on the method of recording accidents, reporting and sending an accident record
The Government orders the implementation of Act No. 262 / 2006 Coll., Act No. 362 / 2007 Coll., as amended by Act No. 585 / 2006 Coll., Act No. 181 / 2007 Coll., Act No. 261 / 2007 Coll., Act No. 296 / 2007 Coll., Act No. 362 / 2007 Coll., Act No. 305 / 2008 Coll., Act No. 306 / 2008 Coll., Act No. 382 / 2008 Coll., Act No. 286 / 2009 Coll., Act No. 320 / 2009 Coll., and Act No. 326 / 2009 Coll., and Act No. 309 / 2006 Coll.
This Regulation implements the relevant provisions of the European Union1), following the directly applicable European Union2), and regulates the manner and content of the registration, reporting and transmission of an accident alert, the reporting of a fatal accident at work, the model of the accident record and the range of institutions and bodies reporting an accident at work and sending an accident alert.
(1) Employers (3) keep records of accidents in the injury book (4) in electronic or paper form. The record shall contain the following information:
(a) the name and, where applicable, the names and surnames (hereinafter referred to as "the name") of the accident of the disabled employee (5);
(b) the date and time of the accident;
(c) the place where the accident occurred;
(d) the activity in which the accident occurred;
(e) the number of hours worked immediately before the accident occurs;
(f) the total number of persons injured;
(g) the type of injury and the injured part of the body referred to in Annex 3 to this Regulation;
(h) a description of the accident;
(i) the type of accident (6);
(j) the source of the injury;
(k) the causes of the injury;
(l) the names of the accident witnesses,
(m) the name and working title of the person who recorded the data.
(2) If an accident occurred with another employer to whom the staff member has been established) or temporarily assigned 8), the information referred to in paragraph 1 shall be recorded by the employer in the accident books of the staff member affected and the employer to whom the staff member has been seconded or temporarily assigned by the accident.
(3) The employer shall, at his request, issue a certified copy or extract of the information in the injury book (9) of his accident; if there is a fatal accident, the employer shall issue them to the members of the family of the staff member on their application (9).
For statistical purposes, a fatal occupational injury shall mean health damage, the result of which an injured employee has died within 1 year at the latest.
(1) The employer shall report an accident at work without undue delay
(a) the territorial competent department of the Police of the Czech Republic, suggesting that a criminal offence has been committed in connection with a work accident,
(b) trade unions and representatives in the field of safety and health at work10),
(c) the relevant regional labour inspectorate, if any, has been injured by a natural or legal person subject to its control under another legislation 11), and if hospitalisation by an accident at the affected employee for more than 5 days or if, due to the nature of the injury, such hospitalisation period is expected,
(d) the competent district mining office, where the activity, workplace or technical equipment is subject to oversupervision under another legislation (12), if there is a serious occupational accident under another legislation (13);
(e) to the employer who has seconded or temporarily seconded a staff member to work with him.
(2) The employer shall report a fatal accident at work without undue delay
(a) the territorial competent department of the Police of the Czech Republic,
(b) trade unions and representatives in the field of safety and health at work;
(c) the relevant regional labour inspector, if any, has been injured by a natural or legal person subject to his control under another legislation;
(d) the competent district mining office, where the activity, workplace or technical establishment is subject to the supervision of a superior body under another legislation;
(e) the employer who has seconded or temporarily seconded a staff member to work with him;
(f) a health insurance undertaking with which a staff member has been insured by a fatal accident at work.
(1) An accident record shall be drawn up by the employer by the accident on the staff member affected without delay, but no later than 5 working days after the date on which he became aware of the accident. The accident record shall be transmitted by the employer to the authorised person15 without undue delay.
(2) The model of the accident alert is set out in Annex 1 to this Regulation.
The employer shall send an accident record for the preceding calendar month by the fifth day of the following month at the latest.
(a) the territorial competent department of the Police of the Czech Republic, suggesting that a criminal offence has been committed in connection with a work accident,
(b) the relevant regional labour inspectorate, if any, has been injured by a natural or legal person subject to its control under another legislation;
(c) to the competent district mining office, where the activity, workplace or technical equipment is subject to oversight under another legislation;
(d) a health insurance undertaking with which the worker is insured by an accident at work.
In the event of a fatal accident at work, the employer shall send an accident record no later than 5 days after the date on which he became aware of the accident,
(a) the territorial competent department of the Police of the Czech Republic,
(b) the relevant regional labour inspectorate, if any, has been injured by a natural or legal person subject to its control under another legislation;
(c) to the competent district mining office, where the activity, workplace or technical equipment is subject to oversight under another legislation;
(d) a health insurance undertaking with which a staff member has been insured by a fatal accident at work.
The employer shall send, for the purposes of the liquidation of claims, a record of the accident at work or occupational disease and of the organisational unit of the insurance undertaking with which the insurance is insured for this purpose (16).
(1) If an accident alert has been sent by the employer in accordance with Sections 6 and 7 and subsequently the employer becomes aware of the facts that lead to the change in the information referred to therein, the employer shall make an accident report on the accident by the accident worker.
(2) The accident record - the change report shall be made by the employer by the accident on the staff member affected if:
(a) the hospitalisation of the disabled employee's accident exceeded 5 consecutive days and was terminated after the entry of the accident record;
(b) temporary incapacity for work by accident on the part of the staff member affected as a result of the accident is terminated after the alert on the accident has been sent;
(c) the staff member affected by the accident has died within 1 year at the latest;
(d) there has been a change in the assessment of the source or cause of the accident, the nature of the accident and, where appropriate, other factors affecting the processing and content of the accident record - the reporting of changes;
(e) an additional incapacity for work has been created and terminated following the same accident at work.
(3) The accident record - the report of changes will be sent by the employer by the accident at the latest by the fifth day of the following month.
(a) the relevant regional labour inspector, if any, has been injured by a natural or legal person subject to his control under another legislation;
(b) the competent district mining office, where the activity, workplace or technical equipment is subject to the supervision of a superior body under another legislation;
(c) the health insurance undertaking in which the worker is insured by an accident at work;
(d) the territorial competent department of the Police of the Czech Republic, suggesting that a criminal offence has been committed in connection with a work accident or in the event of a fatal occupational accident.
(4) The employer shall send a record of the accident - notification of the changes and the organisational component of the insurance undertaking with which the insurance is insured for this purpose - for the purpose of the liquidation of insurance claims on the grounds of the employer's statutory liability for damage caused by an accident at work or occupational disease and a fatal accident at work.
(5) Where there has been a change in the assessment of the source or cause of the accident, the nature of the accident and, where appropriate, other factors affecting the processing and content of the accident record - the notification of changes - the employer shall forward one copy of the accident record - the notification of changes by accident to the worker and, in the event of a fatal accident at work, to his family members.
(6) The model of the accident record - the notification of amendments is set out in Annex 2 to this Regulation.
(1) The accident record and the accident record - the change report shall be sent by the employer electronically or in paper form.
(2) Where an accident or accident alert is sent electronically, the form referred to in Annex 1 to this Regulation or Annex 2 to this Regulation may be used; The Ministry of Labour and Social Affairs shall make the forms available in a way that allows remote access.
The competence of the department of the Police of the Czech Republic and the administrative authorities pursuant to Sections 4, 6, 7 and 8 shall be governed by the place where the accident or fatal occupational injury occurred.
Government Regulation No. 494 / 2001 Coll., laying down the method of recording, reporting and sending an accident alert, the model of the accident record and the circle of institutions and bodies reporting an accident at work and sending an accident alert shall be deleted.
This Regulation shall enter into force on 1 January 2011.
