume of the matrix book shall contain an introductory sheet of the matrix book, a sheet of signature designs, a sheet on which the birth, marriage or partnership is registered, the creation of a registered partnership or death (hereinafter referred to as the "matrix sheet ') and a sheet for an alphabetical name register (hereinafter referred to as the" register'). Individual matrix sheets are numbered in advance.
(2) The volume of the matrix book contains a maximum of 300 matrices.
(3) Each volume of the matrix book is marked on the front of the binding with the type of matrix book, the name of the matrix office, the name of the municipality, the city, the capital of Prague and the territorial subdivisions of the statutory cities as well as the name of the city or city district or the designation of the military exit for which the matrix book is kept, the serial number of the volume and the indication of the initial and final date of registration. The volumes of the matrix book in which the birth, marriage or partnership is registered, the creation of a registered partnership and the death of citizens of the Czech Republic (hereinafter referred to as "the citizen '), which took place abroad, (hereinafter referred to as" the special matrix'), have instead the name of the municipality indicated "Special matrix '.
(4) The opening sheet of each volume of the matrix book shall be completed by an employee of the municipality or of the Ministry of Defence who is assigned to the Matrix Office (hereinafter referred to as "the Matrix '). The information on this sheet shall be verified by the staff member responsible for the work on the matrix section
(a) the municipal office of the municipality with extended competence ("the extended office") for the matrix offices which are included in its administrative district; or
(b) the Regional Office for Extended Authorities, which are included in its administrative district, and the City of Prague, as well as the Municipality of Brno, Ostrava and Pilsen, for the offices of the urban areas and, where appropriate, the urban districts of these cities (hereinafter referred to as the Regional Office).
(5) The Matrix Office shall keep the matrix books for each municipality, town, town, urban district and military territory separately.
(6) Since the decree has been effective, the matrimonial book volumes are marked with a new numerical series beginning with 1. In the case of a special matrix, "ZM" shall be entered before the number line of each matrix book volume.
(7) In parallel, if the matrix office holds more than one volume for one type of matrix book for one municipality, urban area, urban district, military territory or special matrix, each individual volume of matrix book shall be marked with a Roman number on the front of the bond, starting with the number I broken by the Arabic number of the volume. This indication shall also be given on the opening sheet of the matrix book volume and shall be indicated for which entries this matrix book volume is kept.
§ 4
(1) The registration in the matrix book is carried out by the matrix holder in his own hand in documentary ink by filling in each section of the relevant matrix sheet. The registration shall be marked with a serial number on its implementation. Scripture must be readable.
(2) The section of the matrix sheet which cannot be completed for the objective absence of data at the time of registration shall be crossed by a horizontal line. The blank part of the section "Records and repairs before signature 'shall be crossed through the line across. The section" Additional records and corrections' cannot be crossed out.
(3) Instead of the information which has not been established before the closure of the registration, the Registrar shall enter the word "undetected" in the relevant sections of the matrix sheet, unless otherwise specified.
(4) If an indication remains undetected after the registration has been closed and after further investigation, this shall be recorded in the heading of the matrix sheet "Additional records and corrections'.
§ 5
(1) A birth, marriage or partnership, the creation of a registered partnership and death (hereinafter referred to as the "matrix event") which took place in the same calendar year shall be entered in the matrix book, with the exception of a special matrix book. A reasonable number of matrix sheets for additional entries shall be left behind the last entry of the calendar year. The notes of the matrix events in the following years shall be continued unless a whole volume of the matrix book is described. In doing so, the entries in each year shall be numbered separately, including, where no registration is made in the calendar year, the heading of the matrix sheet on which the first entry is made in the year.
(2) If the volume of the matrix book is described before the end of the calendar year, the volume of the matrix book shall be further used, the numbering of the entries being continued. The individual volumes of the matrix book following in succession shall be marked with an Arabic number.
§ 6
omission of the matrix sheet
If one or more matrix sheets are omitted, the matrix holder shall cross the blank sheet with a line across and mark this sheet with the clause "accidentally omitted." The document shall be accompanied by its signature and date.
