on the secondment of border guards and troops to the Ministry of Interior to carry out public security tasks
The Bureau of the Federal Assembly of the Czech and Slovak Federal Republic has acted pursuant to Article 58 (3) of Constitutional Act No. 143 / 1968 Coll., on the Czechoslovak Federation, on the following legal measure:
The Government of the Czech and Slovak Federal Republic may, at the request of the Government of the Czech Republic or the Government of the Slovak Republic, assign border guards and troops to the Ministry of Interior ("the soldiers') to carry out public security tasks.
Soldiers may, at the request of the Government of the Republic concerned, be assigned to carry out public security tasks where necessary to ensure security and public order in the territory of the Republic concerned.
Soldiers shall be subordinate to the Minister of the Interior of the Republic concerned for the duration of the secondment.
Soldiers in the performance of Public Security tasks
(a) demonstrate their competence to perform the public security tasks by their prescribed uniform with a red sleeve with black letters "SNB" or, where appropriate, oral declaration, 1)
(b) have the same rights and obligations as members of the National Security Corps, (2) unless the Minister of the Interior of the Republic concerned provides otherwise.
On the assignment of soldiers to perform tasks The provisions of Section 1 (2) (c) of the Law No. 92 / 1949 Coll., as amended, and of Section 51 (2) of Act No. 40 / 1974 Coll., on the National Security Corps, as amended, shall not apply to public security.
This legal measure shall take effect on the date of its publication.
