on the details of the application for a test to demonstrate the special competence to operate radio equipment, the extent of the knowledge needed for each type of special competence, the method of conducting the tests, the types of certificates and their duration
According to § 109 (2) of Act No 151 / 2000 Coll., on Telecommunications and on the amendment of other laws, hereinafter referred to as "the Act", the Ministry of Transport and Communications provides for the implementation of § 67 (5) of the Act:
For the purposes of this decree:
(a) radio broadcasting equipment (hereinafter referred to as "stations") - one or more transmitters or a set of transmitters and receivers, including equipment of their accessories, necessary for the performance of the radio communications service;
(b) by the operator - a natural person who has demonstrated by examination that the station is fit to operate,
(c) air moving service - radio communications service between air and air stations or between air stations serving to ensure the safety of air traffic;
(d) by an aircraft station - a mobile station on board an aircraft;
(e) air station - ground station of air moving service,
(f) by an Earth station - a station located either on the surface of the Earth or in the main part of the Earth's atmosphere;
(g) ground-based aircraft station - a mobile ground-based satellite mobile station located on board an aircraft;
(h) land-based air station - land-based fixed satellite service station or mobile satellite station located at a fixed point on land to implement modulation connections for satellite air mobile service;
(i) maritime mobile service - radio communications service between coastal and marine stations or between ship stations serving to ensure the safety and operation of maritime navigation;
(j) radio telephony services on inland waterways - services between coastal stations and ship stations or between ship stations, or between coastal stations serving each other to ensure the safety and operation of inland navigation;
(k) by ship's station - a mobile station for maritime mobile services or radio telephony services on inland waterways located on board a vessel which is not permanently connected to land;
(l) coastal station - ground station of maritime mobile services or radio telephone services on inland waterways,
(m) abbreviation GMDSS - a global maritime distress and security system providing radio communications within the maritime mobile service;
n) Amateur radio communication service1) - radio communication service for self-education, for mutual links and technical studies carried out by amateurs, i.e. authorised persons interested in radio technology exclusively from personal interest and non-employment,
o) CEPT - European Conference of Postal and Telecommunications Administrations,
(p) radio communication operation - establishing, conducting and terminating radio communications.
Only persons with a valid special licence to operate such equipment may operate the service of radio broadcasting equipment.
Test Panel
Verification of the special competence shall be carried out by a test committee of at least three members whose chairman and other members shall be appointed by the Czech Telecommunications Office (hereinafter the Office) from among its staff or external experts.
Application for a test
(1) The written application for the test contains the following information:
(a) the name and surname of the tenderer;
(b) the date and place of birth;
(c) birth number,
(d) nationality,
(e) residence;
(f) employment,
(g) degree of education;
(h) the type of test required;
(i) two photographs measuring 35 mm x 45 mm for the certificate referred to in Article 10 (1) (a) to (g).
Persons under 18 years of age for an application for a test shall support the written consent of their legal representatives.
(2) A certificate of practical training in the use of GMDSS communication techniques issued by applicants for a licence pursuant to Article 10 (1) (c) and (d) is a mandatory part of the application for a licence, issued by applicants by a training centre recognised by the maritime authority of the Member State of the International Maritime Organisation (IMO).
(3) The prescribed training for applicants for a licence referred to in Article 10 (1) is a basic education with the exception of points (c) and (d), where secondary vocational education is required. For applicants for a licence under Section 10 (1) (h), the requirement for education shall be waived.
(4) The minimum age required for obtaining a licence under Article 10 (1) (c), (d), (e) and (g) is 18 years, for obtaining a licence under points (a), (b) and (f) is 16 years and for obtaining a licence under point (h) is 15 years.
(5) Only a tenderer who:
(a) submit a written application in accordance with paragraph 1, supported where appropriate under paragraph 2;
(b) at the time of the examination, he has achieved the necessary education in accordance with paragraph 3;
(c) has reached the age referred to in paragraph 4 at the time of the examination.
Scope of the knowledge required for each type of licence
(1) Each test consists of the following test areas:
(a) radio communications regulations;
(b) radio communications operations;
(c) electrical engineering and radiotechnology,
(d) a practical test of telegraphy, if required for that competence.
(2) The examination in the field of radio communications regulations for obtaining a licence pursuant to Article 10 (1) (a), (c), (d) and (e) for the performance of services at sea mobile stations also includes a World Geography Knowledge test and an English communication test.
(3) For applicants for a licence as referred to in Section 10 (1) (a), the examination shall include the verification of the knowledge of the aviation faceology.
(4) The Office shall publish in the Telecommunications Bulletin the test syllabus and the test procedure for each type of licence in accordance with the development of existing regulations, the development of techniques and the requirements of practice.
Method of conducting the tests
(1) The candidate shall normally take the test at the seat of the Examination Board at the time specified by the Test Panel. Where an examination is carried out at the request of candidates outside the seat of the Examination Board, the applicant shall reimburse the travel expenses incurred by the Examination Board on the basis of the examination site and back.
(2) The examination committee shall inform the applicant in writing of the time and place of the examination at least two weeks before the examination.
(3) If, for serious reasons, the candidate cannot attend the test, he shall notify the Examination Board no later than 3 days before the examination and shall request a new deadline if he insists on the examination.
Test run
(1) Before starting the examination, the Secretary of the Commission shall verify the identity of the tenderers and, in the cases referred to in Article 4 (2), shall check the evidence of the prescribed practice.