§ 7
Repeal of registration
The incorrect non-closed entry or erroneous closed entry shall be cancelled by crossing the line across and by "Additional records and corrections' in the section" Additional records and corrections' shall be noted that the registration shall be deemed to have been cancelled, stating the reason. The serial number of the cancelled registration shall also be deemed not to have been used if the cancelled registration has not yet been completed.
§ 8
Loading data in the minutes
The date, month and year of registration, the additional registration, the additional entry and the correction of registration and the date, month and year of their execution shall be indicated by Arabic numerals according to the Gregorian calendar by using the 01 to 31 marking for the calendar day, the 01 to 12 calendar month and the serial number for the calendar year. The markings shall be separated by dots.
§ 9
Indicate the location of the matrix event
(1) Place of the matrix event shall be entered in the record
(a) the name of the municipality and, if it is divided into parts, the name of the part thereof and, where appropriate, the name of the cadastral territory, and the number of the descriptive or registered territory; if the name of the municipality is identical with the name of the part of the municipality, part of the municipality is not listed,
(b) in the capital city of Prague, the name of the district, the cadastral territory, the number of the descriptive or recorded.
(2) If there is no descriptive or registration number instead of a matrix event, the name of the municipality shall be added to the name of the place of the matrix event. In the case of a place of marriage or partnership or the establishment of a registered partnership, a description or registration number may be followed by a description of the place.
(3) The place of the matrix event abroad shall be indicated by the name of the municipality and, where appropriate, by the name of the place of the matrix event and by the name of the State.
§ 10
Indication of place of birth, citizenship, sex, surname and permanent residence
(1) Place of birth, if not for registration of the site of the matrix event, shall be indicated in the minutes
(a) the name of the municipality or military retreat and district, in the capital city of Prague the name of the district, if it is of birth in the Czech Republic; or
(b) the name of the municipality and the name of the State where the place of birth is abroad.
(2) Citizenship shall be indicated in the minutes by the name of the State. If a person is not a national citizen of any State, the nationality figure shall be crossed out and the "Records and corrections before signature 'section shall indicate that the registered person is a non-citizen.
(3) The sex in the record should be preceded by M for male and F for female.
(4) The name of the registered person shall be entered in the minutes only if the surname currently used is different from that of the birth.
(5) The place of residence shall be indicated in the minutes in the manner specified in Paragraph 9 (1), supplemented by the street name, the indicative number, if assigned, and the district name. If a person does not have a permanent residence in the Czech Republic, his foreign residence shall be indicated in the manner set out in Section 9 (3).
§ 11
Shortcuts
The abbreviation can only be used in the minutes if it is common and does not affect the completeness and clarity of the minutes made. However, it is not possible to shorten the name and / or the name, designation of the family status and the names of the municipalities.
§ 12
Write Correction
(1) Incorrect or incorrect data found in the registration of the matrix underline or underline, indicating the correct data
(a) before its conclusion in the section "Records and repairs before signature,"
(b) following its conclusion in the section "Additional records and corrections."
(2) An error in writing shall be corrected by crossing out the wrong number above which the correct number shall be indicated.
§ 13
Signature of registration, additional registration, additional entry and repair
(1) The Registrar shall sign each registration, additional registration, additional entry and correction.
(2) The signature of the matrix must conform to the signature pattern set out in point 4 of Annex No 2.
§ 14
Additional Minutes
(1) An additional entry shall be made in the year of the matrix book in which the matrix event occurred, in such a form as is legally applicable at that time.
(2) Additional entries for matrix events occurring before 1 January 1950 shall be made in the matrix books in which the matrix events of non-religious persons were recorded.
(3) If, due to lack of space, it is not possible to make an additional entry of the matrix event into the matrix book in the relevant year in which the matrix event occurred, the matrix event shall be carried out:
(a) to the matrix book at the end of the year 1949, if the matrix event occurred before 1 January 1950,
(b) the matrix book of the next following year.
§ 15
Additional record
(1) The additional entry shall be made in the section "Additional records and corrections' for the entry to which it belongs.
