laying down closer conditions for the implementation of the common organisation of the market in dried fodder
The Government orders pursuant to § 2b (2) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll.:
§ 1
Subject matter
This Regulation (1) provides for detailed conditions for the implementation of the common organisation of the market in dried fodder following the directly applicable rules of the European Communities (1a) (hereinafter referred to as "the European Communities').
§ 2
Approval of the processing undertaking
(1) The undertaking processing dried fodder shall submit an application for approval as a processing undertaking to the State Agricultural Intervention Fund (hereinafter referred to as "the Fund") in the period from 1 to 31 January before the beginning of the marketing year in question.
(2) The application for approval referred to in paragraph 1 shall be made on a form issued by the Fund.
(3) The application referred to in paragraph 1 shall be accompanied by proof, in addition to the documents referred to in European Communities2, that the applicant is an entrepreneur under specific legislation. 5)
(4) The processing undertaking shall notify the Fund of any change in the documents provided for in paragraph 3 within the time limit laid down by the European Communities.
§ 3
Approval of buying-in feed for drying and grinding
(1) Natural and legal persons meeting the conditions laid down in the provisions of the European Communities (7) shall submit to the Fund an application for approval of their status as collectors of fodder for drying and grinding during the period from 1 to 31 January before the beginning of the marketing year in question. (4)
(2) The application for approval referred to in paragraph 1 shall be made on a form issued by the Fund.
(3) The application referred to in paragraph 1 shall be accompanied by proof that the applicant is an entrepreneur under specific legislation. 5)
§ 4
Application for subsidy
The application for a grant for processing dried fodder shall be submitted on the form issued by the Fund.
§ 5
Acceptance and re-acceptance of dried fodder
(8) inform the Fund in writing no later than 48 hours before receiving or re-accepting dried fodder. The information shall indicate the estimated time of receipt of the dried fodder, its quantity, quality, origin and place of receipt and the reason for receipt or re-acceptance.
§ 6
Transitional provision
Applications pursuant to Article 2 (1) or Article 3 (1) shall be submitted for the 2004 / 2005 marketing year at the latest by 15 May 2004.
§ 7
Efficacy
This Regulation shall enter into force on the date of the entry into force of the Treaty of Accession of the Czech Republic to the European Union.
