DECLARATION
Ministry of Agriculture
of 6 September 1999
amending Decree of the Ministry of Agriculture No. 83 / 1997 Coll., on the protection against the introduction of harmful organisms on importation, transit and export of plants and plant products and against their spread within the Czech Republic and on systematic plant health control
The Ministry of Agriculture, after consulting the Ministry of Transport and Communications, the Ministry of Finance and the Ministry of Industry and Trade, provides pursuant to § 45 (1) of Act No. 147 / 1996 Coll., on Phytosanitary Care and Changes to Certain Related Acts (hereinafter referred to as "the Act"):
Decree No. 83 / 1997 Coll., on the protection against the introduction of harmful organisms on the import, transit and export of plants and plant products and against their spread within the Czech Republic and on systematic plant health control, is amended as follows:
1. In Article 5 (3), at the end of "in addition to the original phytosanitary certificate or a certified copy thereof, accompanied by a new phytosanitary certificate or a phytosanitary certificate for re-export ', the following sentence is added:" If
(a) when imported into the Czech Republic the certificate according to the first sentence does not fully confirm the health status of the consignment according to the applicable phytosanitary rules of the Czech Republic;
(b) when exported from the Czech Republic, it is not possible to fully confirm, for material reasons, the health status of the consignment in accordance with the applicable phytosanitary rules of the importing State;
the consignment must be accompanied by a phytosanitary certificate for re-export and a phytosanitary certificate from the country of origin of the consignment or a certified copy thereof. ';
2. in Article 6 (1) (d), including footnote 2a, the following shall be added:
"(d) consignments which do not comply with the specific quarantine requirements laid down in Annex 9; compliance with the specific quarantine requirements (hereinafter referred to as" official confirmation ") shall be indicated in the supplementary declaration of the phytosanitary certificate and, if the treatment of plant protection products is concerned, also in the section" Dissection and / or disinfection "of the phytosanitary certificate, unless otherwise provided for by an international agreement to which the Czech Republic is bound, 2a).
3. In Article 7, the following paragraph 3 is added:
"(3) The working hours of the operational arrangements of the entry points shall be determined and published in the Ministry of Agriculture Bulletin by the State Plant Health Administration (hereinafter referred to as the" Plant Health Administration "). '
4. In Section 8 (1), the words "State Plant Health Administration (hereinafter referred to as the" Plant Health Administration ") 'are replaced by the words" Plant Health Administration' and the words "these particulars in the transport documents' are replaced by the words" in the transport document that the consignment is required to carry out plant health checks outside the entry point '.
5. Paragraph 8 (3) reads as follows:
"(3) Imported or accompanying consignment
(a) it must be returned or destroyed if:
1. it is subject to the import and transit ban provided for in Article 6 (1);
2. its origin or identity is not reliably established;
3. it is not accompanied by a phytosanitary certificate or phytosanitary certificate for re-export in accordance with § 8 (2) and (3) of the Act or by any other official document in accordance with § 8 (4) of the Act,
4. it is not accompanied by a phytosanitary certificate containing the particulars referred to in Article 5 (1);
5. its state or manner of storage does not permit a phytosanitary inspection at all;
(b) they must be destroyed if there is an imminent risk of spreading the quarantine pest;
(c) may, except for a consignment whose import is prohibited, be placed under the proposed customs regime (4), provided that exceptional plant health measures have been complied with, provided that the consignment has been found to contain non-quarantine harmful organisms and that such exceptional plant health measures have been prevented from spreading and causing harm. "
6. in Article 12 (1) (a), the words "for loss of income or" shall be deleted;
7. in Article 12 (3), the following point (d) is inserted after point (c):
"(d) whether the applicant is a payer of value added tax,";
Points (d) to (f) shall be renumbered as points (e) to (g).