(2) If the section "Additional records and corrections' is fully filled, a sheet of paper may be glued to the centre of the matrix book for the corresponding entry. This sheet shall be affixed at the two places where it was affixed by means of an official stamp of the matrix office so that part of the stamp is printed in the matrix book. It shall appear on the sheet affixed:" Addendum to the registration of birth (conclusion of marriage, establishment of partnership, death) No... of the Matrix Book of St...... (designation of the Matrix Office)..... '.
§ 16
Method and procedure for keeping the register
(1) The register shall be kept at the end of each bundle of matrix books. Each registration of a matrix event shall be indicated in the register by reference to the number of the matrix sheet. If the matrix book has multiple volumes for matrix events occurring in one calendar year, a common register may be kept in the first volume of that book; in this case, the number of the volume of the matrix book in which the registration is made shall also be indicated in the register.
(2) The register records surnames and names in two columns, left men, right women. Surname (s) shall always be given before name (s). A marriage entered into the register, both by man's surname and by woman's surname. Closed partnerships shall be entered in the register according to the surname of both partners.
(3) If the name or surname of the person registered in the matrix is changed, the change in the register shall be marked with a new entry.
(4) An incorrect or incorrect indication or an erroneous serial number in the register shall be corrected by crossing them out and writing the correct indication or the correct number.
Procedure for registration in matrix books
§ 17
Registration of birth
(1) The registration of the birth shall be carried out by the Matrix by completing the relevant matrix sheet in the birth book as notified.
(2) In particular, in the section "Records and corrections before signature," the consent declaration on the determination of paternity and the use of the surnames of women shall be given.
§ 18
Registration of multiple births
The registration of multiple births shall be carried out by the matricorn in the chronological order of birth of the children and in the section "Records and repairs before signing 'shall be indicated under which order number the sibling's registration shall be made.
§ 19
Registration of a stillborn child
(1) A child born dead will only be written by a matricide in the book of birth.
(2) In the section "Records and repairs before signature" of the registration, the child is indicated as dead-born.
§ 20
Registration of the birth of the child
The registration of the birth of the child found missing shall be made after verification that it has not yet been carried out in the matrix book. The section "Records and repairs before signature 'shall include the time, place and circumstances in which the child was found, a description of his or her special physical characteristics, clothing and marking of other objects related to his or her identification, including the likely age.
§ 21
Registration of marriage and partnership
(1) The registration of a marriage or partnership shall be carried out by the matrimonial by filling in the relevant matrix in the book of marriage or partnership.
(2) In particular, under the heading "Records and corrections before signature," the final decision authorising the Regional Office to conclude a marriage or partnership shall be indicated by an agent, the final decision of the court to authorise the conclusion of a marriage or partnership to a minor over 16 years of age, the certificate of legal capacity to conclude a marriage or partnership or the final decision to forgive it, the certificate of compliance with all the requirements of the Civil Code for the conclusion of a marriage (4) or the partnership.
(3) If the marriage data are entered in the relevant matrix sheet in the marriage book, the words "/ partnership '," / PARTNER / KA' and "/ partnership 'shall be crossed by a horizontal line.
(4) In the case of entry of data on the partnership in the marriage book, the words "marriage / '," MANZEL /', "MANZELKA / 'and" marriage /' shall be crossed by a horizontal line.
§ 21a
Registration of registered partnerships
(1) The registration of the registered partnership shall be carried out by the matrix holder by completing the relevant matrix sheet in the registered partnership book.
(2) In particular, the section "Records and corrections before signature" shall indicate the presentation of a certificate of legal capacity to enter a registered partnership or a final decision on its remission.
§ 22
Registration of death
The registration of the death will be carried out by the Matrix by filling in the relevant certificate in the Death Book.
§ 23
Registration of the death of a person of unidentified identity
(1) The registration of the death of a person of unidentified identity shall include, in the section "Records and repairs prior to signature ', the time, place and circumstances in which the person was found, the description of the clothing and other objects related to the identification of that person and, where appropriate, the special physical characteristics and the likely age.
