DECLARATION
of 30 June 2003
on animal health requirements for milk and milk products
The Ministry of Agriculture provides pursuant to Section 78 of Act No. 166 / 1999 Coll., on Veterinary Care and on the amendment of certain related laws (Veterinary Act), as amended by Act No. 131 / 2003 Coll., ("the Act ') for the implementation of Sections 20 (8), 21 (7), 22 (2) and 24 (2) of the Act:
(1) Raw milk, including raw milk intended for the manufacture of drinking heat-treated milk and milk products, must be obtained from animals which:
(a) satisfy the animal health requirements for animals of the species concerned laid down by law and by specific legislation1c);
(b) they do not come from a production farm, assembly centre, standardization centre, a milk treatment undertaking, a processing undertaking, a territory or part of a territory which is subject to restrictive or prohibited veterinary measures, adopted in the light of the occurrence of foot-and-mouth disease, classical swine fever, swine vesicular disease, African swine fever, rinderpest, Newcastle disease, avian influenza or small ruminants in accordance with the rules laid down by law and specific legislation1d) and relating to the animals and their products.
(2) The Regional Veterinary Administration may, in accordance with Article 49 (1) (g) of the Act and subject to the disease control measures referred to in paragraph 1 (a). (b) authorise the production, processing and putting into circulation of raw milk, consumed heat-treated milk and milk products originating in the territory or part of the territory which is subject to restrictions or prohibiting veterinary measures referred to in paragraph 1 (b) but not from a production holding in which the presence of one of the diseases referred to in paragraph 1 (b) has been confirmed. (b) or suspected of such a disease, provided that:
(a) are subject to the treatment provided for in Annex 4 to this Decree in an undertaking approved for that purpose;
(b) are clearly marked;
(c) have been obtained, processed, stored and transported in a space or in time separate from animal products complying with all animal health requirements and the Regional Veterinary Administration has approved the conditions for their transport from the territory or part of the territory subject to restrictions or prohibiting veterinary measures.
Efficacy
(1) This Decree takes effect on the date of its publication, with the exception of Paragraph 6 (1) (a) (2), which takes effect on the date of entry into force of the Treaty of Accession of the Czech Republic to the European Union.
(2) Paragraphs 6 (1) (a) (1) and 16 (1) expire on the date of entry into force of the Treaty of Accession of the Czech Republic to the European Union.