8. in Article 12 (3) (e):
"(e) place of implementation of emergency plant health measures: municipality, cadastral territory, parcel number and, where appropriate, more precise marking of the place;"
9. Paragraph 12 (4) reads as follows:
"(4) The application referred to in paragraph 2 shall be accompanied by:
(a) proof of business (extract from the business register, trade certificate or extract from the register of persons engaged in agricultural production);
(b) the tax authority's registration certificate of the payer;
(c) evidence of ownership or use of the land or objects concerned for any other legal reason;
(d) accounting documents and, where appropriate, tax documents proving the property damage suffered as a result of the implementation of exceptional plant health measures. "
10. The indication of the provisions on efficiency varies from "§ 11" to "§ 13."
11. In Annex No 1, Part B, the following point 5 is inserted after point 4:
"5. Bacterial Topol Cancer
Xanthomonas populi (Ridé) Ridé et Ridé '.
Points 5 to 17 shall become points 6 to 18.
12. In Annex 1, Part C, the following point 11 is inserted after point 10:
"11.
Mycosphaerella dearnessii M. E. Barr. "
Points 11 to 14 shall be renumbered 12 to 15.
13. In point 3 of Annex 2, the words "shallots (Allium cepa L.) 'shall be inserted after the words" allium ascalonicum L.';
14. In Annex 2, points 6 and 7 are replaced by the following:
'6. Wood which:
(a) comes wholly or partly from plants:
- chestnut tree (Castanea Mill.), except bark-free wood,
- platinum (Platanus L.), including wood stripped of natural rounded surface, and
(b) is put into circulation as:
- fuel wood (logs, blocks, branches, heating, etc.),
- wood chips or chips,
- residues of wood or wood waste not agglomerated in blocks, briquettes, pellets, etc.,
- raw wood, including stripped of bark or roughly squared, provided it is not coated or coated with creosote or other preservatives,
- split bars, wooden poles or pins, painted, not sawn lengthwise,
- railway or tramway sleepers of wood not impregnated,
- wood sawn or chipped lengthwise or cut into pieces, other than planed, sanded or joined by wedges, of a thickness exceeding 6 mm (in particular beams, foils, landscapes, boards, lats).
7. Separate bark of chestnut tree (Castanea Mill.). "
15. In the first indent of point 1 of Annex 3, the words "shallots (Allium porrum L.) 'shall be inserted after the words" Allium cepa L.), "" shallots and tubers of the genus Solanum L. and their cross-breeds' shall be inserted after the words "triticale (Triticosecale Wittamp)," and the words "and 'shall be deleted after the words" Medicago sativa L.';
16. In Annex 3, point 1, the third indent "wheat seed (Triticum L.) and triticale (Triticosecale Wittlock), originating in Afghanistan, India, Iraq, Mexico, Nepal, Pakistan and the USA 'is deleted.
17. In the first indent of point 2 of Annex 3, the words "maize (Zea mays L.) including dry sticks' shall be inserted after the words" daiquiris (Leucanthemum Mill.) '.
18. In Annex 3, point 6 (b):
"(b) is imported and, where appropriate, accompanied by:
- fuel wood (logs, blocks, branches, heating, etc.),
- wood chips or chips, except pine wood (Pinus L.) originating in European countries,
- residues of wood or wood waste not agglomerated in blocks, briquettes, pellets, etc.,
- raw wood, including debarked, stripped or roughly trimmed, unless it is coated or pickled with creosote or other protective equipment, with the exception of pine wood (Pinus L.) originating in European countries,
- split poles, wooden poles and pins, pointed, sawn lengthwise, excluding pine wood (Pinus L.) originating in European countries,
- unimpregnated wooden railway or similar sleepers,
- wood sawn or chipped lengthwise or cut into pieces, peeled, other than planed, sanded or joined by wedges, of a thickness exceeding 6 mm (in particular beams, foils, landscapes, planks, lats), with the exception of pine wood (Pinus L.) originating in European countries,
- packaging of wooden boxes, cages and drums, originating in non-European countries,
- simple pallets and box pallets, with the exception of pallets which meet the requirements of the International Railway Union Code (UIC) No 435-2 for "European free wooden pallets of wood" and which are also appropriately marked, other loading platforms and flint pallets of wood originating in non-European countries,
- oak barrels (Quercus L.), including pulp. '
19. In Annex 3, point 10 is added:
"10. Grain of wheat (Triticum L.), triticale (Triticosecale Wittlock) and rye (Secale L.) originating in all countries. '
20. In Annex 6, Part A, including footnote 1, read:
