DECLARATION
of 14 April 2004
on measures to prevent and combat African swine fever
The Ministry of Agriculture provides pursuant to Section 78 of Act No. 166 / 1999 Coll., on Veterinary Care and on the amendment of certain related laws (Veterinary Act), as amended by Act No. 131 / 2003 Coll., ("the Act ') for the implementation of Sections 10 (3) (a) and (g) and Article 51a (3) of the Act:
§ 1
Subject matter
This decree regulates in accordance with the law of the European Community1)
(a) the notification of African swine fever, the contingency plan for the occurrence of African swine fever ("the contingency plan"), the animal health programme ("the recovery programme") and their vaccination,
(b) measures to combat African swine fever;
(c) animal health measures from African swine fever.
§ 2
Definition of terms
For the purposes of this decree, the term
(a) pig - any animal of the Suidae family, including wild boar;
(b) wild swine - a pig which is not kept or kept on the holding,
(c) holdings - any agricultural or other premises in which pigs are kept or kept permanently or temporarily; that term does not include slaughterhouses, means of transport and disciplines, (2) in which wild pigs are kept and may be hunted; such disciplines must be of such size and arrangement as do not permit the application of the measures provided for in Article 5 (1);
(d) the swine suspected of African swine fever virus infection - any pig or pig body showing such clinical signs, post-mortem changes or results of laboratory tests carried out in accordance with the procedures laid down in the Manual to ensure uniform diagnosis of African swine fever ("the Diagnostic Manual"), issued by the State Veterinary Administration and corresponding diagnostic manual approved by the European Commission ("the Commission"), indicating the possibility of African swine fever being present,
(e) the case of African swine fever or swine infected with African swine fever - any pig or pig body in which the presence of African swine fever has been officially confirmed due to clinical signs or post-mortem changes, or where the presence of African swine fever has been officially confirmed following a laboratory examination carried out in accordance with the diagnostic manual;
(f) an outbreak of African swine fever - a holding where one or more cases of African swine fever have been detected,
(g) a primary outbreak - a holding or other place where the animals are collected and where one or more cases of disease not related from an epidemiological point of view to an outbreak previously found in the same area or an outbreak which is the first outbreak of that disease in that area have been officially confirmed;
(h) the infected area - the area of a Member State of the European Union (hereinafter referred to as "the Member State") in which, after confirmation of one or more cases of African swine fever in feral pigs, enforcement measures are applied in accordance with § 15 or § 16;
(i) the primary outbreak of African swine fever in feral pigs - any case of African swine fever detected in feral pigs in an area where measures are not applied in accordance with § 15 or § 16;
(j) contact holdings - holdings into which African swine fever may have been introduced either as a result of the location of the holding or as a result of movements of persons, pigs or means of transport, or by any other means;
(k) breeder - any natural or legal person who owns pigs or is responsible for holding pigs, both for remuneration and free of charge;
(l) the competent authority - the central authority of the Member State authorised to carry out veterinary checks or another authority of the Member State to which that competence has been conferred;
(m) processing - one of the methods of processing high-risk confiscates of animal origin provided for in an immediately binding European Community legislation, (3) used in a way that avoids the risk of spread of the African swine fever virus;
(n) culling - killing of pigs without bleeding in accordance with specific legislation, 4)
(o) slaughter - killing of pigs for use in accordance with specific legislation, 5)
(p) vector - tick of the species Ornithodorus erraticus.
§ 3
African swine fever report
(1) The occurrence of African swine fever or the suspected presence of African swine fever is, in accordance with Articles 11 and 12 of the Act, compulsorily and without delay reported to the Regional Veterinary Administration or the Municipal Veterinary Administration in Prague (the Regional Veterinary Administration).
(2) Without prejudice to the provisions of specific legislation on the notification of outbreaks of animal diseases, the State Veterinary Administration, if African swine fever is confirmed in the Czech Republic,
(a) report the disease to the Commission and the other Member States in accordance with Annex 1 thereto and provide information on:
1. outbreaks of African swine fever confirmed on holdings,
2. cases of African swine fever confirmed in a slaughterhouse or means of transport;
3. the primary outbreaks of African swine fever confirmed in feral pigs,
4. the results of an epidemiological inquiry carried out in accordance with Article 8;
(b) in accordance with Articles 16 (3) (a) and 16 (4), provide the Commission and the other Member States with information on further cases confirmed in feral pigs in areas infected with African swine fever.
