GOVERNMENT REGULATION
of 12 April 2006
amending Government Regulation No 354 / 2002 Coll., setting emission limits and other conditions for waste incineration
The Government orders pursuant to § 55 paragraph 1 of Act No. 86 / 2002 Coll., on Air Protection and on the amendment of certain other laws (Air Protection Act), as amended by Act No. 92 / 2004 Coll., Act No. 180 / 2005 Coll. and Act No. 385 / 2005 Coll.:
Čl. I
Government Decree No. 354 / 2002 Coll., establishing emission limits and other conditions for waste incineration, is amended as follows:
1. In Paragraph 1 (2), at the end of point (b), the comma is replaced by a dot and point (c) is deleted.
2. The following paragraph 3 is added to Article 1, including footnotes 3a and 3b:
"(3) The requirements laid down in this Regulation for hazardous waste shall not apply to such hazardous waste:
(a) flaming liquid wastes, including waste oils 3a), if they meet the following conditions:
1. the total content of polychlorinated aromatic hydrocarbons or their derivatives, in particular polychlorinated biphenyls (PCBs), or pentachlorophenol (PCP), is not more than 50 mg / kg,
2. do not contain other components which make waste hazardous under the Specific Legislation (3b) and which would impede the recovery of waste in a manner similar to those of fuels; and
3. their calorific value is at least 30 MJ / kg,
(b) flue-gas liquid wastes whose incineration cannot cause emissions other than those resulting from the combustion of gas oil (4).

3. Paragraph 6 (5) is deleted.
Paragraph 6 shall become paragraph 5.
4. Paragraph 9 (2) reads as follows:
"(2) The authorised person referred to in Article 5 (10) shall oversee the correct functioning of emission measurement systems for emissions to air and to water and shall ensure, in accordance with the procedure laid down in the Specific Legislation (10), at least once a year the verification of the accuracy of their measurements and at least every three years their calibration."
5. In Paragraph 10 (2), the comma at the end of point (d) is replaced by a dot and point (e) is deleted.
6. In Section 10 (7) of the introductory part of the provision, the words "or No 6 'are deleted.
7. In Section 10 (8) of the Introductory Part of the Provisions, the words ", No 5, No 6, No 8 and No 9 'are replaced by the words" and No 5'.
8. in Paragraph 10 (10) (a), a comma is added after the words "Annex 2 to this Regulation" and the remainder of the text is deleted.
9. in Paragraph 10 (10) (c), the words "Annexes 2, 6, 8 and 9" shall be replaced by "Annexes 2" and "a" shall be replaced by a comma.
10. in Article 10 (10) (d), the words "Annexes 6, 8 and 9 to this Regulation" shall be deleted;
11. In Paragraph 10, the dot at the end of paragraph 10 is replaced by "a 'and the following point (e) is added:
"(e) 97% of all daily average values of carbon monoxide concentrations in a calendar year shall not exceed the emission limit set in accordance with point (e) (1) of Annex 5 to this Regulation.";
12. In the second sentence of Article 10 (11), the word "values' is replaced by the word" results', the word "given 'is replaced by the word" defined' and in the last sentence the word "year 'is replaced by" calendar year' and the text "% 'is deleted.
13. Paragraph 10 (13) is deleted.
14. In the first sentence of Article 11 (4), a dot is inserted after the words "Annex 5 to this Regulation 'and the remainder of the sentence is deleted.
15. Article 12 shall be deleted, including the title and footnote 13.
16. In Annex 2, point 2.1, second paragraph, third sentence and tenth row, the text "ng / m3 'is replaced by" ng TE / m3'.
17. In Annex 3, the introductory part of the text of paragraph 3 reads: "The value of 95% of the confidence interval of the individual measured result at the daily emission limit value level shall not exceed the following percentages of the emission limit values. '
18. In Annex 4, in the 11th row of the table, the text "ng / l 'is replaced by" ng TE / l'.
19. In Annex 5, the words "gaseous compounds' are replaced by the words" gaseous inorganic compounds'.
20. Annexes 6 and 8 to 11 are deleted.

This Regulation shall enter into force on 1 July 2006.
