THE LAW
of 3 May 2005
amending Act No. 117 / 1995 Coll., on State Social Support, as amended
Parliament has decided on this law of the Czech Republic:

1. in Paragraph 30 (3) (a):
"(a) a child who has not reached the age of 3 shall attend a nursery or other similar establishment for children not exceeding 5 calendar days in a calendar month, unless otherwise specified below; for a visit to a child in a nursery or similar facility for children on a calendar day, means any day on which the child visits a nursery or said establishment, irrespective of the duration of the visit; ';
2. in Article 30 (3), the following point (b) is inserted after point (a):
"(b) a child who has reached 3 years of age regularly attends a nursery school or other similar facilities for pre-school children to a range not exceeding 4 hours a day;"
Points (b) to (d) shall be renumbered (c) to (e).
3. In Paragraph 31 (2), the words "(a) 'are deleted.
4. In Article 54 (4), the following sentence is added at the end of the paragraph: "The provisions of the first sentence shall also not apply if a woman is entitled to a parental allowance for the period during which she carries her child and takes care of her child in the exercise of custody under the special legislature48d).
48d) § 28a of Act No. 293 / 1993 Coll., on the performance of the custody, as amended by Act No. 52 / 2004 Coll. '
Transitional provision
In the case of a child attending a nursery, maternity school or other similar institution for pre-school children, entitlement to a parental allowance shall be assessed in accordance with Article 7 (2) of Regulation (EU) No 1306 / 2013. Even from the beginning of the calendar month following the month in which the Act took effect.
Efficacy
This Law shall take effect on 1 January 2006.