§ 4
Measures in cases of suspected African swine fever on the holding
(1) Where one or more pigs suspected of being infected with the African swine fever virus are present on the holding, the Regional Veterinary Administration shall, in accordance with Articles 13 and 49 (1) (d) of the Act and in accordance with the procedures laid down in the diagnostic manual, take immediate action to confirm or exclude the presence of that disease. The official veterinarian shall check that pigs on the holding are marked in accordance with specific legislation. 6)
(2) Where African swine fever cannot be ruled out on the holding, the Regional Veterinary Administration shall, in accordance with Articles 13 and 49 (1) (d) of the Act, immediately initiate, in the framework of the exercise of national veterinary surveillance, targeted monitoring (hereinafter referred to as "monitoring ') of that holding and shall in particular:
(a) all pigs of different categories on the holding have been counted and an inventory has been made indicating for each category of pigs the number of pigs already sick, dead or possibly infected; the inventory data shall be updated taking into account the birth and mortality of pigs during the suspected period; the information contained in this inventory must be submitted on request to the authorities exercising national veterinary supervision,
(b) all pigs on the holding have been kept in their housing or other places allowing their quarantine;
(c) no pigs enter or leave the holding; the county veterinary administration may, if necessary, extend the ban on movements from the holding to other animal species and require the application of appropriate measures to control rodents or insects;
(d) no pig bodies may be removed from the holding without the approval of the Regional Veterinary Administration, issued in accordance with Sections 13 and 49 (1) (d) of the Act;
(e) no pig meat and products derived from such meat, semen, egg cells or embryos of pigs, feed, tools, materials or waste through which the African swine fever virus may be transmitted could leave the holding without the agreement of the Regional Veterinary Administration, issued in accordance with Articles 13 and 49 (1) (d) of the Act; pigmeat and products derived from such meat, semen, egg cells or embryos of swine may not be removed from the holding for trade within the European Communities,
(f) the movement of persons to or from a holding was subject to the written consent of the Regional Veterinary Administration, issued in accordance with Sections 13 and 49 (1) (d) of the Act;
(g) the movement of means of transport to or from the holding was subject to the written consent of the Regional Veterinary Administration, issued in accordance with Sections 13 and 49 (1) (d) of the Act,
(h) appropriate disinfectants are used at the entry into and exit from the premises where pigs are housed and on the holding itself, and that all persons entering or leaving the pig holding comply with the relevant hygiene measures necessary to reduce the risk of spread of the African swine fever virus and that all means of transport are effectively disinfected before leaving the holding;
(i) an epidemiological investigation has been carried out in accordance with Article 8.
(3) If the disease situation so requires, the Regional Veterinary Administration
(a) may apply the measures provided for in Article 5 (1) on the holding referred to in paragraph 2; however, where the conditions allow, the Regional Veterinary Administration may restrict the application of such measures only to pigs suspected of being infected or infected with the African swine fever virus and to that part of the holding where those pigs are kept, provided that such pigs are housed, kept and fed completely separately from other pigs on the holding; a sufficient number of samples are always taken when pigs are slaughtered to confirm or disprove the presence of the African swine fever virus in accordance with the diagnostic manual;
(b) may define a temporary surveillance zone around the holding referred to in paragraph 2; for pigs in this zone, some or all of the measures referred to in paragraph 1 or 2 shall apply.
(4) If the measures referred to in paragraph 2 have been adopted, they may not be withdrawn until after the presence of African swine fever has been officially excluded.
§ 5
Measures in case of confirmation of African swine fever on the holding
(1) In cases where African swine fever has been officially confirmed on the holding, the competent authority shall, in accordance with Article 15 of the Act, order, in addition to the protection and control measures referred to in Article 4 (2), that:
(a) all pigs on the holding are immediately killed under official supervision in a manner preventing the spread of the African swine fever virus during transport or spent;
(b) in accordance with the diagnostic manual, a sufficient number of samples have been taken during the slaughter of pigs in order to determine the method of introduction of the African swine fever virus into the holding and the length of time the virus may have been present on the holding prior to the notification of the disease;
(c) carcases of dead or slaughtered pigs have been processed under the supervision of an official veterinarian;
(d) the meat of pigs slaughtered in the period between the probable introduction of the disease into the holding and the adoption of official measures has, where possible, been traced and processed under official supervision;
(e) semen, ova and embryos of swine collected on the holding between the probable introduction of the disease into the holding and the adoption of official measures have been traced and destroyed under official supervision in a manner preventing the spread of the African swine fever virus;
(f) all wastes, materials, articles and substances which may be contaminated have been processed and disposed of and any disposable materials which may be contaminated, in particular those used in the destruction of animals, must be carried out in accordance with the instructions of the official veterinarian;
(g) buildings used for housing pigs, means of transport used for transporting pigs or their bodies, equipment, bedding, manure and slurry which may be contaminated, have been cleaned after removal of the pigs and, where appropriate, disinfected and disinfected in accordance with § 12;
(h) in the case of a primary outbreak, the virus isolate has been subjected to laboratory testing for the purpose of determining the genetic type by the procedure laid down in the diagnostic manual;
(i) an epidemiological investigation has been carried out in accordance with Article 8.
