THE LAW
of 3 May 2005
amending Act No. 435 / 2004 Coll., on Employment, as amended
Parliament has decided on this law of the Czech Republic:
Act No. 435 / 2004 Coll., on Employment, as amended by Act No. 168 / 2005 Coll., is amended as follows:
1. in Paragraph 13 (3) (c):
"(c) the legal or natural person shall:
1. any other legal or natural person who has the activities to be entrusted to him or her included in the subject matter of his or her activity and will be provided by his or her staff; or
2. another natural person who is to be entrusted with the activities to be carried out by him shall be included in the subject matter of the activity and shall not carry out the tasks entrusted to him in a disguised employment relationship.
The operation of the entrusted activity must fulfil the characteristics of the business within the meaning of Section 2 (1) of the Commercial Code. Paragraph (a) shall apply mutatis mutandis. ';
2. Paragraph 13 (4) is deleted.
This Act shall take effect on the day of its publication.
