laying down requirements for the keeping of operational records of large and medium-sized sources of pollution and the scope of other data provided by their operators to air protection authorities
According to § 12 (d) of the Act of the Czech National Council No. 389 / 1991 Coll., on State Air Protection Administration and Charges for Pollution:
General provisions
Scope
This decree covers operators of large and medium-sized pollutions1) (hereinafter referred to as "operators').
Basic concepts
For the purposes of this decree:
(a) an operational record of the keeping of records that are relevant to air pollution in relation to the operation of the source, in particular records of the characteristics and quantities of pollutant emissions;
(b) the emergency state of operation of the source of pollution (hereinafter referred to as "the accident"), an unexpected or unexpected state of operation in which air quality is seriously and immediately compromised or deteriorated and where it is necessary to stop or reduce the source of pollution or part thereof or, where appropriate, any other activity which is the technical cause of the accident;
(c) one-off measurements are emissions measurements carried out at prescribed intervals in a manner of short-term measurements;
(d) continuous measurement is continuous measurement of emissions over a calendar year by means of continuous measurement instruments with the registration of results and simultaneous recording, evaluation and storage of measured data by means of computing.
Operational record keeping requirements
Content of operating records
(1) The operational records shall record permanent and variable data to the extent set out in the Annex.
(2) Operating records shall be kept separately for each individual source of air pollution. The operational records shall include records of the cumulative monthly and annual evaluation of the operational records for all sources of pollution monitored therein.
(3) The records shall record:
(a) permanent data on a one-off basis and on each change;
(b) variables of data at regular intervals, at least four times in each operational shift, and any change in operating conditions affecting the quantity or characteristics of emissions. For single or continuous measurements, the result shall be recorded as a variable.
(4) The summary evaluation of the operational record data shall contain an overview of all fixed data and the average values of all data variables as set out in the Annex. The summary evaluation shall be carried out by the operators at the end of each month at the latest by the end of the following month and thereafter after the end of the calendar year, at the latest by the time specified for the calculation of the pollution charges. 2) An alert shall be issued for the summary evaluation.
(5) Operators shall keep a register of operations and all documents relating thereto for a period of three years; the general archiving rules apply after this period.
(6) For failure to comply with obligations under the previous provisions, the air protection authority shall impose a fine on operators of sources of pollution pursuant to § 18 (1) and (3) of the Air Protection Act.
Provision of traffic record data
(1) Operators are required to report data on the start and end of operation of sources of pollution and on the inclusion or change of classification in the category of sources of pollution within 15 days of the occurrence of these factors.
(a) Czech environmental inspection,
(b) the district office in whose territory the source of pollution is located;
(c) the municipality in whose territory the source of pollution is located.
(2) Operators are required to transmit to the Czech Environmental Inspection Office and to the District Office by 15 February of the calendar year a summary assessment of the traffic records for the previous calendar year.
(3) In order to verify the accuracy of the calculation of air pollution charges, operators are required to submit their operating records at any time within the period laid down in § 3 (5) at the invitation of the Czech Environmental Inspection Office or the District Office.
Accident report
(1) Operators are obliged to report the crash immediately after its detection to the Czech Environmental Inspection Office and to the district authorities, the municipal authorities and the health services whose territorial districts may be affected by the accident.
(2) The report shall include:
(a) the name of the establishment and the location and time of establishment and, where known, the expected duration of the accident;
(b) the type of pollutant emissions and their likely quantities;
(c) the intended cause of the accident;
(d) measures taken to eliminate the consequences of the accident.
Within 14 days of the notification of the accident referred to in Article 5, operators shall be required to prepare a report which, in addition to a summary of all available supporting documents for determining the size of the leakage of pollutants into the air, shall include:
(a) the name of the establishment in which the accident occurred;
(b) the timing and duration of the accident;
(c) the type and quantity of pollutant emissions during the accident;
(d) the cause of the accident;
(e) precautionary measures taken to prevent further accidents;
f) Timetable for the notification of an accident by the Czech Environmental Inspection Office.
The operator is obliged to provide additional data on request from the Czech Environmental Inspection.3)
Final provisions
(4) the competent air protection authorities may publish the data identified by the operator as an object of commercial secrecy only with the approval of the operator.
This decree shall take effect on the day of its publication.

Scope of the fixed and variable data constituting the traffic register
Large sources of pollution
A. Identification of source of pollution:
Permanent data: cadastral territory number, administrative territory (district), source identification number, name and address of the operator, organisational code, IČO, location address, municipality number, location number, location, location of air pollution charges, last year's fines, air pollution charges, composition of the source (e.g. boiler room with separators, technology, mines, quarries, landfill, burning area, steamed volume, etc.), bank connections and account number of the legal or natural person paying the fees.
B. Data on boilers and heat production:
Permanent data: boiler number, rated heat output, type of furnace, type and type of boiler, boiler manufacturer, year of production, putting into service, type of fuel, fuel supplier, heat production per year, efficiency, daily and weekly production rate, operating hours per year, average use of rated heat output;
for boilers in electricity or cogeneration, also: installed block power, electricity generation per year, efficiency, average use of installed electricity.