(2) In cases where the outbreak has been confirmed in the breeding of experimental animals, zoos, branches, game reservations or in the enclosed territory where pigs are kept for scientific purposes or for the conservation of species or rare breeds, the State Veterinary Administration may decide to exempt from paragraph 1 (a) and (e) provided that the essential interests of the European Communities are not adversely affected; Article 48 (1) (o) (2) of the Law shall immediately inform the Commission thereof.
§ 6
Measures in case of confirmation of African swine fever in holdings consisting of different epidemiological units
(1) Where the presence of African swine fever is confirmed in holdings consisting of two or more separate epidemiological units, the competent authority may, in accordance with Article 15 of the Act, decide to exempt from the provisions of Section 5 (1) (a) for the epizootic unit of healthy pigs in the infected holding, provided that the official veterinarian has confirmed that the layout, size and distance of those epizootic units and the activities carried out in those units allow a complete separation of the facilities serving housing, holding and feeding, and the virus cannot thus spread from one epidemiological unit to another.
(2) Where the procedure referred to in paragraph 1 is followed, the Regional Veterinary Administration shall, in accordance with Article 15 of the Act, lay down detailed rules for its application, taking into account the possible provision of veterinary guarantees. The State Veterinary Administration shall immediately inform the Commission of its application in accordance with Articles 10 (2) and 48 (1) (o) (2) of the Act.
§ 7
Measures in contact holdings
(1) The holdings are recognised as contact holdings where the official veterinarian finds or assumes, on the basis of an epidemiological inquiry carried out in accordance with Article 8, the possibility of the introduction of African swine fever; introduction may take place either from other holdings to the holding referred to in § 4 or § 5 or from the holding referred to in § 4 or § 5 to other holdings; in those holdings, pending official exclusion of the presence of African swine fever, the measures provided for in Article 4 shall apply.
(2) Where the disease situation so requires, the Regional Veterinary Administration shall apply the measures provided for in Article 5 (1) in the contact holdings referred to in paragraph 1; in accordance with the diagnostic manual, sufficient samples shall be taken for the purpose of confirming or excluding the presence of African swine fever virus on those holdings when pigs are slaughtered.
§ 8
Epizootic investigation
(1) The Regional Veterinary Administration, in accordance with Articles 13 (1) (d) and 49 (1) (d) of the Act, carries out an epidemiological investigation to detect suspected cases or outbreaks of African swine fever by means of questionnaires prepared in the context of the contingency plans referred to in Article 21.
(2) The epidemiological investigation shall cover at least:
(a) the length of time during which the African swine fever virus may have occurred on the holding prior to the notification of the disease or suspected disease;
(b) the possible origin of African swine fever on the holding and the identification of other holdings where pigs may have been infected from the same source,
(c) the movement of persons, means of transport, pigs, pig carcases, semen, meat or other objects which may have carried the virus from or to the holdings concerned;
(d) the possibility that the spread of the disease was caused by vectors or wild pigs.
(3) Where the results of this investigation indicate that African swine fever may have spread from or to holdings situated in other Member States, the State Veterinary Administration shall immediately inform the Commission and the Member States concerned thereof.
§ 9
Definition of the protection and surveillance zones
(1) Following official confirmation of African swine fever in pigs on the holding, the Regional Veterinary Administration shall immediately establish a protection zone of at least three kilometres around the outbreak in accordance with Articles 15 and 49 (1) (d) of the Law. The protection zone shall be part of a surveillance zone with a radius of at least 10 kilometres. The measures referred to in paragraphs 10 and 11 shall apply in these zones.
