amending Decree No 383 / 2001 Coll., on the details of waste management, as amended, and Decree No 294 / 2005 Coll., on the conditions for the disposal and use of waste on the terrain and amending Decree No 383 / 2001 Coll., on the details of waste management, as amended
The Ministry of the Environment provides pursuant to § 14 (6), § 19 (3), § 21 (5), § 37x (4) and § 45 (3) of Act No. 185 / 2001 Coll., on waste and on the amendment of certain other laws, as amended by Act No. 188 / 2004 Coll., Act No. 7 / 2005 Coll., Act No. 314 / 2006 Coll., Act No. 154 / 2010 Coll., Act No. 229 / 2014 Coll., Act No. 223 / 2015 Coll. and Act No. 45 / 2019 Coll.:
Decree No. 383 / 2001 Coll., on Details of Waste Management, as amended by Decree No. 41 / 2005 Coll., Decree No. 294 / 2005 Coll., Decree No. 353 / 2005 Coll., Decree No. 351 / 2008 Coll., Decree No. 478 / 2008 Coll., Decree No. 61 / 2010 Coll., Decree No. 170 / 2010 Coll., Decree No. 35 / 2014 Coll., Decree No. 27 / 2015 Coll., Decree No. 83 / 2016 Coll., Decree No. 387 / 2016 Coll. and Decree No. 437 / 2016 Coll., is amended as follows:
1. In Paragraph 4 (5), the word 'which' is' is replaced by 'which'.
2. In Section 22, paragraphs 5 to 7 are added:
"(5) The model of the data reporting form referred to in Article 12 (1) (a) to (c) of Regulation (EU) 2017 / 852 of the European Parliament and of the Council of 17 May 2017 on mercury and repealing Regulation (EC) No 1102 / 2008 is set out in Annex 30 thereto.
(6) The model certificate referred to in Article 14 (1) to (3) of Regulation (EU) 2017 / 852 of the European Parliament and of the Council is set out in Annex 31 to this Regulation.
(7) The template for the statement referred to in Article 14 (4) of Regulation (EU) 2017 / 852 of the European Parliament and of the Council is set out in Annex 32 to this Regulation. '
3. In Section 24a, paragraph 8 is added:
"(8) The separate installation identification number shall be assigned to each waste facility carrying out the interim disposal of waste mercury, to each waste facility carrying out the conversion and, where appropriate, to the solidification of waste mercury and to each installation carrying out the permanent disposal of waste mercury. ';
4. The following Annexes 30 to 32 are added:

Decree No 294 / 2005 Coll., on the conditions for the disposal of waste into landfills and their use on the surface of the terrain and amending Decree No 383 / 2001 Coll., on the details of waste management, as amended by Decree No 341 / 2008 Coll., Decree No 61 / 2010 Coll., Decree No 93 / 2013 Coll. and Decree No 387 / 2016 Coll., are amended as follows:
1. In footnote 1, the second sentence is replaced by "Regulation (EU) 2017 / 852 of the European Parliament and of the Council of 17 May 2017 on mercury and repealing Regulation (EC) No 1102 / 2008 '.
2. In Article 1 (f), the words "temporary storage of metal 'are replaced by the words" interim disposal of waste'.
3. in Article 2 (w), including footnote 24,
"(w) by the provisional storage of waste mercury in accordance with the directly applicable European Union Regulation (24) as set out in Annex 4 to the Act under code D15 for more than one year.

4. § 9a, including the title:
Technical requirements for the temporary and permanent storage of waste mercury
(1) The facility for the temporary storage of waste mercury is a landfill of the S-hazardous waste group. The temporary disposal of waste mercury is subject to the specific requirements set out in Annex 13 to this Decree.
(2) Waste mercury can only be disposed of at the disposal of the S-hazardous waste group. In addition to the requirements of this Ordinance for the landfill of S-hazardous waste group, the requirements for the interim disposal of waste mercury referred to in Part A and Part B (6) and (8) of Annex 13 to this Ordinance shall be fulfilled in the permanent storage of waste mercury. ';
5. In Annex 4, point 8 (e), "temporary storage 'is replaced by" temporary storage' and "temporary storage 'is replaced by" temporary storage'.
6. In Annex No 5, Part A, points 2 and 3, the words "temporary storage 'are replaced by the words" temporary storage'.
7. In Annex 13, the words "temporary '," temporary', "temporary 'and" temporary' are deleted, the words "storage 'are replaced by the words" storage', the words "metallic 'and" metal' are replaced by the words "waste 'and the words" metal' are replaced by the words "waste '.
Efficacy
This Regulation shall enter into force on 1 September 2019.
