laying down requirements on the quality and sale of direct combustion fuels
According to § 12 (e) of the Act of the Czech National Council No. 389 / 1991 Coll., on the State Administration of Air Protection and Charges for Pollution, the Ministry of the Environment provides for the Act of the Czech National Council No. 389 / 1991 Coll., on the State Administration of Air Protection and Charges for Pollution, having regard to § 6 (3) of Act No. 218 / 1992 Coll.:
§ 1
Scope
The Decree applies to legal and natural persons who, as entrepreneurs (1), produce, import or sell fuels for direct combustion ("sellers').
§ 2
Basic concepts
(1) The fuel for direct combustion ("fuel") is the final product of the production of the fuel intended for heat generation by combustion. Under these conditions, fuel produced from coal is also a mixture of substances which weigh sulphur in the combustion of sulphur and extracted fuel with a stoichiometric ratio of calcium oxide to sulphur of more than 1: 1 ("additive fuel ').
(2) The purpose of application is to distinguish fuel for the population, for business and for energy installations.
(3) Fuel for the population is fuel intended for small sources of pollution in dwellings, family houses or buildings for individual recreation and fuel for other small sources of pollution of heat output below 50 kW.
(4) The fuel for business is fuel intended for medium sources of pollution and for small sources of pollution with a heat output exceeding 50 kW, unless it is fuel referred to in paragraph 3 or fuel for energy installations.
(5) Fuel for energy installations is a fuel intended for technological buildings containing stationary combustion plants with a rated heat output of more than 5 MW (power plants, CHP plants and heating plants) .2)
(6) The actual value of the specific sulphur content of the Srm sk fuel is the sulphur content in grams in the original fuel relative to the calorific value [MJ.kg-1] in a 24-hour sample by the manufacturer of the dispatched fuel type.
(7) The maximum specific emissions of sulphur dioxide (SO2) rm max are the maximum permissible emissions of SO2 from the additive fuel in its original state (i.e. with all water content) expressed in SO2 grams per calorific value [MJ.kg-1] in each individual fuel delivery.
(8) The average specific sulphur content of the Srm fuel is the average sulphur content in grams in the original fuel relative to the calorific value [MJ.kg-1] in deliveries per seller over a period of one quarter.
(9) The maximum specific sulphur content of the Srm max fuel is the maximum permissible sulphur content in grams in the original fuel related to the calorific value [MJ.kg-1] in each individual supply.
(10) The maximum sulphur content of the fuel Sdmax is the maximum amount of sulphur related to the anhydrous fuel permitted for each consignment by weight (% w / w). For liquid fuels,% m Smax shall be used indicating the sulphur content of the fuel.
§ 3
Fuel quality requirements
(1) The fuel quality requirements are set out in Annexes 1 to 3.
(2) The fuel quality requirements referred to in paragraph 1 shall apply as follows:
(a) Annex 1, starting from 1 January 1994 without a time limit;
(b) in accordance with Annex 2, from 1 January 1994 and ending on 31 December 1994,
(c) Annex 3, starting from 1 January 1995 without a time limit.
(3) The provisions of the preceding paragraphs shall not apply to fuel when used in equipment equipped with a desulphuriser.
§ 4
Special conditions for sale
(1) When supplying fuel, the seller is obliged to certify its quality. The certificate shall contain:
(a) the name, registered office and identification number of the seller;
(b) the name (company) and address (seat) of the buyer;
(c) the purpose of the application;
(d) the type of fuel and its precise production description;
(e) details of compliance with the requirements for maximum specific sulphur content or maximum sulphur content or maximum specific emissions of sulphur dioxide content for the intended purpose of use;
(f) weight,
(g) the actual value of the specific sulphur content or sulphur content;
(h) the date of loading,
(i) the name of the official issuing the certificate.
(2) Where the information required in paragraph 1 (g) cannot be already stated in the certificate, the seller shall communicate that information to the buyer no later than 24 hours after the analysis of the relevant 24-hour sample of the fuel dispatched has been completed.
(3) When selling fuel for heating purposes in apartments, family homes and recreational facilities for individual recreation, the certificate shall be limited to the data referred to in paragraph 1 (a), (b), (c) and (e).
§ 5
Final provision
This decree shall take effect on the day of its publication.