(2) When defining zones, the Regional Veterinary Administration shall take into account:
(a) the results of an epidemiological inquiry carried out in accordance with Article 8;
(b) geographical location, in particular natural or artificial borders;
(c) location and distance of the holding;
(d) methods of movements of pigs and trade in pigs and the availability of slaughterhouses and facilities for the treatment of pig carcases;
(e) the availability of establishments and persons responsible for controlling the movement of pigs in zones, in particular where pigs intended for slaughter are to be removed from the holding of origin.
(2) Where the zone includes parts of the territory of several Member States, the Regional Veterinary Administration shall cooperate in defining it with the competent authorities of those States.
(3) The Regional Veterinary Administration shall take all necessary measures, including the use of signs, warning signs and mass media (printing and television), to ensure full information to all persons in the protection and surveillance zones on the restrictions in force in accordance with paragraphs 10 and 11 and shall take measures which it considers appropriate to ensure adequate enforcement of the abovementioned measures.
§ 10
Measures in the demarcated protection zone
(1) The Regional Veterinary Administration shall ensure, in accordance with Articles 15 and 49 (1) (d) and (f) of the Act, that the following measures are applied in the protection zone:
(a) making an inventory of all holdings as soon as possible; no later than seven days after the establishment of the protection zone, the official veterinarian shall carry out a clinical examination of pigs on the holding and check on the marking and registration of pigs under specific legislation, 5)
(b) the movement and transport of pigs on the road, with the exception, where necessary, of special purpose roads within the holding or by rail, shall be prohibited without the authorisation of the regional veterinary administration, allowing the movement referred to in (f); exceptionally, the Regional Veterinary Administration may authorise the transport of pigs by road or rail without unloading or stopping. Moreover, a derogation may be granted by decision of the institutions of the European Union for the transport of pigs for slaughter not originating in the protection zone and intended for immediate slaughter in slaughterhouses situated in the protection zone,
(c) means of transport and equipment for transporting pigs or other farmed animals or for transporting materials which may be contaminated, such as carcases of animals, feed, manure, slurry, etc., shall be cleaned, disinfected as soon as possible after pollution, or disposed of insects in accordance with § 12; no means of transport for transporting pigs may leave the zone without cleaning, disinfection and subsequent inspections and re-authorisation of transport by the county veterinary authorities;
(d) no other livestock or pet animals may enter or leave the holding without the authorisation of the Regional Veterinary Administration;
(e) all dead or sick animals on the holding shall be reported without delay to the Regional Veterinary Administration, which shall carry out appropriate investigations in accordance with the procedures laid down in the diagnostic manual;
(f) pigs shall not be removed from the holding on which they are kept for at least 40 days after completion of preliminary cleaning, disinfection, or disinsectisation of infected holdings; after 40 days, the Regional Veterinary Administration may authorise the removal of pigs from that holding for direct transport, subject to the conditions laid down in paragraph 3.
1. to slaughterhouses designated by the Regional Veterinary Administration, preferably located in the protection or surveillance zone, for immediate slaughter;
2. to a processing plant or an appropriate place where pigs are immediately killed and their bodies processed under the supervision of an official veterinarian;
3. in exceptional circumstances to other areas situated in the protection zone; The State Veterinary Administration shall immediately inform the Commission, through the Standing Veterinary Committee, if this provision is applied,
(g) semen, ova and embryos shall not leave the holding situated in the protection zone;
(h) all persons entering or leaving a pig holding comply with the relevant hygiene measures necessary to reduce the risk of spread of the African swine fever virus.
(2) Where the prohibitions laid down in paragraph 1 are complied with for more than 40 days due to further outbreaks, the Regional Veterinary Administration may, with regard to the protection and well-being of animals or other problems linked to the breeding of pigs, on the basis of a reasoned request from the breeder, authorise the removal of pigs from the holding in the protection zone for direct transport
(a) to slaughterhouses designated by the Regional Veterinary Administration, preferably located in the protection or surveillance zone, for immediate slaughter;
(b) to a processing plant or an appropriate place where pigs are immediately killed and their bodies processed under the supervision of an official veterinarian;
(c) in exceptional circumstances to other areas situated in the protection zone; The State Veterinary Administration shall immediately inform the Commission, through the Standing Veterinary Committee, if this provision is applied.
