State Arbitration of the Czechoslovak Socialist Republic
of 18 December 1989
amending and supplementing Decree No. 38 / 1980 Coll.
The State Arbitration of the Czechoslovak Socialist Republic on the basis of proposals by the Ministry of Trade and Tourism of the Czech Socialist Republic and the Ministry of Trade and Tourism of the Slovak Socialist Republic and after consultation with the central authorities involved, pursuant to § 392 (2) of the Economic Code No. 109 / 1964 Coll., in the full version published under No. 80 / 1989 Coll.:
The Decree of the State Arbitration of the Czechoslovak Socialist Republic No. 38 / 1980 Coll., which issues the basic conditions for the supply of products supplied by internal trade organisations, is amended as follows:
1. § 2 is deleted.
2. Article 3, including the title, reads:
Preparatory contracts
(1) The organisations conclude preparatory contracts to improve the fulfilment of the needs of the internal market.
(2) In the contract of the organisation as a general rule
(a) negotiate, in accordance with the needs of the regular supply of sales and, where appropriate, other customer organisation units, the principles for drawing up the order and delivery plans;
(b) negotiate cases where a draft contract for the delivery of products (order) can be made by telephone and the method of its registration;
(c) negotiate a procedure for the disposal of stocks incurred by the supplier as a result of the fact that the total volume or volume of supplies in a particular range of products for which contracts for the supply of products have been concluded was lower than anticipated in the preparatory contract; in particular, agree on the procedure for organising after-sales events for consumers;
(d) negotiate further details on the application and handling of complaints. ";
3. Paragraph 5 (2) is deleted and footnote 3 is deleted. Paragraphs 3 to 5 shall be renumbered paragraphs 2 to 4.
4. In Section 8, the last sentence is deleted.
5. In Section 9, the second sentence is inserted after the words "vendors', the words" and the food establishments 1) '.
6. Paragraph 10 is deleted.
7. in Article 11 (1), point (d) shall be deleted;
8. In Article 11, paragraphs 2 and 3 are deleted; at the same time, the numbering of paragraphs is deleted and footnote 4 is deleted.
9. in Paragraph 14 (1) (b), the words "unless a shorter period is provided for in a separate Regulation (5)" shall be deleted; Note 5 is deleted.
10. In Paragraph 15 (2), the word "periodic penalty payments' is replaced by" delayed '. Note 6 is renumbered as No 2 and reads: "(2) Paragraph 13 of the Order of the State Arbitration of ČSSR No. 4 / 1986 Coll., on the Management of Packaging at the Delivery of Products."
11. Article 17 is deleted.
12. Paragraph 18 is deleted.
13. The heading above Section 19 reads: "Supplies of the State Company Packaging of Commerce."
14.
"(1) The provisions of this Order do not apply to the supply of the State firm Balírny of trade, Sections 3 (2) (a) to (c) and 4 to 7, 9, 13 to 16."
15. Paragraphs 2 and 4 shall be deleted in Paragraph 19. Paragraph 3 shall become paragraph 2.
16. Paragraph 21 is deleted.
17. § 22 is released.
18. Paragraph 23 shall be deleted; Note 7 is deleted.
This Decree shall take effect on 1 January 1990.
