DECLARATION
Ministry of Labour and Social Affairs
of 11 October 1994
determining the scope and detailed conditions for the provision of personal protective equipment and of washing, cleaning and disinfection equipment
According to Section 133 (8) of Act No. 65 / 1965 Coll., Labour Code, as amended by Act No. 74 / 1994 Coll., in agreement with the Ministry of Health:
Provision of personal protective equipment
(1) Personal protective equipment ("protective equipment") is intended for the purposes of this Decree to protect workers from risks which could endanger their life, safety or health at work. Women's or girls' garments and clothing accessories 1)
(2) Safeguards for the purposes of this Decree are not:
(a) clothing, footwear which does not serve to protect health and safety at work;
(b) rescue and emergency facilities operating under special regulations;
(c) sports equipment;
(d) means intended for self-defence.
(3) Only those protective equipment which comply with the conditions laid down in specific legislation.3)
(1) The protective equipment is provided by the employer according to his own list, based on risk assessment and specific conditions at the workplace.
(2) The risk assessment and the modification of the list for the provision of protective equipment shall be carried out by the employer again as soon as changes are made regarding safety and health at work as a result of the introduction of new technology, the creation of new working conditions or changes to existing working conditions.
(1) The employer provides protective equipment where the risks of work cannot be excluded or adequately reduced by technical means of collective protection or other measures.
(2) Protective equipment must:
(a) be effective against and shall not pose an additional risk during use;
(b) comply with existing workplace conditions;
(c) respect the ergonomic requirements and health of workers;
(d) be adapted to the physical assumptions of the staff.
(3) Where the presence of more than one risk requires workers to use at the same time more protective equipment, such protective equipment must be mutually compatible.
(4) Staff members must be informed of the use of protective equipment. Their use for multiple employees is only possible if measures have been taken to avoid threats to communicable diseases.
(5) The method, conditions and duration of use of the protective equipment shall be determined by the employer on the basis of the frequency and severity of the risks involved, the characteristics of the work and the workplace and taking into account the characteristics of the protective equipment.
Provision of washing, cleaning and disinfection products
(1) The employer provides cleaning, cleaning and disinfection products to workers. Protective ointments shall also be considered as disinfectants.
(2) Save as otherwise provided in the specific regulation, 4) the employer provides washing, cleaning and disinfection products according to a list drawn up by the employer on the basis of an assessment of the extent of the pollution of workers at work or the risk of irritants.
(3) Workers who come into contact with substances which may cause skin irritation (acids, lyes, organic solvents, etc.) or which may cause irritation of irritants (tar substances, heating oils, epoxy resins, etc.) are provided with disinfectants according to the type of harmful substance.
Common and final provisions
(1) The provisions of this Decree shall apply mutatis mutandis to employers who are natural persons and who work themselves, to natural persons who do business under a special rule and do not employ anyone, and to their co-operating spouse or child. 5)
(2) The provisions of this Decree apply mutatis mutandis to all persons who, with the employer's knowledge, are present at his workplace. 6)

(1) The following shall be deleted:

11th Decree of the Ministry of Health and Social Affairs of the Czech Republic No. 227 / 1990 Coll., on the provision of personal protective equipment.
(2) All measures still in force in the field of the provision of protective equipment, washing, cleaning and disinfection products shall also be repealed.
This Decree shall take effect on 1 January 1995.