(3) If the provisions of this decree so provide, the Regional Veterinary Administration may authorise the removal of pigs from the holding concerned, provided that:
(a) the official veterinarian has carried out a clinical examination of pigs on the holding, in particular those to be removed from the holding, including the measurement of body temperature, in accordance with the procedures laid down in the diagnostic manual, and has carried out checks on the marking and registration of pigs under specific legislation, 5)
(b) the checks and tests referred to in (a) have not shown African swine fever and have shown compliance with specific legislation, 5)
(c) pigs are transported in means of transport sealed by the Regional Veterinary Administration;
(d) the means of transport used for the transport of pigs shall be cleaned and disinfected immediately after transport in accordance with Section 12;
(e) where pigs are to be slaughtered or killed, a sufficient number of samples shall be taken from them in accordance with the diagnostic manual to confirm or exclude the presence of African swine fever virus in those holdings;
(f) if pigs are to be transported to slaughterhouses,
1. the Regional Veterinary Administration responsible for slaughterhouses has been informed of the intention to send pigs and the sending Regional Veterinary Administration will report their arrival;
2. on arrival at the slaughterhouse, these pigs are kept and slaughtered separately from other pigs,
3. during the ante-mortem and post-mortem inspection carried out in designated slaughterhouses, the Regional Veterinary Administration shall take into account any signs of African swine fever,
4. Fresh meat originating from such pigs shall be either processed or labelled in the manner specified in the specific legislature7) and processed separately in accordance with the specific legislation; 8) these activities shall be carried out exclusively in an undertaking designated by the Regional Veterinary Administration. The meat must be dispatched to that undertaking on condition that the consignment is sealed before dispatch and must remain so throughout the shipment.
(4) The measures applied in the protection zone shall be complied with at least until:
(a) cleaning, disinfection, or disinsectisation, where appropriate, is carried out in infected holdings;
(b) pigs on all holdings undergo clinical and laboratory tests carried out in accordance with the diagnostic manual to detect the possible presence of African swine fever virus; Such tests shall be carried out not earlier than 45 days after completion of preliminary cleaning, disinfection, or disinsectisation in infected holdings.
(5) By way of derogation from paragraph 1 (f) and paragraphs 2 and 4, periods of 40 days and 45 days may be reduced to 30 days where an intensive sampling and sampling programme has been applied in accordance with the diagnostic manual to avoid the presence of African swine fever on the holding concerned.
§ 11
Measures in the established surveillance zone
(1) The Regional Veterinary Administration, in accordance with Articles 15 and 49 (1) (d) and (f) of the Act, shall ensure that the following measures are applied in the surveillance zone:
(a) making an inventory of all pig holdings;
(b) the movement and transport of pigs on the road, with the exception, where appropriate, of special purpose roads within the holding or by rail, shall be prohibited without the authorisation of the regional veterinary administration; that prohibition does not have to apply to the transport of pigs on roads or railways without unloading or stopping, or to pigs for slaughter not originating in the surveillance zone and intended for immediate slaughter, and to their transport to slaughterhouses situated in the surveillance zone,
(c) means of transport for the transport of pigs or other livestock or for the transport of materials which may be contaminated, such as bodies of animals, feed, manure, slurry, etc., shall be cleaned, disinfected as soon as possible after pollution, or disposed of insects in accordance with § 12; no means of transport used for the transport of pigs may leave the zone without cleaning and disinfection;
(d) no other livestock or pet animals may enter or leave the holding without the authorisation of the Regional Veterinary Administration during the first seven days following the establishment of the surveillance zone;
(e) all dead or sick animals on the holding shall be reported without delay to the Regional Veterinary Administration, which shall carry out appropriate investigations in accordance with the procedures laid down in the diagnostic manual;
(f) pigs shall not be removed from the holding on which they are kept for at least 30 days after completion of the preliminary cleaning, disinfection and, where appropriate, disinfection of infected holdings;
1. after 30 days the Regional Veterinary Administration may authorise the removal of pigs from that holding for direct transport, subject to the conditions laid down in Article 10 (3)
(aa) to slaughterhouses designated by the Regional Veterinary Administration, preferably located in the protection or surveillance zone, for immediate slaughter;
(bb) to a rendering establishment or an appropriate place where pigs are killed and their bodies are processed under the supervision of an official veterinarian; or
(cc) in exceptional circumstances to other areas situated in the protection or surveillance zone. The State Veterinary Administration shall immediately inform the Commission, through the Standing Veterinary Committee, if this provision is applied,
2. where pigs are to be transported to slaughterhouses at the request of a Member State which is duly justified and is in accordance with a decision of the institutions of the European Union, exemptions from Article 10 (3) (e) and (f) (4) may be granted, in particular with regard to the labelling of meat from such pigs, their continued use and the identification of processed products,
(g) semen, ova and embryos shall not leave the holding situated in the surveillance zone;
(h) all persons entering or leaving a pig holding comply with the relevant hygiene measures necessary to reduce the risk of spread of the African swine fever virus.
