GOVERNMENT REGULATION
of 10 September 2014
amending Government Regulation No 135 / 2009 Coll., providing a one-off contribution to mitigate certain injustices caused by the Communist regime, as amended by Government Regulation No 51 / 2013 Coll.
The Government hereby orders pursuant to Paragraph 8 (1) of Act No. 198 / 1993 Coll., on the illegality and resistance of the Communist regime, as amended by Act No. 220 / 2011 Coll.:
Government Regulation No. 135 / 2009 Coll., providing a one-off contribution to mitigate certain injustices caused by the Communist regime, as amended by Government Regulation No. 51 / 2013 Coll., is amended as follows:
1. In Article 1, the following paragraph 3 is inserted after paragraph 2:
"(3) The person referred to in paragraph 2 who has been awarded a contribution pursuant to paragraph 1 or 2 shall be entitled to the grant for the period of inclusion in the technical battalion, provided that the inclusion in the technical battalion is directly linked to the inclusion in the forced labour military camp; the contribution for the period of inclusion in the technical battalion shall not be for the month for which the contribution has already been granted for the period of inclusion in the forced labour military camp. ';
Paragraph 3 shall become paragraph 4.
2. In Section 1, the words "or in the technical battalion 'shall be added at the end of the text of paragraph 4.
3. In Article 2, the following paragraph 3 is inserted after paragraph 2:
"(3) The Ministry of the Interior shall decide on the entitlement to the payment of the contribution provided for in Article 1 (3) upon written request of the person referred to in Article 1 (3), which shall attach to the application the documents certifying his entitlement. The application may be lodged by 31 March 2015 at the latest, otherwise entitlement to payment of the allowance shall cease. '.
Paragraph 3 shall become paragraph 4.
4. In Article 3, the words "in § 1 (1) or (2) 'are replaced by the words" in § 1 (1), (2) or (3)';
5. At the end of the text of § 3, the words "and, in the case of an application for payment of the allowance provided for in § 1 (3) concerning a widow after a citizen of the Czech Republic fulfilling the conditions laid down in § 1 (3), if that citizen of the Czech Republic or after him has been granted a contribution under § 1 (1) or (2)."
Transitional provision
Where a person has been granted a right to receive a contribution pursuant to Government Regulation No. 135 / 2009 Coll., as effective before the date of entry into force of this Regulation, he may not be entitled to pay the contribution again on the basis of the same facts.
Efficacy
This Regulation shall enter into force on the day of its publication.