(2) If the registration of a found dead newborn, the identity of which has been identified, even if subsequently, is carried out by the competent matrix authority, the investigation shall be carried out if such a newborn has not been entered in the matrix book as a child born alive. If not so registered, they shall ensure that the registration is carried out.
Procedure for the issue of birth certificates, marriage certificates, registered partnership documents, death certificates, certificates and verbatim extracts from matrix books
§ 24
(1) The birth certificate, marriage certificate, registered partnership document or death certificate (hereinafter referred to as the "matrix document") is issued only from a closed entry (1) on the prescribed form. Where the birth certificate of a person whose parents are of the same gender (7) is issued, the birth certificate shall be issued on the form set out in Annex 2, in model 23; where the death certificate of the deceased who died during the duration of a partnership or registered partnership is issued, the death certificate shall be issued on the form set out in Annex 2 in Model 12. Data shall be completed by machine-copy or by computer. A copy of the first matrix document issued, a copy of the matrix document issued after an additional entry or correction of the registration in the matrix book shall be entered in a collection of documents or a duplicate of the matrix book kept until 31 December 1958 in the manner set out in Section 8 of the Act. A copy of each additional matrix document, if not the copies referred to in the third sentence, shall be entered in the file documentation.
(2) The names of the municipalities and counties or States shall be indicated in the matrix document by the name of the person in existence at the time of issue of the matrix document, which shall also be entered in the matrix book, unless an indication of the change in the name of the municipality is given on the initial sheet of the matrix book for that municipality. On request, the original name may be entered in the notes of the matrix document.
§ 24a
The multi-lingual standard form shall bear the date of issue, the name, surname and signature of the Registry and the official stamp of the Registry, as appropriate. The multi-lingual standard form shall be closely linked to the matrix document issued or the certificate of legal capacity to conclude a marriage or the certificate of legal capacity to conclude a partnership by stitching together. The sticker shall be affixed by means of an official stamp of the Registry from both sides so that the part of the stamp of the Office is always printed on the sticker and the part on the sheet.
§ 25
(1) Confirmation of the data entered in the matrix shall be issued on request; and
(a) after proof that the person claims abroad; or
(b) where a special law so provides.
(2) Confirmation of the data entered in the matrix book
(a) the designation of the Registry issuing the certificate and the reference number;
(b) an indication of to whom the certificate has been issued,
(c) the reason for issuing the certificate;
(d) the type, date and place of the matrix event;
(e) the name and surname of the person to whom the matrix event relates;
(f) the confirmed fact in the matrix book;
(g) the place and date of completion;
(h) the name and / or surname of the matriarch, his signature and the print of the official stamp of the Registry.
(3) The literal statement shall be provided by the matrician with a clause indicating from which journal the literal statement was made. They shall attach an official stamp of the Registry, name and surname, signature and date.
(4) Matrix documents and certificates from matrix books
(a) transmit to the applicant on the basis of proof of his identity;
(b) send it to their own hands on delivery;
(c) send to the matrix office, which has provided supporting documents for registration in the matrix book, for transmission;
(d) send to the representative office of a foreign state in the Czech Republic if it requests the issue; or
(e) send an official stamp to the Office with extended competence or to the Regional Office to verify the authenticity of the signature of the Registry and the authenticity of the stamp, if the representative office of a foreign State or the State authority of the Czech Republic so requests; the extended office, or the regional office, after verification, sends the matrix document to the Ministry of Foreign Affairs.
§ 26
Procedure for sending the matrix documents abroad
(1) Where a person requests the transmission of a matrix document to a foreign country, the Registry shall send that document to the service itself if an administrative fee has been paid for its issue or if its issue is exempted from payment of the administrative fee.
(2) If the fee for issuing the matrix document has not been paid and its issue is not exempted from the administrative fee, the matrix office shall send the matrix document to the applicant via the representative office of the Czech Republic.
(3) If the matrix documents are to be used abroad, the matrix office shall, upon request, send an extension of office registration document or the county office to verify the authenticity of the signature of the matrix and the authenticity of the stamp (2).