(2) Where the prohibitions laid down in paragraph 1 are complied with for more than 40 days because of further outbreaks of the disease, the Regional Veterinary Administration may, with a view to the protection and well-being of animals or other problems related to the breeding of pigs, subject to the conditions laid down in Article 10 (3), upon a reasoned request from the breeder, authorise the removal of pigs from the holding in the surveillance zone for the purpose of direct transport
(a) to slaughterhouses designated by the Regional Veterinary Administration, preferably located in the protection or surveillance zone, for immediate slaughter;
(b) to a rendering plant or to an appropriate place where pigs are immediately killed and their bodies processed under the supervision of an official veterinarian; or
(c) in exceptional circumstances to other areas situated in the protection or surveillance zone; The State Veterinary Administration shall immediately inform the Commission, through the Standing Veterinary Committee, if this provision is applied.
(3) The measures applied in the surveillance zone shall be complied with at least until:
(a) cleaning, disinfection, or disinsectisation, where appropriate, is carried out in infected holdings;
(b) pigs on all holdings undergo clinical and laboratory tests carried out in accordance with the diagnostic manual to detect the possible presence of African swine fever virus; These tests shall be carried out not earlier than 40 days after completion of preliminary cleaning, disinfection, or disinsectisation in infected holdings, as appropriate.
(4) By way of derogation from paragraph 1 (f) and paragraphs 2 and 3, the 30-day periods laid down in paragraph 1 (f) may be reduced to 21 days, the 40-day periods laid down in paragraph 2 may be reduced to 30 days and the 40-day periods laid down in paragraph 3 may be reduced to 20 days if an intensive sampling and sampling programme has been applied in accordance with the diagnostic manual to exclude the presence of African swine fever in the holding concerned.
§ 12
Cleaning, disinfection, disinsection
Cleaning, disinfection and disinsects ordered in accordance with § 13 (1) (c) and § 49 (1) (d) of the Act are carried out
(a) approved disinfectant and insecticidal agents and in concentrations approved by the Regional Veterinary Administration;
(b) under official supervision in accordance with the instructions of the official veterinarian and in accordance with the principles and procedures laid down in Annex 2 to this Regulation.
§ 13
Repopulation in pig holdings
(1) The re-housing of pigs on the holdings referred to in § 5 may take place at least 40 days after completion of cleaning, disinfection or disinsectisation on the holding concerned in accordance with paragraphs 2 to 5.
(2) The restocking of pigs corresponds to the farming method used on the holding concerned and to one of the procedures laid down in paragraphs 3 and 4.
(3) In the case of holdings where the presence of the disease was not linked to vectors, the following procedure shall apply:
(a) in the case of open-air breeding, the rehousing of pigs begins with the housing of marker pigs which have been examined and which have shown a negative result in the test for the presence of antibodies to the African swine fever virus or come from holdings not subject to restrictions as a result of African swine fever; Indicator pigs shall be spread throughout the infected holding in accordance with the requirements of the Regional Veterinary Administration and shall be sampled after 45 days in accordance with the diagnostic manual for the presence of antibodies; no pig may leave the holding before negative results are obtained; if none of the pigs have developed antibodies to the African swine fever virus, full housing may occur,
(b) for all other farming practices, the rehousing of pigs shall be carried out either in accordance with the measures laid down in (a) or based on full rehousing provided that:
1. all pigs are housed within 20 days at the latest and come from holdings not subject to restrictions as a result of African swine fever;
2. pigs in repopulated herds shall be subjected to a serological examination in accordance with the diagnostic manual; samples for this examination shall be taken at least 45 days after the last pigs are housed;
3. no pig may leave the holding before negative results are obtained.