Variables: heat production, electricity production.
C. Fuel quality and consumption data:
Constant data: boiler number, boiler group, types of fuel fired, consumption of individual types of fuels per month and year, average quality characteristics of individual fuels - calorific value, water content, ash content, sulphur content (A and S in dry matter and in the original sample), total operating hours per month and per year.
Variables: boiler number (identifier), hourly consumption of single fuel types, quality characteristics of individual fuels - calorific value, water content, ash content, sulphur content.
D. Data on technology equipment:
Continuous data: operating number, type of production, production line number, name and output of technological equipment (production lines), manufacturer and year of entry into service, name and size of technical section, specification of separators and chimneys.
E. Production data for technologies:
Fixed data: operation number, product serial number, name and quantity of product (per month and per year), type of fuel, average fuel quality characteristics, fuel consumption per month and per year, type, specification and quantity (per month and per year) of input raw materials, semi-finished and operating materials, operating hours per month and per year, type of pollutant leakage, production rate - daily, weekly, monthly and annual.
Variables: operation number (identifier), name and hourly quantity of the product, type of fuel, quality characteristics of fuel (calorific value, ash content, sulphur content), hourly fuel consumption, type, specification and hourly quantity of input raw materials, semi-finished products and operating materials.
F. Data on emission control devices:
Continuous data: designation of the separation device, type of separation device, number of units, manufacturer, type, size, year of manufacture and year of entry into service, time utilisation per month and per year, type of pollutant, guaranteed and average achieved efficiency (separability), average hourly flow of separator.
Variable data: identification of the separator, type of pollutant (identifiers), time utilisation, achieved efficiency (separability), flow rate of the separator.
G. Data on chimneys and emissions:
Constant data: number and name of operation, chimney number, chimney height, construction material, type and number of mouthpiece devices, internal surface (lightness) in the chimney crown, altitude of the chimney heel, geographical coordinates, average quantity, temperature and speed of gas flowing through the chimney, specification of further releases of pollutants, pollutant emissions - type and quantity (month and year) in connection with individual chimneys or releases.
Variables: number and name of operation, chimney number (identifiers), quantity, temperature and speed of gas flowing through the chimney, pollutant emissions - type and quantity per hour - in relation to individual chimneys or leaks.
H. Emissions measurement data:
Continuous data: name of the pollutant, type of measurement, measuring organisation, time and location specifications, instrument technology specification and measurement methods.
Variable data: *) name of the pollutant, specification of the measuring site (identifiers), flow, temperature and pressure of the carrier gas, oxygen content of the carrier gas, concentration and mass flow of the detected pollutant.
I. Data on emergency operating conditions or accidents of production facilities, data on hazardous operating conditions (accidents) of production facilities and / or pollution detection devices.
J. Documentation additional to the operating record and records of continuous measurement results.
A. Identification of source of pollution:
Permanent data: name and address of the operator, ICO of the operator, fines and charges for air pollution paid last year, bank connections and account number of the legal or natural person who pays the fees, name and address of the location of the source, cadastral territory number, composition of the source, source identification number.
B. Data on fuel incineration plants:
Fixed data: serial number of the installation, type designation and manufacturer, rated heat output, type of heater, year of production, year of entry into service, type of fuel, operation rhythm, operating hours per year, average annual use of rated heat output;
for installations producing electricity or cogeneration also: installed electricity, electricity generation per year, efficiency, average use of installed electricity.
C. Fuel quality and consumption data:
Fixed data: serial number of the installation, fuel quality specification, operating hours, total fuel consumption per month and per year.
Variables: device serial number (identifier), fuel consumption.
D. Data on technological sources of pollution:
Fixed data: type of production code, name of technology, year of entry into service, specification of separators and chimneys.
E. Production data for technologies:
Continuous data: code and name of technology, product name, product quantity, type of fuel (in case of technological swelling - keep records according to C.), specification and quantity of input raw materials, semi-finished materials and operating materials, operating hours (per day, week, month and year), type of leakage and specification of pollutants.
Variables: product name (identifier), product quantity.
F. Data on emission control devices:
Constant data: identification and specification of the separator - type of separator, number of units, manufacturer, type, year of entry into service, type of separated pollutant, guaranteed and achieved efficiency, quantity of separated pollutant, time utilisation per month and per year.
G. Emissions and chimneys data:
Permanent data: type of leak, emission of pollutants - type and quantity in relation to individual leaks and chimneys, altitude of the object, or heel of the chimney, geographical coordinates, serial number of the leak, virtually chimney, height of chimney, inner surface (light) in the chimney crown, average amount and temperature of gas flowing through the chimney, type and number of mouthpiece devices.
H., I. and J.: in cases where applicable to the same extent as the part of this Annex for large sources of pollution.
