on the implementation of the profit contribution on the basis of the financial plan
The Government of the Czechoslovak Socialist Republic orders pursuant to § 24 paragraph 2 (b) of Act No. 156 / 1989 Coll., on contributions to state budget:
The profit contribution based on the financial plan shall be made by organisations within the competence of the Federal Ministry of Transport and Communications, with the exception of Czechoslovak Airlines, Slovair, Intrans, the State Institute of Transport Design and the Organisation of Communications, the Federal Ministry of National Defence (1) and the Federal Ministry of Interior, the Organisation of Forestry and Water Management, with the exception of the Hydroprojekt Praha, Water Resources Prague, Water Repair and Engineering Písek, State Forests, the Commercial and Sales Company of Prague and State Forests, the Technical Development Company, Olomouc, the Urban Public Transport Organisation, the Housing Economy Organisation and the Czechoslovak Film Organisation (hereinafter "the Organisation ').
(1) The profit payment on the basis of the financial plan shall be set at the level by which the planned profit formation exceeds the planned profit-based needs; in the case of a planned loss or low profit generation, a grant shall be granted to the sources of distribution.
(2) For the purposes of this Regulation, the planned needs for profit are the government
(a) a uniform allocation of profits to a fund of cultural and social needs at the level laid down in a specific regulation;
(b) the planned allocation of profits to the development fund;
(c) the planned allocation to the reserve but up to a maximum of the minimum balance,
(d) the planned allocation of profits to the remuneration fund at the level laid down in the special regulation, 2)
(e) the planned volume of expenditure on entertainment, refreshments and gifts, on corporate scholarships and, where appropriate, other planned items of profit use.
(1) The planned profit formation, the contribution of the financial plan or, where applicable, the subsidy from the national budget or budget of the national committee shall be determined by the organisations as binding outputs in the relevant national budget or budget of the national committee.
(2) The binding outputs for organisations within the competence of the Federal Ministry of Transport and Communications, the organisation of the Czechoslovak film and the organisation within the competence of the Ministry of Forestry and Water Management and the woodworking industry of the Czech Socialist Republic are set out in the state budget for 1990 as a summary which the central competent authority specifies for each organisation.
(1) The remaining part shall be included in the annual settlement with the relevant national budget or national committee budget.
(2) If the organisation fails to meet the planned profit creation, it will reduce the fixed amount of profit contribution (Section 3) according to the rate of performance of the planned profit creation.
The organisation shall pay, at the latest on the third day before the end of the calendar month, monthly advance payments on profits on the basis of a financial plan of one twelfth of the annual contribution provided for, unless the management authority has decided otherwise at the request of the organisation.
For organisations the provisions of Sections 8 and 17 of Act No. 156 / 1989 Coll., on contributions to the state budget do not apply.
This Regulation shall enter into force on 1 January 1990.