(4) In the case of holdings where the presence of the disease has been associated with vectors, re-housing shall not take place for at least six years, except where specific measures have been successfully taken under official supervision to remove vectors from the premises and places where pigs are to be kept or may come into contact with vectors, or it has been demonstrated that the persistence of vectors no longer poses a serious risk of transmission of African swine fever. Subsequently, the measures provided for in paragraph 3 (a) shall apply; outside those measures, no pig may leave the holding concerned after being fully rehoused before further serological testing of samples taken from pigs on the holding has been carried out in accordance with the diagnostic manual and with a negative result, at least 60 days after complete restocking, on African swine fever.
(5) Where the presence of the disease has not been associated with vectors and where more than six months have elapsed since the completion of the cleaning and disinfection on the holding, the Regional Veterinary Administration may, in accordance with Articles 15 and 49 (1) of the Act, allow an exemption from the provisions of paragraph 3, taking into account the disease situation.
(6) The re-housing of livestock or pet animals of other species in the holding described in Section 5 shall be subject to the authorisation of the Regional Veterinary Administration, taking into account the risk of spread or persistence of vectors associated with such resettlement.
§ 14
Measures in cases of suspected African swine fever or confirmation of African swine fever in slaughterhouses or means of transport
(1) Where African swine fever is suspected in a slaughterhouse or means of transport, the Regional Veterinary Administration shall, in accordance with Articles 15 and 49 (1) (d) of the Act, immediately take measures to confirm or exclude the presence of that disease in accordance with the procedures laid down in the diagnostic manual.
(2) Where an African swine fever case is detected in a slaughterhouse or means of transport, the Regional Veterinary Administration shall ensure, in accordance with Articles 15 and 49 (1) (d) of the Act, that:
(a) all susceptible animals in the slaughterhouse or means of transport have been killed without delay;
(b) bodies, offal and animal waste from animals which may have been infected are processed under the supervision of an official veterinarian;
(c) cleaning, disinfection, or disinfecting of buildings and equipment, including means of transport, are carried out under the supervision of an official veterinarian and in accordance with Section 12;
(d) the epidemiological investigation provided for in Article 8 has been carried out with the necessary adaptations;
(e) the African swine fever virus isolate has been subjected to the laboratory procedure laid down in the diagnostic manual for the purpose of determining the genetic type;
(f) the measures referred to in Article 7 have been applied on the holding of origin of the pigs or pig bodies and on the contact holdings; if other circumstances are not established by an epidemiological inquiry, the measures provided for in Article 5 (1) shall apply on the holding of origin of the pigs or pig bodies;
(g) no animals have been slaughtered or transported at least 24 hours after completion of the cleaning, disinfection or disinsectisation carried out in accordance with § 12.
§ 15
Measures in cases of suspected African swine fever or confirmation of African swine fever in feral pigs
(1) Where the Regional Veterinary Administration has been informed, in accordance with Articles 15 and 49 (1) (d) of the Act, that wild boar is suspected of being infected, it shall take all appropriate measures to confirm or exclude the presence of the disease, inform the pig breeders and the wander9 users and examine all wild boar caught or killed, including laboratory testing.
(2) The Regional Veterinary Administration in accordance with Articles 15 and 49 (1) (d) of the Act immediately after confirmation of the primary case of African swine fever in feral pigs in order to reduce the spread of the disease
(a) establish an expert group, consisting of veterinary surgeons, hunters, biologists dealing with wild animals and epidemiologists, with the task of cooperating with the Regional Veterinary Administration in:
1. examination of the disease situation and determination of the infected area in accordance with Article 16 (3) (b);
2. the establishment of appropriate measures to be applied in the infected area in addition to those referred to in points (b) and (c); such measures may include suspension of fishing and prohibition on feeding wild boar,
3. drawing up a plan for the eradication of the disease in accordance with Article 16 to be submitted to the Commission,
4. the implementation of checks to verify the effectiveness of measures taken to eradicate African swine fever in the infected area;
(b) monitor holdings in a specified infected area of pigs, in particular to order that:
1. an official inventory of all categories of pigs has been made in all holdings; This list shall be updated by the breeder; the information contained in the inventory shall be submitted on request to the Regional Veterinary Administration and may be checked at each inspection; for open-air pigs, the first inventory carried out may be based on an estimate;
2. all pigs on the holding have been kept in their housing or other places allowing their quarantine where they can be permanently separated from wild boar; wild pigs shall not have access to any material which may subsequently come into contact with pigs on the holding;
3. no pigs entered the holding without the approval of the Regional Veterinary Administration based on the disease situation and issued in accordance with Sections 13 and 49 (1) (d) of the Act,