(2) The Chairman of the Examination Board shall direct the examination and monitor the testing from each test field, and may ask additional questions to the tenderers.
(3) Candidate of the exam takes place in Czech or Slovak language 2)
(4) In addition to the members of the test committee, only persons whose presence is authorised by the chairman of the test committee may be present at the test.
Assessment of test result
(1) The Trial Panel uses both two-degree overall tests for evaluation in individual test fields: good, bad.
(2) The candidate has passed the test if he has demonstrated knowledge of the substance prescribed by the test curriculum and has benefited in all test subjects.
(3) The candidate did not pass the test if at least one of the subjects was assessed as being of no benefit.
(4) The examination and the results of the examination committee shall be drawn up by a single form signed by the chairman and the examiners. The minutes shall be set up by the Examination Board together with an application for examination in a file kept by the Office at least five years after the date of the examination.
(5) In the event of successful passing of the examination, the chairman of the examination committee shall issue the candidate with the relevant licence according to the type of authorisation required, which shall include in particular:
(a) for the authorisation referred to in Article 3 (1) (a), (b), (c), (d), (e), (f), (g)
1. the name and date of birth of the licence holder;
2. licence number,
3. the date of issue and the period of validity of the licence;
4. a photograph and signature of the licence holder;
(b) for the authorisation referred to in Article 3 (1) (h)
First name,
2nd birth number,
3. amateur / CEPT class.
If the candidate failed the examination, he may take another examination on the basis of a new application pursuant to Section 4 at least 1 month.
Eligibility for station operators
(1) Only persons receiving a licence of the type concerned are authorised to operate the stations:
(a) a general licence for a mobile air traffic service radiotelefonist authorising its holders to perform radio-telephony service on any aircraft station, aircraft earth station, air station or aircraft earth station;
(b) a limited licence for a mobile air service radio operator authorising its holders to perform radio-telephony services for any aircraft or aircraft earth station operating on frequencies allocated solely to the air mobile or air mobile satellite service, provided that the control of the station consists solely in the operation of simple external controls;
(c) a general licence of a maritime mobile service operator authorising its holders to carry out their duties at ship stations, land stations and coastal stations operating in all GMDSS frequency bands;
(d) a limited licence for a maritime mobile service operator authorising its holders to perform their duties at ship stations and coastal stations operating in very short-wave GMDSS bands;
(e) a general licence for a radio-telephonist authorising its holder to perform radio-telephony services for ships and coastal stations in the radio-telephony service on inland waterways or for marine mobile stations;
(f) a limited licence for a radio-telephonist authorising the holder to perform radio-telephony services for ship stations and coastal stations in the radio-telephony service on inland waterways or for marine mobile stations in offshore waterways, provided that the station control consists solely in the operation of simple external controls;
(g) a certificate from a ground-based radio-telegraph operator authorising its holder to perform radio-telegraphic and radio-telephonic services at stations participating in ground-based radio-communications services operating in short wave bands;
h) an amateur station operator's licence authorising its holder to operate an amateur radio station corresponding to Class 1)
(2) The licences issued in accordance with paragraph 1 (a), (c), (d), (e), (f) and (h) are international.
(3) In order to provide training and training, stations and persons with no special competence to operate such stations may be operated under the supervision of the person holding the relevant licence.
Validity of the licence
(1) The card referred to in Article 10 (1) (h) has unlimited validity.
(2) The card referred to in Article 10 (1) (a), (b), (c), (d), (e), (f) and (g) shall be valid for five years.
(3) The Office may cancel the validity of the licence before the expiry of the period provided that its holder has committed a gross infringement of the law, decrees issued for the implementation of the law or measures of the Office published in the Telecommunications Bulletin.
(4) The validity of the licence referred to in paragraph 2 may be extended by the Office, at the written request of the holder, for a further period of five years. The licence holder may submit an application for an extension of the licence not earlier than 6 months before its expiry.
(5) An applicant for the renewal of a licence referred to in paragraph 2 shall support an application by confirming that its holder has worked for at least one year as an operator for stations for which the type of licence is required to operate.
(6) In the event of loss, damage or destruction of the licence, its holder may request the Office to issue a duplicate for a specified administrative fee.
Transitional and repeal provisions
(1) Licences issued before the date of application of this Order remain valid for the period specified therein.
(2) Operators referred to in Article 10 (1) (h) who have successfully passed the test of an amateur radio station operator under the previously applicable rules may apply to the Authority for the issue of a licence within one year of the entry into force of this Decree. In such a case, the Authority shall issue a pass without passing the test and for the operator class achieved by the applicant in accordance with the regulations previously in force.
(3) The following shall be deleted:
1. Proceeds of the Federal Ministry of Communications No 7574 / 1973-R / 1 on tests of on-board radio operators, registered in the amount of 28 / 1973 Coll.
2. The proceeds of the Federal Ministry of Communications No 6002 / 1977 amending and supplementing the Code on the testing of on-board radiooperators, registered in the amount of 15 / 1977 Coll.
3. The proceeds of the Federal Ministry of Transport and Communications No 8500 / 89-III-130 amending the Federal Ministry of Communications's Code on the testing of on-board radio operators, the Federal Ministry of Transport and Communications measures on the modification of the Permissions Conditions for the establishment and operation of broadcasting radio stations of mobile ground and fixed services and the Federal Ministry of Transport and Communications measures granting an exemption from the Code on the testing of ground-based radio operators, registered in the amount of 26 / 1989 Coll.
Efficacy
This decree shall take effect on the day of its publication.
