Government Regulation
of 6 September 1949
on the change of competence in the field of care of military and war victims and victims of war and fascist persecution.
The Government of the Czechoslovak Republic hereby orders pursuant to § 1, paragraph 1, point (a) of the Act of 11 May 1949, No 143 Coll., on changes in the organisation of public administration and within the jurisdiction of its bodies:
Čl. I.
Article 35 (2) and Article 45 (2) of the Law of 18 July 1946, No 164 Coll., on the care of military and war damages and victims of war and fascist persecution, the Ministry of Labour and Social Welfare and pursuant to Sections 3, 3, 7, 4, 2, 5, 7, 1, 9, 1, 10, 3, 11, 2, 21, 1, 24, 2, 3, 39, 43, 1, 45, 3, 49, 1 and 4, 52, 2, 53, 55, 1 and 56, paragraph 1 of the Law of the Ministry of Labour and Social Welfare in the Agreement with the Ministry of Finance, transforms into the State Offences.
Čl. II.
The scope, which falls within the scope of § 74, paragraph 1, of the First Law No 164 / 1946 Coll. of the Ministry of Labour and Social Welfare in an agreement with the Ministry of Health, passes to the State Offices for Damage, which implement it in an agreement with the Regional National Committee responsible for the place of residence of the doctor.
Čl. III.
The scope of the appeal procedure laid down in § 77 of Law No 164 / 1946 Coll. is newly amended as follows:
1. The Ministry of Labour and Social Welfare decides on appeals from decisions of the State Office for War Damage.
2. However, if the State Office for Damage has reached the view that the appeal could be granted, it may itself grant the appeal and arrange for the appeal.
3. If the appeal is directed against the assessment of the extent and degree of damage, it is submitted by the State Office for War Damage to the Appeal Board (Section 78 of Act No. 164 / 1946 Coll.) for an assessment. The Board of Appeal shall be bound by this opinion in substance. It is entitled to review it only on a formal basis, but it is obliged to ascertain whether it completes the appeal and does not contradict the content of the files.
Čl. IV.
This Regulation shall enter into force on the day of its publication; they shall be carried out by the Minister for Labour and Social Welfare in agreement with the Ministers involved.
