DECLARATION
of 1 July 2011
amending Decree No 467 / 2003 Coll., on the use of tobacco labels in the labelling of tobacco products, as amended
According to Article 139 (1) of Act No. 353 / 2003 Coll., on Consumer Taxes, as amended by Act No. 217 / 2005 Coll., Act No. 575 / 2006 Coll. and Act No. 37 / 2008 Coll.:
Decree No. 467 / 2003 Coll., on the use of tobacco labels in the labelling of tobacco products, as amended by Decree No. 276 / 2005 Coll. and Decree No. 72 / 2007 Coll., is amended as follows:
1. In Article 2 (1), the words "or, with a precision of 50 halers' shall be deleted and the words" and other tobacco of such quantities' shall be replaced by the words "quantities'.
2. Paragraph 2 (3) reads as follows:
"(3) The tobacco sticker shall be glued to the designated part of the package which is designed to be opened so that it cannot be opened without visible damage to the tobacco sticker. The packaging may only have one part designed to be opened. '
3. In Article 2, paragraphs 4 and 5 are deleted.
4. In both the heading and the text of Section 3, the words "a servant working in a customs office 'are replaced by the words" an official of the customs office' and the words "manufacturer 'are replaced by the words" authorised consignee'.
5. In both the heading and the text of Section 4, the words "the staff member working in the Customs Directorate authorised 'shall be replaced by the words" the official of the Customs Directorate authorised' and the words "under 'shall be inserted after the words" Article 118 (6) a'.
6. In Article 5 (1), the words "smoking tobacco and other tobacco 'are replaced by the words" smoking tobacco'.
7. In Article 9, the words "a staff member who works in an authorised customs office and 'are replaced by the words" an official of the authorised customs office which';
8. Article 9a shall be deleted, including the title.
9. In the heading of Annex No 1, the words "a staff member working in a customs office 'are replaced by the words" an official of the customs office'.
10. In Annex No 1, the word "staff member 'is replaced by" official person of the customs office'.
11. In the title of Annex No 2, the words "the staff member working in the Customs Directorate, authorised 'are replaced by the words" the official of the Customs Directorate'.
12. In Annex 2, the words "Article 118 (6) and 'shall be inserted after the words" the official person' and the words "the State price printer 'shall be deleted.
13. In Annex 3 (c), the words "and other tobacco 'and the words" and other tobacco' are deleted.
14. In Annex No 4, point 1, the words "a staff member working in a customs office 'are replaced by the words" an official of the customs office'.
15. In Annex 4, point 1 (c), the words "and other tobacco 'are deleted.
16. Annexes 6 and 7 shall be deleted, including the headings.
Efficacy
This Decree shall take effect on 1 August 2011.
