Regulation of the Minister for Labour and Social Welfare
of 1 September 1949
on social security measures for Czechoslovak citizens living abroad.
The Minister of Labour and Social Welfare, in agreement with the Ministers of Finance and Foreign Affairs, hereby orders, pursuant to Paragraph 2, paragraph 2 of the Law of 30 June 1948, No 174 Coll., to abolish home law:
(1) Czechoslovak citizens living abroad who are legally reliable and committed to the People's Democratic establishment of the Czechoslovak Republic and who are found for sickness, disability, old age or without any other reason in need, can be provided with social measures under this Regulation (in other words "social measures"), unless the necessary measures can be taken otherwise.
(2) Persons shall be excluded from social security measures:
1. who have left the territory of the Czechoslovak Republic illegally after 5 May 1945 or who have not returned to the Czechoslovak Republic without serious reasons after the authorisation given to them has expired; or
2. which refused without serious reasons to move on to the invitation of the representative office to cargo the state to the Czechoslovak Republic.
(3) There is no legal entitlement to social security measures.
Social measures may depend on the nature and extent of the emergency of provision
1. one-off assistance; or
2. social loans for a maximum period of three years; or
3. regular social contributions up to the amount of the social pension under the National Insurance Act.
The provision of social assistance is decided by the representative authorities under the directives issued by the Ministry of Foreign Affairs in agreement with the Ministry of Labour and Social Welfare, Finance and National Security.
This Regulation shall enter into force on the day of its publication.
